The Department has determined: 2.1. The Respondent violated California Code of Regulations, Title 22, section 66265.16, in that on or about september 30, 1992, Respondents failed to meet training requirements. 2.3. The Respondents violated California Code of Regulations, Title 22, Section 66265.51, in that on. or about September 30, 1992, Respondents failed to have a contingency plan. Title 22, container holding hazardous waste was not closed. The Respondents violated California Code of Regulations, section 66265.174, in that on or about September 30, 1992, Respondents did not inspect areas used for container storage -or transfer at least on a weekly basis. 2.6. Based on the foregoing DETERMINATION OF VIOLATIONS, IT IS HEREBY ORDERED THAT: "."::: -' \ \ ' 3.1.1. ,Respondents shall immediately label all containers. o.f hazardous waste appropriately, as described and required in section 66262.34 of the California Code of Regulations, Title 22. " 3.1.2. Respondents shall immediately close all containers' holding hazardous waste, except when it is necessary to add or remove waste. 3.1.3. Site Access: Access to the site shall be provided at all reasonable times to employees, contractors, and consultants of ',."", the Department, and any agency having jurisdiction. Nothing in this Order is intended to limit in any way the right of entry or inspection that any agency may otherwise have by operation of any law. SamDlina. Data. ,nd Document Availability. Respondents , .., ., , ~\ shall permit the Department and its authorized representatives to inspect and copy all sampling, testing, monitoring, and other data generated by Respondents or on Respondents' s behalf in any way pertaining to work undertaken pursuant to this Order. Respondents shall allow the Department and its authorized representatives to take duplicates of any samples collected by Respondents pursuant to or ' ~this cOrder.' - Respondents shalL maintain a central,deposi tory, of the data, reports, and other documents prepared pursuant to this Order. All such data, reports, and other documents shall be preserved by Respondents for a minimum of six years after the conclusion of all acti vi ties under this Order. If the Department requests that some or all of these documents be preserved for a longer period of time, Respondents shall either comply with that request, deliver the documents to the Department, or permit the Department to copy the ,- .. documents prior to destruction. Respondents shall notify the Department in writing at least six months prior to destroying any \ documents prepared pursuant to this Order. 3.10. Government Liabilities: The state of California shall ¡~ not be liable for injuries or damages to persons or property resulting from acts or omissions by Respondents or related parties spacified in paragraph 3.16 in carrying out activities pursuant to -this Order, nor shall the state of California be held as a party to any contract entered into by Respondents or its agents in carrying 7. :j -. -. out activities pursuant to the Order. 3.11. Endanqerment durinq Implementation: In the event that the -Department determines that any circumstances or activity (whether or not pursued in compliance with this Order) are creating an imminent or substantial endangerment to the health or welfare of 5. e e I people on the site or in the surrounding area or tQ the environment, the Department may order Respondents to stop further implementation of this Order for such period of time as needed to abate the endangerment. Any deadline in this Order directly affected by a stop Work Order under this section shall be extended for the term of the stop Work Order. 3.7. Liability: Nothing in this Order shall constitute or be construed as a satisfaction or release from liability for any conditions or claims arising as a result of past, current, or . future operations of Respondents. Notwithstanding compliance with the terms of this Order, Respondents may be required to take further actions as are necessary to protect public health or welfare or the environment. 3.8. site Access: Access to the site shall be provided at all reasonable times to employees, contractors, and consultants of the Department, and any agency having jurisdiction. Nothing in this Order is intended to limit in any way the right of entry or inspection that any agency may otherwise have by operation of any law. The Department and its authorized representatives shall have the authority to enter and move freely about all property at the Site at all reasonable times for purposes including but not limited to: inspecting records, operating logs, and contracts relating to the site: reviewing the progress of Respondents in carrying out the terms of this Order: and conducting such tests as the Department may deem necessary. Respondents shall permit such persons to inspect and copy all records, documents, and other writings, 6. e e including all sampling and monitoring data, in any way pertaining to work undertaken pursuant to this Order. 3.9. SamDling. Data. and Document Availability. Respondents shall permit the Department and its authorized representatives to inspect and copy all sampling, testing, monitoring, and other data generated by Respondents or on Respondents's behalf in any way pertaining to work undertaken pursuant to this Order. Respondents shall allow the Department and its authorized representatives to take duplicates of any samples collected by Respondents pursuant to this Order. Respondents shall maintain a central depository of the data, reports, and other documents prepared pursuant to this Order. All such data, reports, and other documents shall be preserved by Respondents for a minimum of six years after the conclusion of all activities under this Order. If the Department requests that some or all of these documents be preserved for a longer period of time, Respondents shall either comply with that request, deliver the documents to the Department, or permit the Department to copy the documents prior to destruction. Respondents shall notify the Department in writing at least six months prior to destroying any documents prepared pursuant to this Order. 3.10. Government Liabilities: The state of California shall not be liable for injuries or damages to persons or property resulting from acts or omissions by Respondents or related parties specified in paragraph 3.16 in carrying out activities pursuant to this Order, nor shall the state of California be held as a party to any contract entered into by Respondents or its agents in carrying 7. e e out activities pursuant to the Order. 3.11. Additional Enforcement Actions: By issuance of this Order, the Department does not waive the right to take further enforcement actions. 3.12. Incorporation of Plans and ReDorts. All plans, schedules, and reports that require Department approval and are submitted by Respondents pursuant to this Order are incorporated in this Order upon approval by the Department. 3.13. Extension Request: If Respondents is unable to perform \ any activity or submit any document within the time required under this Order, the Respondents may, prior to expiration of the time, request an extension of time in writing. The extension request shall include a justification for the delay. 3.14. Extension ApDrova1s: If the Department determines that good cause exists for an extension, it will grant the request and specify in writing a new compliance schedule. 3.15. Penalties for Noncompliance: Failure to comply with the terms of this Order may also subject Respondents to costs, penalties, and/or punitive damages for any costs incurred by the Department or other government agencies as a resul t of such failure, as provided by HSC section 25188 and other applicable provisions of law. 3.16. Parties Bound: This Order shall apply to and be binding upon Respondents, and its officers, directors, agents, employees, contractors, consultants, receivers, trustees, successors, and assignees, including but not limited to 8. e e individuals, partners, and subsidiary and parent corporations, and upon any successor agency of the state of California that may have responsibility for and jurisdiction over the subject matter of this Order. Oil exiting drop by drop is not considered to be fiu-flowing. As a result of that inspection, violations of hazardous waste statues and regulations were identified. violations 1. These included inadequate training of all personnel involved in handling hazardous waste; no annual review of training; no training plan. 4. Specifically, used oil filters were not stored in containers. Schedule for Compliance Immediately, Mr. Piston shall: 1. Cease all discharge into the sump, located north of the office and main building. 2. Label all containers of hazardous waste appropriately, as described and required in section 66262.34 of the California Code of Regulations, Title 22. 3. Close all containers of hazardous waste, except when it is necessary to add or remove waste. 4. Inspect all areas used for container storage or transfer, at least weekly. Inspections should include looking for leaking containers and for deterioration of the containers and the ·containment system caused by corrosion or other factors. \ 5. Manage used oil filters in accordance with section 66266.130 of the California Code of Regulations, Title 22. If used oil filters are not to be handled as hazardous waste, the requirements as outlined in this Section must be met. The provisions of the plan shall be carried out immediately whenever there is a fire, explosion, or release of hazardous waste or hazardous waste constituents which could threaten human health or the environment. S. Environmental Protection Agency ("VSEPA") by § 1431(a) of the Safe Drinking Water Act ("the Act"), 42 V.S.C. § § 300f et. seQ., 300i(a). The authority to take these actions has been duly redelegated to the undersigned Chief, Drinking Water and Ground Water Protection Branch, Water Management Division, Region IX. DESCRIPTION OF RESPONDENTS 1. Respondent Macke- V ee Company is a company that does business in the 1 e e State of CaIüornia and is therefore a person within the meaning of § 1401(12) of the Act, 42 U.S.C. § '300£(12). 2. Respondent Mr. Piston is authorized to do business in the State of CaIüornia and is therefore a person within the meaning of § 1401(12) of the Act, 42 U.S.C. § 300£(12). 3. The Respondents own and/or operate an earthen sump ("the sump"), which may be an injection well as defined by 40 C.P.R. § 144.3, at the facility located at 4110 Wible Road, Unit D, Bakersfield, California ("the facility" or "Respondents' facility"). FINDINGS 3. On August 16, 1990, officials of the Kern County Department of Environmental Health Services ("KCDEHS") inspected the Respondents' facility and discovered that waste water from the washing and steam cleaning of engine parts was allowed to drain to the sump. 4. On October 9, 1991, the KCDEHS sent a notice of violation via certified mail to Respondent Macke- V ee Company, requiring removal and sampling of the soil and/or sludge in the sump within thirty (30) days (letter from Terry Gray to John Mackessy dated October 9, 1991). When the Respondent failed to comply, the KCDEHS sent a second notice of violation on December 26, 1991, requiring removal and sampling of the soil and/or sludge in the sump within fourteen (14) days (letter from Terry Gray to John Maclœssy dated December 26, 1991). The Respondent then conducted the required 2 e e sludge sampling and submitted the analytical results to the KCDEHS (letter from Duane R. Smith to Terry Gray dated February 4, 1992). The analytical results of the sludge sampling are listed in Appendix 1 and are incorporated herein by reference. 5. Based on the analytical results, the KCDEHS required Respondent Macke- Vee Company to close the sump and sample the underlying soil (letter from Terry Gray to John Mackessy dated March 9, 1992). The Respondent has not yet complied with this requirement. 6. The Respondents' facility is located directly above an underground source of drinking water, or USDW (see Appendix 2 for the definition of a USDW). At least three public drinking water wells are located within a one-quarter mile radius of the facility. The depth to groundwater in the part of Bakersfield where the facility is located is approximately 160 feet. 7. There are no confining zones of impermeable soils underlying the Respondents' facility that would restrict the movement of contaminants from the sump into the groundwater. The soils in this zone are permeable, allowing for the movement of contaminants from the Respondents' sump to the groundwater. 8. As shown in Appendix 1, many contaminants were discovered in the sludge in the well. Two contaminants in particular cause the most concern. The concentration of lead is six times the California Total Threshold limit Concentration (1TLC), making the sludge a hazardous waste under the state standards (see Appendix 2 for a definition of the TrLCs). Benzene is a known human carcinogen. These contaminants could migrate through the soil to the USDW, causing the water to exceed the Maximum 3 e e Contaminant Levels or MCLs (see Appendix 2 for a definition of the MCLs.) Based on analyses by USEP A's toxicologist, concentrations of these contaminants in drinking water at levels that exceed the MCLs could have the following health effects: a. Lead can damage the central and peripheral nervous system and the kidneys, and is especially harmful to infants and fetuses. b. Benzene is a known human carcinogen. Acute exposure to benzene may also result in central nervous system depression. 9. Based upon the data received, the USEP A finds that contaminants are likely to be present in a USDW that may present an imminent and substantial endangerment to the health of persons. Continued operation of the sump risks increased contamination of the groundwater by concentrations of contaminants that may endanger human health. 10. The USEP A has consulted with the Kern County Department of Environmental Health Services, the Central Valley Regional Water Quality Control Board, and the California Department of Toxic Substances Control to confirm the validity of the above information and to ascertain what actions such authorities are taking or will be taking regarding the Respondents' activities. 11. To date, no governmental action has been taken to protect the health of persons from contaminants that are likely to be present in a USDW due to Respondents' sump operations. 12. The USEP A therefore finds that the Order described below is authorized under § 1431 of the SDWA, 42 U.S.C. § 300i, and is necessary in order to protect the 4 ! ' e- e health of persons. ORDER 13. In considering the foregoing facts and findings, and taking into account the imminent and substantial endangerment to the health of persons, under authority of § 1431 of the SDWA, 42U.S.C. § 300i, I hereby order compliance with the following provisions: CEASE INJECI10N 14. To prevent the continued endangerment of the USDW and to protect the health of persons the Respondents shall: a. on the effective date of this Order, immediately cease injection of fluids from engine washing and steam cleaning into the sump; b. on the effective date of this Order, place a temporary cover over the sump which prevents the entrance of any fluids; c. provide USEP A with written certification within 48 hours of the effective date of this Order that they have complied with paragraphs 14.a. and 14.b. (see paragraph 19). WORK PlAN 15. Within forty-five (45) days of the effective date of this Order, the Respondents shall submit for USEP A's approval, and upon approval shall implement, a Work Plan for closure of the sump, as described in Appendix 3: Guidelines for Oosure of Shallow Disposal Wells, Case C. 5 e e- 16. H USEPA does not approve the Respondent's Work Plan specified in the preceding paragraph, the Respondents shall submit a new Work Plan incorporating USEPA's comments and instructions within ten (10) days of receiving notice that the Work Plan is unacceptable. Once the USEPA approves the Work Plan, the Respondents shall implement it and submit a final report within sixty (60) days of the date of approval. 17. Upon approval by USEP A, the Work Plan shall be deemed incorporated into this Order as if fully set forth herein. SUBMIITALS 18. Where this Order specifies that a matter is to be submitted to USEP A for its review and approval, unless otherwise specifically provided, the following provisions apply: a. USEP A shall notify the Respondents in writing as to whether USEP A approves or disapproves the submittal. b. If the submittal is not approved, USEP A shall specify in writing the reasons for the disapproval, and Respondents shall, within ten (10) days of receipt of such notice, submit a response which shall address each deficiency identified by USEP A by modifying the submittal. GENERAL PROVISIONS 21. The provisions of this Order shall apply to, and be binding upon, the Respondents, their officers, directors, agents, successors and assigns. Notice of this Order shall be given to any successors in interest prior to transfer of the facility or its operation. Action or inaction of any persons, firms, contractors, employees, agents, or corporations acting under, through, or for the Respondents, shall not excuse any failure of Respondents to fully perform their obligations under this Order. 22. This Order does not constitute a waiver, suspension, or modification of the requirements of any federal, state, or local statute, regulation, or condition of any permit issued thereunder, including the requirements of the SDWA and accompanying regulations. Issuance of this Order is not an election by USEP A to forgo any civil or any 7 e e criminal action otherwise authorized under the SDW A. 23. This Order does not constitute a release of all claims respecting all conditions of operation or closure/post-closure of the sump, nor does it necessarily establish all actions that may be necessary to respond to conditions or otherwise close the sump in the event of conditions indicating the need for further investigation, including a feasibility study or other response action. 24. Notwithstanding compliance with the terms of this Order, USEP A is not precluded from taking any action authorized by law, including but not limited to the issuance of additional administrative orders and/or the initiation of judicial actions against the Respondents. USEP A expressly reserves the right to enforce this Order through appropriate proceedings. 25. Violation of any term of this Order, or failure or refusal to comply with this Order, may subject Respondents to a civil penalty not to exceed $5,000 for each day in which such violation occurs or ü failure to comply continues pursuant to § 1431(b) of the SDWA, 42 U.S.C. § 300i(b). In addition, actions or omissions which violate both this Order and any requirements of the USEP A-administered California underground injection control (UIC) program may subject the Respondents to additional civil penalty liability of up to $25,000 per day pursuant to § 1423 of the SDW A, 42 U.S.C. § 300h-2. SEVERABILI1Y 26. The provisions of this Order shall be severable. See 40 C.F.R. § § 144.3 and 146.3. On a prior inspection it was noted by representatives of this Department that several barrels are stored which also contain residue previously removed from the sump. Prior to disposal, all sediments and sludge are to be contained in 55 gallon barrels and stored and labeled as hazardous waste. You are to perform or have performed within 14 days sampling of the material in the drums. The tests are to be as follows: EPA method 8010/8020 or 8240 and the CAM 17 metals test. The results of these tests as well as copies of the last two manifests evidencing proper disposal of waste oils generated at your facility are also to be provided to this office.
