A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING THE VACATION OF T~E
SOUTH 11.25 FEET OF 40TH STREET BETWEEN
CHESTER AVENUE AND "K" STREET TO USE THE
SURPLUS ROAD RIGHT-OF-WAY FOR DEVELOPMENT
OF OFF-STREET PARKING IN THE CITY OF
BAKERSFIELD.
WHEREAS, on January 4, 1989, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets,
Highways and Service Easements Vacation Law," being Chapter 3 of
Part 3 of Division 9 of the Streets and Highways Code of the State
of California, passed and adopted its Resolution of Intention No.
1055 declaring its intention to order the vacation of the south
11.25 feet of 40th Street between Chester Avenue and "K" Street
to use the surplus road right-of-way for development of off-street
parking in the City of Bakersfield, County of Kern, State of
California; and
WHEREAS, said Council did fix a time and place for hearing
all persons interested in or objecting to said proposed vacation,
which said hearing was held on WEDNESDAY, FEBRUARY 1, 1989, after
notices were duly published and posted as required by law; and
WHEREAS, this Council after duly considering the matter,
does hereby find and resolve as follows:
1. That the vacation of the south 11.25 feet of 40th
Street between Chester Avenue and "K" Street to use the surplus
road right-of-way for development of off-street parking in the
City of Bakersfield, County of Kern, State of California, more
particularly described in Exhibit "A" attached hereto and made a
part hereof, is unnecessary for present or prospective street or
easement purposes.
2. That the vacation of the south 11.25 feet of 40th
Street between Chester Avenue and "K" Street to use the surplus
road right-of-way for development of off-street parking in the
City of Bakersfield, County of Kern, State of California, be and
the same is hereby closed up, vacated and abandoned for public
street purposes. Reference to said Resolution of Intention No.
1055 is hereby made for further particulars.
3. That the City Clerk shall certify to the passage of
this Resolution and shall cause a certified copy hereof, attested
by the Clerk under the seal of the City, to be recorded in the
office of the County Recorder of the County of Kern, California.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on February ~, 1989 , by

OF BAKERSFIELD" filed November 25, 1898 in Map book 1, Pages 13 and 14 in the
office of tJ~e Keri] Coui%ty Recorder, more particularly described as follows:
PARCEL 1
Beginning at a point on the South line of 40th Street, also being the Northeast
corner of [~t 10, Block 668 of said "MAP OF THE CITY OF BAKERSFIELD;
Thence West along the North line of said Lot 10, a distance of 122 feet to the
Northwest corner thereof;
Thence North along a prolongation of the West line of said Lot ]0, a distance
of 11.25 feet;
Thence East along a line parallel with the North line of said Lot 10, a distance
of 110.75 feet;
Thence Southeasterly in a direct line, 15.91 feet to the POINT OF BEGINNING:
PARCEL 2
Beginning at a point on the South line of 40th Street, also being the Northwest
corner of LOt 11, Block 668 of said "MAP OF ~E CITY OF BAKERSFIELD;
Thence East along the North line of said Lot 11, a distance of 122 feet to the
Northeast corner thereof;
Thence North along a prolongation of the East line of said LOt 11, a distance
of 11.25 feet;

Thence Southwesterly in a direct line, 15.91 feet to the POINT OF BEGINNING.
