HomeMy WebLinkAboutRES NO 17-89RESOLUTION NO. 17-89 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, APPROVING NEGATIVE DECLARATION AND APPROVING SEGMENT III OF PRO- POSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 3-88). WHEREAS, the Council of the City of Bakersfield referred Segment III of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakers- field, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on December 15, 1988, on Segment III of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by pub- lication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: SEGMENT III: DAVID R. BROWN, INC. requests to amend the Bakersfield Metropolitan Area General Plan to add Low Density Residential land use designation from Kern County 5.4 Maximum 4 Units/Net Acres (10,890 sq. ft. Site Area/Units) on 34.41 acres located at the southeast corner of Stine Road and the Arvin-Edison Canal and concurrent Zoning Upon Annexation to R-1 (One Family Dwelling) Zone; and WHEREAS, for the above described Segment, an Initial Study was conducted and it was determined that, with mitigation measures incorporated as conditions of development and accepted by the applicant, the proposed project would not have a signifi- cant effect on the environment and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepara- tion and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution 107-86 have been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 57-88 on December 15, 1988, the Planning Commission recommended approval and adoption of Segment III, subject to conditions, by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on FEBRUARY 1, 1989, on the above-described Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment III is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The City Council hereby approves and adopts Segment III of the proposed amendment to the Land Use Element, constituting a change to a Low Density Residential land use designation gener- ally located at the southeast corner of Stine Road and the Arvin- Edison Canal, as shown on map attached as Exhibit "A", subject to the following conditions of approval: Upon development or subdivision of the site, the developer/subdivider shall pay his share of one-half the cost of widening the Stine Road crossing of the Arvin-Edison Canal. This share will be based on the anticipated traffic generated by his project as deter- mined by the Traffic Engineer. - 2 - Major access points shall be limited to 1/3 mile (1600' - 1700') spacing between arterial-arterial intersections. Future subdivisions or development shall be designed using this criteria. One major access point along Stine Road shall be allowed with full access and shall be located approximately 1/3 mile south of Panama Lane. The exact location shall be determined at time of subdivision. A secondary restricted access may be allowed to Stine Road but shall be no closer than 300' to the primary access. Limited access may be allowed with the left turn out move prohibited. Allowance of such access shall be determined at time of subdivision or development subject to its location relative to the primary access. The secondary access point shall be no closer than 600' from the mid-section line running along the south bound- ary of the subject area. Future subdivisions or development shall be designed to allow for the extension of at least 2 accesses to the east. Future subdivisions shall be designed such that the southern 200' can be severed from the remaining portion without affecting its integrity. The southern 200' of the project shall be included in the last phase of subdi- vision dew~lopment. No final map shall be approved for this phase until 2 years from approval of this GPA by City Council, unless an alignment of such freeway which does not cross the project area is formally adopted by the City and County and approved by Caltrans prior to such time. A landscaped median island with automatic sprinkler sys- tem shall be constructed in Stine Road at the time of development or subdivision. The median island shall pro- vide for turning movements as described above. To curtail the proliferation of small, independent drain- age retention basins, upon development or subdivision, a drainage study shall be submitted to and approved by the City Engineer showing how storm water from the entire site can be handled and possibly consolidated with drain- age systems from adjacent areas. Upon development or subdivision, an offer of dedication for right of way to arterial standards of Stine Road along the entire project frontage shall be required. - 3 - Upon development or subdivision, sewer service within the project area shall be designed and constructed to allow for extension of the sewer lines easterly in the required accesses so that adjacent areas can be served. Park land shall be dedicated at a standard of 2.5 acres per 1,000 population or in-lieu fees provided. A maintenance district shall be formed or inclusion into an existing district shall take place so that all assessments levied for the maintenance of parks and streetscape will be the responsibility of all property owners within the annexation. 5.
