Dear Mr. Sullivan:
A business plan submitted on December 1,1997 by Mr. Jerry Tallman of
TBL Charter Lines, indicated that a 1,000 gallon above ground tank had been added

1. Verify the existence of one 1,000 gallon above ground diesel
tank.
2. Confinn that it meets the Unifonn Fire Code.
3. Confinn the date this tank went into service (which was
approximately 11/2 years ago).

As you mayor may not be aware, all above ground tanks must be pennitted
prior to installation. This is to insure that your tank meets the Uniform Fire Code.
During our exit interview with Terry Tallman, we were infonned that you are the
owner of this tank, and have provided it for Mr. Tallmans exclusive use.
Accordingly, I must infonn you that your tank does not meet the Uniform
Fire Code (1994 Edition) requirements for dispensing motor vehicle :fuel for the
following reasons:
1. Your tank design does not have fire-resistive protection from
high intensity fire exposure.
2. Your tank design does not have projectile protection.
3. Your tank does not have overfill and overspill protection.
4. Your tank does not have crash posts for vehick impact
protection.
5. Your tank has not been permitted.

You are therefore required to remove your 1,000 gallon above ground tank
from service with within fifteen (IS) days ( December 25, 1997).
I am enclosing copies of the Uniform Fire Code (1994 Edition) Section II-F
on dispensing motor vehicle fuel, as a reference. Should you have any questions,
