INTRODUCTION Jack in the Box Inc. authorized Ninyo & Moore to perform underground storage tank (UST) clo- sure activities at the proposed Jack in the Box No. 3576 property located at 10 and 30 Union Avenue in Bakersfield, California (site; Figure 1). Work was conducted in general accordance with the contract dated March 9, 2001 between Jack in the Box Inc. and Ninyo & Moore. Jack in the Box Inc. has recently purchased the site and is developing the property as a Jack in the Box restaurant. As part of the real estate due diligence, Jack in the Box Inc. retained Ninyo & Moore to perform a Phase I Environmental Site Assessment (ESA) in May 2000. The results of the Phase I ESA indicated that the southern portion of the site had been used by gasoline stations from at least 1943 through 1999. Based on the findings of the Phase I ESA, Ninyo & Moore recommended conducting a geophysical survey -in the southern portion of the site to assess whether USTs might be present. The results of the subsequent geophysical survey and limited subsurface investigation indicated the presence of one approximately 1,000-gallon UST located in the south-éentral portion of the site. Two soil samples were collected in the vicinity of the UST and laboratory results indicated low concentrations of total petroleum hydrocarbons as diesel (TPHd), up to 33 milligrams per kilograms (mglkg), and gasoline (TPHg), up to 0.097 mglkg. No detectable concentrations of benzene, toluene, ethylbenzene, and xylenes (BTEX) and methyl tertiary butyl ether (MTBE) were reported in the samples. Ninyo & Moore subsequently recommended that the UST be re- moved in accordance with current regulatory guidelines. 2. UST REMOVAL AND EXCAVATION ACTIVITIES The UST was discovered during a recently completed geophysical survey and subsurface inves- tigation of the site (Figure 2). Groundwater in the site vicinity is expected to be encountered at depths of approximately 200 feet below the ground surface (bgs) , The following includes a de- scription of the UST removal activities. All work described herein was prefonned under the direction of Mr. Paul A. Roberts, a California Registered Geologist from Ninyo & Moore. 3.1. UST Excavation General contracting and excavation was perfonned by Moine Brothers of Wilmington, Cali- fornia. Prior to commencement of field activities, Moine Brothers obtained UST removal pennits from the Bakersfield Fire Department (BFD) (Appendix A). The UST was located in the south-central portion of the site as depicted on Figure 2, Soil excavation for removal ofthe subject UST was perfonned on March 28,2001 using a backhoe and manual labor. 3.2. UST Rinsing and Removal The UST was discovered at a depth of approximately 3 feet bgs with dimensions measuring approximately 3.5 feet in diameter by approximately 8 feet in length (Figures 3 and 4). A petroleum hydrocarbon liquid (i.e., waste oiVsludge) was discovered in the tan1e Following removal of the liquid using a vacuum truck, Moine Brothers personnel subsequently triple- !Ïnsed the UST using a pressure washer. The rinsate and UST contents (approximately 400 gallons), accompanied by a non-hazardous waste manifest, were transported to DeMenno Kerdoon of Compton, California, for recycling (Appendix B). The UST removal activities and subsequent soil sampling was conducted with oversight from Inspector Steve Underwood of the BFD. The UST was lifted out of the excavation us- ing a backhoe and placed in the bed of a semi-truck for removal from the site. No holes were observed in the tank, and the UST appeared to be in good condition. No stained or odorous soil was encountered. The UST was transported to Moine Brothers for recycling. Soil Sampling Under the direction of Inspector Underwood, one soil sample designated T -1 was collected from a total depth of approximately 9.5 feet bgs, which is approximately 3 feet below the bottom of the UST (Figures 3 and 4). A second soil sample designated T -2, was collected from a total depth of approximately 12.5 feet bgs, which is approximately 6 feet below the bottom of the UST. One soil sample designated SP-1 was collected from the excavated stockpiled soil in the approximate location shown on Figure 3. Sampling procedures are pre- sented in Appendix D. 3.4. Laboratory Results The samples were analyzed by BC Laboratories, Inc. of Bakersfield, California, a State- certified environmental laboratory. As requested by the BFD, the soil samples were analyzed for TPHg, total petroleum hydrocarbon extended range hydrocarbons CS-C44 (TPHe), vola- tile organic compounds (VOCs), and Title 22 metals in general accordance with EPA Method Nos. 8015B, 8260B, 6010, and 7471. The VOC analysis included BTEX, and oxy- genates including MTBE, di-isopropyl ether (DIPE), ethyl tertiary butyl ether (ETBE), tertiary amyl methyl ether (TAME), and tertiary butyl alcohol (TBA). Laboratory reports are presented in Appendix E. As presented on Table 1, no detectable concentrations of TPHg, TPHe, and VOCs were de- tected in the samples collected beneath the UST. Laboratory results of these samples also indicated low concentrations of metals, below ten timês the Soluble Threshold Limit Con- centration (STLC). As presented on Table 2, laboratory results indicated no detectable concentrations of TPHg and VOCs in the soil sample collected from the excavated soil stockpile. Low concentra- tions of TPHe (148.6 mg/kg) and total lead (57 mg/kg) were reported in this sample. Because the laboratory reports for total lead indicated concentrations slightly above ten times the STLC for lead, Ninyo & Moore reanalyzed this sample for soluble lead using the Waste Extraction Test (WET) method. Following receipt of laboratory results, Ninyo & Moore consulted Inspector Underwood to assess whether the material could be used for backfill. According to Inspector Underwood, the concentrations detected would be considered low and the material could be used for backfill. 4. SITE RESTORATION On April 25, 2001, the excavation was backfilled with a two-sack slurry to a depth of approxi- mately 5 feet bgs and to ground surface with the previously excavated soil. During backfilling activities, Moine Brothers retained a geotechnical finn to conduct compaction testing. A copy of - the backfill compaction report is included in Appendix F. 5. DISCUSSION Based on the observations made during the UST closure activities and on the subsequent soil sample analytical results, Ninyo & Moore presents the following findings: · During due diligence for a real estate transaction, an approximately 1,000-gallon waste oil UST was discovered at the site. The UST was successfully removed from the site on March 28,2001 in accordance with, and under the direction of, the BFD. · Laboratory results of two confinnation samples collected beneath the fonner UST indicated no detectable concentrations of TPHg, TPHe, and VOCs, and low concentrations of Title 22 metals, Based on the results, the excavation was backfilled. 6. LIMITATIONS The services outlined in this report have been conducted in a manner generally consistent with current regulatory guidelines. No warranty, expressed or implied, is made regarding the profes- sional opinions presented in this report. Ninyo & Moore's opinions are based on an analysis of observed conditions and on information obtained :trom third parties. It is likely that variations in soil conditions may exist which were beyond the scope of work for the UST closure activities. The samples collected and chemically analyzed and the observations made are believed to be representative of the general area evaluated; however, conditions can vary significantly between sampling locations. The interpretations and opinions contained in this report are based on the re- sults of laboratory tests and analyses intended to detect the presence and measure the concentration of certain chemical or physical constituents in samples collected :trom the site. The analyses have been conducted by an independent laboratory which is accredited by the United States EPA and/or certified by the State of California to conduct such analyses. Ninyo & Moore has no involvement in, or control over, such analyses and has no means of confirming the accu- racy of laboratory results. Discrete, relatively undisturbed soil samples were collected from the backhoe bucket and from the excavated stockpiled soil in laboratory supplied glass jars. 2. The glass jars were filled to the top, with little to no headspace. 3. The soil samples were placed in sealable plastic bags and stored in an ice chest, which was cooled, using bagged ice, to a temperature of approximately four degrees Celsius. Sample Handling Procedures 1. The samples were stored in an ice-filled cooler and delivered to an off-site state-certified laboratory following termination of field activities. Tests were performed by our engineering technician. The results of the tests taken within thè septic backfill were 90% or above the maximum density. The limits of our testing were defined by the contractor. This testing does not preclude the possibility that the soil or fill may be loosened by future construction activities. Results of the tests represent the compaction at the locations where the tests \Vere perfonned. The engineering evaluation of the structural integrity of the entire backfill is beyond the scope of this 'work. The maximum depth öf fill tested was three feet. Neither continuous nor part-time grading observations were performed for this project. Our firm does not guarantee earthwork construction, nor does our work relieve the contractor of his responsibility to conform with the approved project plans and specifications. The tables on the following pages present the results of the density tests taken at the project site. The depths cited are measured from rough grade. INTRODUCTION Jack in the Box Inc. authorized Ninyo & Moore to perform underground storage tank (UST) clo- sure activities at the proposed Jack in the Box ~o. 3576 property located at 10 and 30 Union Avenue in Bakersfield, California (site; Figure 1). Work was conducted in general accordance with the contract dated March 9, 2001 between Jack in the Box Inc. and Ninyo & Moore. Jack in the Box Inc. has recently purchased the site and is developing the property as a Jack in the Box restaurant. As part of the real estate due diligence, Jack in the Box Inc. retained Ninyo & Moore to perform a Phase I Environmental Site Assessment (ESA) in May 2000. The results of the Phase I ESA indicated that the southern portion of the site had been used by gasoline stations :trom at least 1943 through 1999. Based on the findings of the Phase I ESA, Ninyo & Moore recommended conducting a geophysical survey ~n the southern portion of the site to assess whether USTs might be present. The results of the subsequent geophysical survey and limited subsurface investigation indicated the presence of one approximately 1,000-gallon UST located in the south-central portion of the site. Two soil samples were collected in the vicinity of the UST and laboratory results indicated low concentrations of total petroleum hydrocarbons as diesel (TPHd), up to 33 milligrams per kilograms (mglkg), and gasoline (TPHg), up to 0.097 mglkg, No detectable concentrations of benzene, toluene, ethylbenzene, and xylenes (BTEX) and methyl tertiary butyl ether (MTBE) were reported in the samples. Ninyo & Moore subsequently recommended that the UST be re- moved in accordance with current regulatory guidelines. 2. UST REMOVAL AND EXCAVATION ACTIVITIES The UST was discovered during a recently completed geophysical survey and subsurface inves- tigation of the site (Figure 2). Groundwater in the site vicinity is expected to be encountered at depths of approximately 200 feet below the ground surface (bgs). The following includes a·de- scription of the UST removal activities. All work described herein was preformed under the direction ofMr, Paul A. Roberts, a California Registered Geologist from Ninyo & Moore. 3.1. UST Excavation General contracting and excavation was performed by Moine Brothers of Wilmington, Cali- fornia. Prior to commencement of field activities, Moine Brothers obtained UST removal permits from the Bakersfield Fire Department (BFD) (Appendix A). The UST was located in the south-central portion of the site as depicted on Figure 2. Soil excavation for removal of the subject UST was performed on March 28,2001 using a backhoe and manual labor. 3.2. UST Rinsing and Removal The UST was discovered at a depth of approximately 3 feet bgs with dimensions measuring approximately 3.5 feet in diameter by approximately 8 feet in length (Figures 3 and 4). A petroleum hydrocarbon liquid (i.e., waste oil/sludge) was discovered in the tank. Following removal of the liquid using a vacuum truck, Moine Brothers personnel subsequently triple- rinsed the UST using a pressure washer. The rinsate and UST contents (approximately 400 gallons), accompanied by a non-hazardous waste manifest, were transported to DeMenTIo Kerdoon of Compton, California, for recycling (Appendix B). . The UST removal activities and subsequent soil sampling was conducted with oversight from Inspector Steve Underwood of the BFD. The UST was lifted out of the excavation us- ing a backhoe and placed in the bed of a semi-truck for removal from the site. No holes were observed in the tank, and the UST appeared to be in good condition. No stained or odorous soil was encountered. The UST was transported to Moine Brothers for recycling. Soil Sampling Under the direction of Inspector Underwood, one soil sample designated T -1 was collected from a total depth of approximately 9.5 feet bgs, which is approximately 3 feet below the bottom of the UST (Figures 3 and 4). A second soil sample designated T -2, was collected from a total depth of approximately 12.5 feet bgs, which is approximately 6 feet below the bottom of the UST. One soil sample designated SP-l was collected from the excavated stockpiled soil in the approximate location shown on Figure 3. Sampling procedures are pre- sented in Appendix D. 3.4. Laboratory Results The samples were analyzed by BC Laboratories, Inc. of Bakersfield, California, a State- certified environmentallàboratory. As requested by the BFD, the soil samples were analyzed for TPHg, total petroleum hydrocarbon extended range hydrocarbons Cg-C44 (TPHe), vola- tile organic compounds (VOCs), and Title 22 metals in general accordance with EPA Method Nos. 8015B, 8260B, 6010, and 7471. The VOC analysis included BTEX, and oxy- genates including MTBE, di-isopropyl ether (DIPE), ethyl tertiary butyl ether (ETBE), tertiary amyl methyl ether (TAME), and tertiary butyl alcohol (TBA). Laboratory reports are presented in Appendix E. As presented on Table 1, no detectable concentrations of TPHg, TPHe, and VOCs were de- ·tected in the samples collected beneath the UST. Laboratory results of these samples also indicated low concentrations of metals, below ten times the Soluble Threshold Limit Con- centration (STLC). As presented on Table 2, laboratory results indicated no detectable concentrations of TPHg and VOCs in the soil sample collected from the excavated soil stockpile. Low concentra- tions of TPHe (148.6 mg/kg) and total lead (57 mg/kg) were reported in this sample. Because the laboratory reports for total lead indicated concentrations slightly above ten times the STLC for lead, Ninyo & Moore reanalyzed this sample for soluble lead using the Waste Extraction Test (WET) method. Following receipt of laboratory results, Ninyo & Moore consulted Inspector Underwood to assess whether the material could be used for backfill. According to Inspector Underwood, the concentrations detected would be considered low and the material could be used for backfill. 4. SITE RESTORATION On April 25, 2001, the excavation was backfilled with a two-sack slurry to a depth of approxi- mately 5 feet bgs and to ground surface with the previously excavated soil. During backfilling activities, Moine Brothers retained a geotechnical finn to conduct compaction testing. A copy of . the backfill compaction report is included in Appendix F. 5. DISCUSSION Based on the observations made during the UST closure activities and on the subsequent soil sample analytical results, Ninyo & Moore presents the following findings: · During due diligence for a real estate transaction, an approximately 1,000-gallon waste oil UST was discovered at the site. The UST was successfully removed from the site on March 28,2001 in accordance with, and under the direction of, the BFD. · Laboratory results of two confinnation samples collected beneath the fonner UST indicated no detectable concentrations of TPHg, TPHe, and VOCs, and low concentrations of Title 22 metals. Based on the results, the excavation was backfilled, 6. LIMITATIONS The services outlined in this report have been conducted in a manner generally consistent with current regulatory guidelines. No warranty, expressed or implied, is made regarding the profes- sional opinions presented in this report. Ninyo & Moore's opinions are based on an analysis of observed conditions and on infonnation obtained ITom third parties. It is likely that variations in soil conditions may exist which were beyond the scope of work for the UST closure activities. The samples collected and chemically analyzed and the observations made are believed to be representative of the general area evaluated; however, conditions can vary significantly between sampling locations. Discrete, relatively undisturbed soil samples were collected from the backhoe bucket ànd from the excavated stockpiled soil in laboratory supplied glass jars. 2. The glass jars were filled to the top, with little to no headspace. 3. The soil samples were placed in sealable plastic bags and stored in an ice chest, which was cooled, using bagged ice, to a temperature of approximately four degrees Celsius. Sample Handling Procedures 1. The samples were stored in an ice-filled cooler and delivered to an off-site state-certified laboratory following tennination of field activities. Sample handling, transport, and delivery to the laboratory were documented using appropriate chain-of-custody protocol, including the use of chain:...of-custody f01ms. Tests were perfonned by our engineering technician, The results of the tests taken within thè septic backfilI were 90% or above the maximum density. The limits of our testing were defined by the contractor. This testing does not preclude the possibility that the soil or filI may be loosened by future construction activities. Results of the tests represent the compaction at the locations where the tests were perfonned, The engineering evaluation of the structural integrity of the entire backfill is beyond the scope of this 'work The maximum depth òf fill tested was three feet. Neither continuous nor part-time grading observations were perfonned for this project. Our finn does not guarantee earthwork construction, nor does our work relieve the contractor of his responsibility to confonn with the approved project plans and specifications. ' The tables on the folIowing pages present the results of the density tests taken at the project site. The depths cited are measured from rough grade. Test numbers that are folIowed by an 'R' indicate retests.
