We then received a letter from the Bakersfield Fire Department dated June 4,2001 indicating that Cardlock Fuels will temporarily close its underground storage tanks upon vacating the premises. Temporary closure of the underground storage tanks is not acceptable. The purpose of this letter is to request that Card.lock Fuels comply with the law and the lease and remove its underground storage tanks from the premises. Article VIII of the lease requires Cardlock Fuels to comply with all laws and regulations relating to the premises and the business conducted thereon. California law requires owners and operators of underground storage tanks to permanently close such tanks when (1) the storage of hazardous substances has ceased, and (2) the tanks will not be used, or are not intended for use, for the storage of hazardous substances within the next twelve consecutive months. (Cal. Admin, Code, tit. 23, § 2670(c).) Cardlock Fuels is both the owner and operator of its underground storage tanks on the premises whose use of the tanks will cease on or before June 30, 2001 when the lease tenninates. Cardlock Fuels will obviously not use the tanks during the ensuing twelve months due to the tennination of the lease. Consequently, the law requires Cardlock Fuels to permanently close its underground storage tanks. The plan is also intended for employee guidance in minimizing potential and actual hazards which could affect our employees, the public or the environment during fire, explosion, or any unplanned sudden or non-sudden release of hazardous materials to the air, soil, surface or ground water. The plan is also designed to set procedures for reporting releases or threatened releases of hazardous materials which may pose a potential hazard to our employees, the public or the environment. In the event a substantial change is made in the normal business operation, the local regulatory agency will be notified within 30 days of that change. The Hazardous Materials Inventory form will be resubmitted on an annual basis. A complete Hazardous Materials Business Plan will be resubmitted every two years. Description of Operation The operation of Beacon Cardlock Fuels #608 located at 241 Union, Bakersfield, California is primarily to serve the general public through retail sale of petroleum products, miscellaneous consumer packaged products and various food items. The petroleum products (i.e. gasoline, diesel) are stored in underground tanks which conform with local, state and federal laws or regulations. Underground piping and dispensing equipment is also installed and maintained in conformance with local, state and federal laws or regulations. Inventory control is achieved thru a daily inventory report via the Veeder-Root TLS-250 and a bi-monthly stick gauge. The inventory reconciliation program also insures the accurate control of inventory. Product reorders are based on the reconciled inventory and maximum tank capacity. Delivery of the product is achieved within the conformity of local, state and federal laws or regulations. Prior to unloading product, delivery drivers are required to gauge the tankage and record this information on the delivery ticket. Upon completion of unloading, the tank is again gauged and the information recorded. Reporting, Notification and Scene Management The Beacon Cardlock #608 located at 241 Union, Bakersfield, California is an unattended facility. Emergency notification procedures are posted at the facility and direct the public to dial 9-1-1 for emgergency response personnel. The phone number of the Ultramar Inc. main office is also posted at the facility. Emergency response personnel can contact any of the Beacon emergency contacts listed on page 4 for additional information and assistance. Emergency Equipment Emergency equipment maintained on site is limited to fire extinguishers, absorbent and water hoses. Additional equipment can be brought on site if necessary, as well as emergency clean up personnel. e e ULTRAMAR INC. EMERGENCY RESPONSE - EVACUATION PLAN In the event of a fire, hazardous material spill or an earthquake... Follow these steps immediately I 1. Turn off the pumps by pressing the "stop button" on the attendant's console. Should the flow of hydrocarbons continue or you can not use the console, turn off the emergency shutoff switch on the electrical pane 1 . 2. Announce over the public address system: "There is a (fire) (dangerous spill) in the facility. Please turn off your engines and leave the station on foot...immediatelyl" If you do not have a public address system at your unit, yell the above statement. 3. Call help by dialing 9-1-1 and giving the following information. "There is a (fire) (dangerous spill) at Beacon Card lock Fuels #608 located at 241 Union, Bakersfield, California " If anyone is trapped or needs attention, tell the answering dispatcher. Stay on the phone and be prepared to answer any questions concerning the situation. If the facility phone is not accessible, use the nearest public phone. 4. Look around to insure that all employees and customers have left the facility, particularly those in vehicles who may need assistance or did not hear the emergency announcement. Assist or direct assistance to any customer having difficulty in leaving the station area. 5. Secure the area to prevent any unnecessary vehicle entry. 6. Attend to the injured and direct medical response to them. 7. Attempt to extinguish any fire if you can do so safely. If the fire is small the fire extinguisher should be used to extinguish it. If the fire is large or spreading, or you determine that there is a potential danger of explosion or personal injury, do not attempt to put out the fire with the fire extinguisher. If a fire or explosion requires you to evacuate the facility, lock the cash drawer and leave the facility. 8. Attempt to contain any hazardous material spill utilizing an absorbent material. 9. Report to arriving emergency response personnel to provide them any information or assistance they may require. 10. Remain calm (earthquake information on next page). HMBP e e In The Event of a Large Earthquake 1. The manager or other qualified employee should make a visual inspection of the facility and equipment. A visual inspection should also be made of the dispenser piping, checking for leaks, loose pipes or other damage which could create a hazard. 2. The manager or other qualified employee will reconcile the tank records, taking into account gallons sold, etc. If the records show a loss, then the zone manager will be notified immediately. 3. If a loss of product is confirmed by the zone manager, the zone manager will then coordinate with our marketing services for tank tests and/or repairs. BEACON OIL COMPANY EMERGENCY RESPONSE PLAN Notification Procedures When a RELEASE is observed or threatened, that poses a potential hazard to public health and/or the environment, the following steps will be taken: 1. THE FIRST STEP is to determine the existence, or potential existence of hazardous material. Where unidentified substances or vapors are involved in these incidents, it is always prudent to assume they are toxic or hazardous until determined otherwise. 2. IMMEDIATELY, it is imperative to ascertain the location of any incident involving hazardous materials and contact the Emergency Operations Coordinator and make the appropriate dispatch of emergency equipment. 3. THE EMERGENCY OPERATIONS COORDINATOR, or his designee, will contact 911 and the local regulatory agency who will initiate the emergency response plan. When there is a potential for hazardous material of any type to enter drains or waterways, call 911 and give full particulars...they will make notification. 4. SCENE MANAGEMENT shall be the responsibility of the Primary Emergency Contact Coordinator (Scene Manager) until the arrival of public safety response personnel. 5. PROTECTION OF SCENE - It is imperative to protect responders and by-standers from injury or contamination. Personnel first on the scene should immediately take steps to secure the area and establish perimeter control at a safe distance until such time that an agency, e.g. Police or Fire personnel, arrives and assumes this responsibility. This would include, when applicable, attempt to contain any hazardous material spill, utilizing spill containment material available at the site. 6. EVACUATION - The Scene Manager must determine if there is any potential danger to individuals in the area and take appropriate steps to notify and evacuate. Assistance will normally be furnished by law enforcement agencies. In major incidents, County and/or City Disaster Officials will be involved. In major incidents evacuation, reception and care will be followed as described in the County Major Disaster Plan. 7. CLEAN-UP RESPONSIBILITY is determined by the cause of the incident. If caused by this Company, this Company has the responsibility to clean-up (either by Company personnel or approved contractor). If it is determined to NOT be this Company's responsibility, responsible party will be liable for clean-up. 8. DECONTAMINATION - Appropriate steps must be taken to decontaminate all victims and response personnel. Local hospitals have facilities to assist in this procedure. They will follow normal prescribed procedures and supplement with specific exchange of information if contamination is involved. 10. IDENTIFICATION - As requested, County Communications will relay information between the response units at the scene and certain other agencies. Releases to be Reported a. Beacon Oil Company will, upon discovery of any release or threatened release of a hazardous material that poses a hazard to public health and/or the environment, immediately report to the (local agency) , and to the Office of Emergency Services. REGIONAL CONTACT COORDINATOR The Regional Contact Coordinator is the Zone Manager or District Manager. It is his responsibility to follow-up on all dispatched emergency incidents and act as intermediary between the Scene Manager and the Operations Coordinator. It is also the Regional Coordinator's responsibility to act on suspected, but unvernied, possible releases by performing spontaneous audits of inventories, checking for any visible releases and/or providing any physical evidence to give credence to the suspected release. 3. OPERATIONS COORDINATOR The Operations Coordinator is Beacon's Manager of Marketing Operations, or his designee. He is responsible for dispatching personnel and/or contractors, as well as essential equipment, to the scene of the incident. Overseeing all phases of construction, environmental clean-up and coordinating efforts between Company personnel, contractors and various agencies are all responsibilites of the Operations Coordinator. Any necessary reports of the incident will be completed by the Operations Coordinator or his designee and he will act as Beacon's liaison with any and aU agencies. 4. A copy of Beacon's "Emergency Response Plan" is enclosed and should be kept in your Truck stop Manual. Also enclosed is a copy of the "station Emergency Response and Evacuation Plan" (a one-sheet plastic-enclosed form, detailing the procedures and steps to follow in an emergency), This form is to be posted in a conspicuous place where it is easily accessible in the event of an emergency. ALL present and future employees are required by law to be trained in the "Emergency Response Plan," In order to comply with the law, we have prepared an "Employee Training Log" as part of the "Emergency Response Plan." ALL employees must read the "Plan" and sign the "Log", certifying that they have read and understand the "Plan", As a refresher course, this procedure is to be repeated annually. Please review the enclosed information with each of your employees to ensure that they understand the Plan and that each understands the significance of complying with the requirements. Prior to unloading product, delivery drivers are required to gauge the tankage and record this information on the delivery ticket.
