A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND AMENDING THE BAKERSFIELD
METROPOLITAN AREA GENERAL PLAN BY APPROVING
AND ADOPTING A REVISED HOUSING ELEMENT FOR
METROPOLITAN BAKERSFIELD.
WHEREAS~ the existing Housing Element of the Bakersfield
Metropolitan Area General Plan was adopted by the City Council of
the City of Bakersfield on April 3~ 1972; and
WHEREAS, the California State Legislature, in 1980,
added Article 10.6 to Chapter 3 of Title 7 of the Government Code
containing requirements for the preparation and adoption of
revised housing elements; and
WHEREAS, the City of Bakersfield and the County of Kern
entered into an agreement on July 7r 1981~ to prepare a revised
housing element having consistent policies and programs for the
entire Metropolitan Area of Bakersfield; and
WHEREAS, consultants were retained to perform the
required work to produce a housing element consistent with State
law; and
WHEREAS, the revised Housing Element has been prepared
in conformance with the Regional Housing Allocation Plan adopted
by the Kern County Council of Governments on December 17, 1981;
and
WHEREAS, an expanded Initial Study was conducted and it
was determined that the proposed project would not have a signifi-
cant effect on the environment and a Negative Declaration was
prepared; and
WHEREAS, the laws and regulations relating to the
preparation of Negative Declarations as set forth in CEQA and
City of Bakersfield Resolution 60-80 have been duly followed; and
WHEREAS, the Planning Commission of the City of Bakers-
field, in accordance with the provisions of Section 65351 of the
Government Code~ held a public hearing on September 16, 1982, and
continued said public hearing to and held such continued hearing
on November 18, 1982, on the proposed revision to the Rousing
Element of the Bakersfield Metropolitan Area General Plan and on
the proposel Negative Declaration, notice of time and place of
hearing having been given at least ten (!0) calendar days before
said hearing by publication in a local newspaper of general
circulation;~ and
WHEREAS, all matters presented at said hearing were
duly considered by the Planning Commission; and
WHEREAS, by Resolution No. 85-82 on November 18, 1982,
the Planning Commission approved the revised Housing Element of
the Bakersfield ~etropolitan Area General Plan and recommended
approval and[ adoption thereof by the Council, such recommendation
being based on findings set forth in such Resolution; and
WREREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted and held a public hearing on January 12, 1983, on
the revised Housing Element of the Bakersfield ~etropolitan Area
General Plan and the proposed Negative Declaration, notice of the
time and place of the hearing having been given at least ten (10)
calendar days before the hearing by publication in the
Bakersfield Californian, a newspaper of general circulation
published and circulated in the City of Bakersfield; and
WHEREAS, the requirements of Article 10.6 of Chapter 3
of Title 7 of the Government Code have been satisfied in all
respects, both as to the process of consideration and adoption of
the revised Housing Element and as to the contents thereof.
NOW, THEREFORE~ IT IS HEREBY FOHND AND RESOLVED as
follows:

Metropolitan Area General Plan by approving and adopting the
revised Housing Element of the Bakersfield Metropolitan Area
General Plan.
5o The revised Housing Element supercedes and replaces
the original Housing Element of the Bakersfield Metropolitan Area
General Plan adopted gn April 3, 1972.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 12th day of January, 1983, by
