RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD, CALIFORNIA, MAKING CERTAIN FINDINGS
REGARDING THE CONSTRUCTION OF A PUBLIC PARKING
FACILITY IN THE DOWNTOWN REDEVELOPMENT PROJECT
BY THE BAKERSFIELD REDEVELOPMENT AGENCY.
WHEREAS, the City Council of the City of Bakersfield
adopted and approved a certain Redevelopment Plan (the
"Redevelopmerit Plan") for the Downtown Redevelopment Project
(the "Project") by Ordinance No. 2033 on August 14, 1972; and
WHEREAS, in furtherance of the Project the Bakersfield
Redevelopment Agency (the "Agency") is in the process of
acquiring land (the "Site") within the redevelopment project
area (the "Project Area"); and
WHEREAS, the Agency now desires to construct a
public parking facility (the "Parking Facility") on the Site
and proposes to issue lease revenue bonds to finance said
Facility; and
WHEREAS, Section 33445 of the California Community
Redevelopment Law (Health and Safety Code Section 33000
et seq.) requires the City COuncil to make certain findings
prior to the acquisition of land and construction of public
improvements thereon; and
WHEREAS, Section 33678 of the Community Redevelopmerit
Law provides that under certain conditions tax increment
funds shall not be subject to the appropriations limitation
of Article XIIIB of the California Constitution;
NOW, THEREFORE, BE IT RESOLVED by the Council of
the City of Bakersfield as follows:
SECTION 1.
The City Council hereby determines that the Parking
Facility is of benefit to the Project Area and that no other
reasonable means of financing the Parking Facility is available
to the Community.
SECTION 2.
The City Council further determines that construction
of the Parking Facility is redevelopment as prescribed in
Sections 33020 and 33021 of the Community Redevelopment Law,
that the Parking Facility will primarily benefit the Project
Area, and that none of the funds used to construct the Parking
Facility will be used to pay for employee or contractual services
of any local government agency except for services directly
relating to the construction of the Parking Facility.
I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 5th day of January ·
