HomeMy WebLinkAboutRES NO 233-88RESOLUTION NO. 233-8~ A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION FOR THE OFFICE OF MAYOR AND THE SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING TO THE ELEC- TORS OF THE CITY AMENDMENTS TO THE CHARTER OF THE CITY OF BAKERSFIELD, MEASURES I, J, K, L, M, N AND O, HELD ON THE 8TH DAY OF NOVEMBER, 1988. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: SECTION 1. That the C~ty Council does hereby find, determine and declare as follows: a. That pursuant to applicable law, a General Municipal Election was held in the City of Bakersfield on the 8th day of November, 1988, for the purpose of electing a Mayor; and b. That said election was held and conducted in confor- mity with all applicable provisions of law; and c. That ~)ursuant to direction of the City Council, the County Clerk of the County of Kern has heretofore conducted a can- vass of the results thereof and has filed with said City Council a certificate relating thereto which has been examined and is hereby accepted by this City Council; and d. That the City Council does hereby accept the canvass of record of said elections as certified by said County Clerk and does hereby resolve, determine and declare the results of said General Municipal EiLection as follows: Mayo~ Clare~%ce E. That the City Council does hereby find, determine and declare as follows: a. That pursuant to applicable law, Election was held and conducted in the City of 8th day of November, 1988; and a Special Municipal Bakersfield on the b. That said election was held and conducted in confor- mity with all applicable provisions of law; and c. That said election was held for the purpose of sub- mitting to the election of said City the following proposed amendments to the Charter of the City of Bakersfield. MEASURE "I" Should Section 16, 20, 67, 68 and 74 of 'the Bakersfield City Charter be amended; Sections 33, 66, 69, 70, 71, 72, 73 and 75 of the Bakersfield City Charter be deleted; and Section 67.1 added to the Bakersfield City Charter relating to elections? MEASURE "J" Should Sections 14, 20 and 21 of the Bakersfield City Charter be amended to clarify the right of the Mayor to vote to break tie votes of the Council, to provide annual salary for Mayor in amount of Twenty Four Thousand Dollars ($24,000.00) and to make miscellaneous changes in the description of the duties and functions of the office of the Mayor? MEASURE "K" Should Section 18 of the Bakersfield City Charter be amended to provide annual salary for councilmembers in amount of Six Thousand Dollars ($6,000.00)? - 2 - MEASURE "L" Should Sections 13, 15, 33.3, 38, 40, 41, 134, 162 and 163 of the Bakersfield City Charter be amended and Sections 33.1, 33.2, 49, 51, 52, 53, 55, 57, 58, 60, 137, 138, 158, 159, 160 and 184 of the Bakersfield City Charter be deleted, to amend or eliminate unnecessary or obsolete language and practice relating to many unrelated subjects? MEASURE "M" Should Sections 135 and 136 of the Bakersfield City Charter be amended and Section 143 of the Bakersfield City Charter be deleted, relating to public contracts and bidding? MEASURE "N" Should Sections 34, 37, 37.5 and 208 of the Bakersfield City Charter be amended to delete the position of City Attorney from Civil Service and to make those provisions of the Charter concerning the appointment, salary and removal of the City Manager also applicable to the City Attorney? MEASURE "O" Should Sections 183, 185, 186, 189, 199, 200, 202, 209, 211, 214, 216, 217a, 217b, 221, 222, 223, 224, 228, 231, 233 and 239 of the Bakersfield City Charter be amended, and Sections 187, 188, 192, 193, 196, 201, 205, 206, 207, 210, 212, 213, 216a, 218, 219, 220, 225, 226, 234, 236, 237, 240 and 241 of the Bakersfield City Charter be deleted, relating to Civil Service? - 3 - MEASURE "0" Should Sections 183, 185, 186, 189, 199, 200, 202, 209, 211, 214, 216, 217a, 217b, 221, 222, 223, 224, 228, 231, 233 and 219 of the Bakersfield City Charter be amended, and Sections 187, 188, 192, 193, 196, 201, 205, 206, 207, 210, 212, 213, 216a, 218, 219, 220, 225, 226, 234, 236, 237, 240 and 241 of the Bakersfield City Charter be deleted, relating to Civil Service? d. That pursuant to the direction of the City Council, the County Clerk of the County of Kern has heretofore .sonducted a canvass of the results thereof and has filed with said City Council a certificate relating thereto which has been .examined and is hereby accepted by this City Council; and e.
