HomeMy WebLinkAboutRES NO 228-88RESOLUTION NO. 228-88 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS AND CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT (FEIR) FOR THE PROPOSED KERN RIVER PARKWAY PLAN. WHEREAS, the City of Bakersfield proposes a plan to pro- vide recreational opportunites and habitat preservation and enhancement for a ].,400-acre area in and adjacent to the Kern River, west of Manor Street to the Stockdale Highway Bridge; and WHEREAS, the plan, as outlined in the Final Master Plan Map, would allow continuation of the Kern River's current flood control and water conservation uses; and WHEREAS, the plan would also provide improved recrea- tional areas, increased access, greenbelts and walking and riding trails and provide open space for the long-term preservation of native habitat; and WHEREAS, a Draft Environmental Impact Report (DEIR) on this proposal was prepared by the City of Bakersfield under con- tract with a consultant, circulated and distributed in accordance with the requirements of law and applicable regulations; and WHEREAS, public and private agencies and individuals submitted written comments on the DEIR, as documented in the Final Environmental. Impact Report (FEIR); and WHEREAS, a duly noticed public hearing was conducted by and before the City of Bakersfield Planning Commission in accordance with procedures required by City Resolution No. 107-86, on August 4, 1988, at which hearing the public was entitled to comment on the DEIR; and WHEREAS, the consultant responded in writing to all significant points raised by the public and private agencies and individuals in the review and public hearing process in the Final EIR, consisting of a DEIR, technical appendix and comments and responses to the DEIR; and WHEREAS, a duly noticed public hearing was conducted on October 6, 1988 by and before the City of Bakersfield Planning Commission to receive input on the Final EIR; WHEREAS, the consultant has responded in writing to all significant points raised by the Planning Commission and public and private agencies and individuals in the review and public hearing process; and WHEREAS, the City of Bakersfield Planning Commission found that significant environmental effects raised in the Final EIR have been eliminated or substantially lessened and that unavoidable environmental effects would require a Statement of Overriding Considerations should the proposal be approved. WHEREAS, a noticed public hearing was held November 30, 1988, before the Council of the City of Bakersfield, on the issue of certification of the Final EIR. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct. 2. Required public notices have been given. The Final EIR consists of the DEIR dated June, 1988, DEIR Technical Appendix dated June, 1988 and the Final EIR (response to comments and DEIR text amendments) dated September, 1988. The Final EIR has been completed in compliance with CEQA and City Resolution 107-86. The Final EIR was presented to the Planning Commission and the Commission reviewed and considered the informa- tion contained in the Final EIR prior to considering the project. Mitigation measures are required and must be incorporated into the project (if approved) which would avoid or substantially lessen the significant environmental effect as identified in the Final EIR. If the proposed project is approved, a statement of overriding considerations would be required for noise impacts affecting the bicycle rest stop east of Golden State Highway, and potential buildout of service indus- trial uses on private property affecting the adjacent parkway. - 2 - The Final EIR serves as the environmental document for amendments to the Kern River Plan Element (1-88, Segment 1) of the general plan necessary for implementa- tion of the Parkway Plan. The Final EIR has been completed in compliance with CEQA, the State EIR Guidelines and the City of Bakersfield Resolution No. 107-86, including findings a through g on Pages 3 and 4 of the Final EIR staff report; and is hereby certified as adequate, including all mitigation measures identified in the revised appendix F of the project staff report. .......... o0o ..........
