A RESOLUTION OF THE COUNOIL OF THE CITY
OF BAKERSFIELD AUTHORIZING THE SALE OF
SURPLUS REAL PROPERTY (MIXING YARD) AND
FINDING THAT SUCH SALE IS IN THE BEST
INTERESTS OF THE CITY.
WHEREAS, pursuant to Section 3.20.125 B. of the Municipal
Code of the City of Bakersfield, the Council may authorize a nego-
tiated sale of real property when it finds that such sale is in
the best interests of the City; and
WHEREAS, said Council did fix 7:00 P.M., or as soon
thereafter as the matter may be heard, on WEDNESDAY, SEPTEMBER 28,
1988, in the Council Chambers of City Hall, 1501 Truxtun Avenue,
Bakersfield, California, as the time and place for hearing all
persons interested in or objecting to said proposed sale of the
Mi~ing Yard, located at 4200 Truxtun Avenue, west of Empire Drive;
and
WHEREAS, said hearing was duly noticed and held on.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
That the sale of the Mixing Yard, located at 4200
Truxtun Avenue, west of Empire Drive, is in the
best interests of the City;
That the benefits to be derived by the City justify
the sale price of $1,005,000;
That the Mayor is authorized to execute the papers
of conveyance and conclude the sale of real property
pursuant to such other terms and conditions as are
acceptable to City staff; and
That a real estate sales commission of six percent
(6%) of the sales price is authorized to be paid
from the proceeds of the sale.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on ____~eptember 28, 1988 _, by
