A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ~4AKING FINDINGS AND ORDERING THE
TERRITORY DESIGNATED AS PROCEEDING NO. 969,
ANNEXATION NO. 320 (OSWELL NO. 7), ANNEXED
TO THE CITY OF BAKERSFIELD. (WARD 1)
WHEREAS, Resolution of Application No. 45-88r dated
March 16, 1988, was submitted to the Local Agency Formation
Commission of Kern County ("Commission") for the annexation of
territory of the City of Bakersfield designated as Proceeding No.
969, Annexation No. 320 (Oswell No. 7); and
WHEREAS, a duly noticed public hearing upon said pro-
posal was held before the Commission on the July 26, 1988; and
WHEREAS, following said public hearing the Commission on
July 26, 1988, adopted its Resolution Making Determination,
being Resolution No. 88-21, recorded in Minute Book 35 of said
Commission; designating the City of Bakersfield as the conducting
authority and authorized said City to annex subject territory
without notice and hearing and without election.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. The description of the exterior boundaries of the
territory annexed is contained in Exhibit "A", attached hereto
and incorporated in this Resolution as though fully set forth
herein.
2. That the said territory designated as Proceeding No.
969, Annexation No. 320 (Oswell No. 7), and described herein, and
every part thereof, is hereby ordered annexed to the City of
Bakersfield, subject to the following conditions:
(1)
The five members of the Board of Supervisors
of Kern County shall remain as the Board of
Directors of Mount Vernon-Panorama Sanitation
District.
(2)
Properties located within the area to be
annexed and also located within the Sphere
of Influence of Mount Vernon-Panorama
Sanitation District on January 1, 1988 shall
be within the sewer service area of that
sanitation district, except by mutual agree-
ment to the contrary by the sanitation district
and the City of Bakersfield.
(3)
Sewers maintained, or to be maintained, by the
sanitation district shall be constructed to the
codes and requirements of the sanitation
district, rather than the City of Bakersfield.
3. That the Clerk shall forthwith transmit a certified
copy of this resolution ordering a change of organization, along
with any required remittance to cover the fees required by
Section 54902.5 of 'the Government Code, to the executive officer
of the Local Agency Formation Commission of Kern County.
4. That the Executive Officer of the Commission is
hereby requested to prepare and execute a certificate of comple-
tion and make the filings required by Part 4, Chapter 8 of the
Cortese-Knox Local Government Organization Act of 1985 and record
a certified copy of the certification of completion with the
recorder of Kern County, with the surveyor of Kern County and
with the Clerk of the City of Bakersfield.

I HEREBY CERTIFY that the foregoing Resolution was passed

meeting thereof held on July 27, 1988 , by

OSWELL NO. 7
A parcel of land situated in the County of Kern, State of California, being a
portion of Sections 34 and 35, Township 29 South, Rang~ 28 East, M.D~B. & M.,
more particularly described as follows:
Beginning at a point of intersection of the West line of the East 55 feet
of the Southeast ~ of said Section 34 and the South line of the North ~ of
the Southeast ~ of Section 34, said point being on the existing corporate
boundary of the City of Bakersfield;
/]{ENCE (1) Northerly along said West line, 629.21 feet more or less, to the
South right-of-way line Of Alloway Lane (Co. Rd. No. 1495);
THENCE (2) Easterly along said South right-of-way line and Easterly prolonga-

of Virginia Avenue School Property;
