HomeMy WebLinkAboutRES NO 152-88RESOLUTION NO. 152-88 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CALLING THE SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY AMENDMENTS TO THE CHARTER OF THE CITY OF BAKERSFIELD, AND PROVIDING FOR THE CONSOLIDATION OF SAID SPECIAL MUNICIPAL ELECTION WITH THE GENERAL MUNICIPAL ELECTION FOR THE OFFICE OF THE MAYOR AND THE STATE OF CALIFORNIA GENERAL ELECTION, ALL TO BE HELD ON TUESDAY, NOVEMBER 8, 1988, AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF KERN TO ORDER THE CONSOLIDATION OF SAID ELECTIONS. WHEREAS, the General Election will be held on the November 8, 1988; and WHEREAS, by separate resolution of the Council, the General Municipal Election for the Office of Mayor is also called for is also called for November 8, 1988, and it is desired to con- solidate such election with the Special Municipal Election for the purpose of submitting to the electors of the City amendments to the Charter of the City of Bakersfield and the State of California General Election to be conducted by the County; and WHEREAS, through said election hereby called, the Council of the City of Bakersfield proposes to submit amendments to the City Charter in the manner set forth in Chapter 3, Division 2, of Title 4 (commencing with Section 34450 of the Government Code of the State of California), at a General Election as aforesaid; and WHEREAS, the Charter amendments so proposed to be submit- ted is as follows: MEASURE "A" Should Sections 16, 20, 67, 68 and 74 of the Bakersfield City Charter be amended; Sections 33, 66, 69, 70, 71, 72, 73 and 75 of the Bakersfield City Charter be deleted; and Section 67.1 added to the Bakersfield City Charter relating to elections? MEASURE "B" Should Sections 14, 20 and 21 of the Bakersfield City Charter be amended to clarify the right of the Mayor to vote to break tie votes of the Council, to provide annual salary for Mayor in amount of Twenty Four Thousand Dollars ($24,000.00), and to make miscellaneous changes in the descriptions of the duties and functions of the office of the Mayor. MEASURE "C" Should Section 18 of the Bakersfield City Charter be amended to provide annual salary for council- members in amount of Six Thousand Dollars ($6,000.00). MEASURE "D" Should Sections 13, 15, 33.3, 38, 40, 41, 134, 162 and 163 of the Bakersfield City Charter be amended and Sections 33.1, 33.2, 49, 51, 52, 53, 55, 57, 58, 60, 137, 138, 158, 159, 160 and 184 of the Bakersfield City Charter be deleted, to amend or eliminate unnecessary or obsolete language and practices relating to many unrelated subjects? MEASURE "E" Should Sections 135 and 136 of the Bakersfield City Charter be amended and Section 143 of the Bakersfield City Charter be deleted, relating to public contracts and bidding? MEASURE "F" Should Sections 34, 37, 37.5 and 208 of the Bakers- field City Charter be amended to delete the position of City Attorney from Civil Service and to make those provisions of the Charter concerning the appointment, salary and removal of the City Manager also applicable to the City Attorney. - 2 - MEASURE "G" Should Sections 183, 185, 186, 189, 199, 200, 202, 209, 211, 214, 216, 217a, 217b, 221, 222, 223, 224, 228, 231, 233 and 239 of the Bakersfield City Char- ter be amended, and Sections 187, 188, 192, 193, 196, 201, 205, 206, 207, 210, 212, 213, 216a, 218, 219, 220, 225, 226, 234, 236, 237, 240 and 241 of the Bakersfield City Charter be deleted, relating to Civil Service? NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That the above-stated measures to amend the Charter of the City of Bakersfield are hereby submitted for placement on the ballot in proper form to be used at said election. 2. That 'the Special Municipal Election is hereby called to be held in the City of Bakersfield on Tuesday, the 8th day of November, 1988, for the purpose of submitting to the electors of said City, the foregoing Charter amendments to the City Charter. 3. That ~he election hereby called, to wit, the Special Municipal Election for the purpose of submitting to the electors of the City of Bakersfield the above-specified amendments to the City Charter is hereby ordered consolidated with the General Municipal Election for the Office of Mayor of the City of Bakers- field and the State of California General Election to be conducted by the County on Tuesday, November 8, 1988. 4. That the polls shall be open in all precincts in the City from 7:00 A.M. to 8:00 P.M. 5. That the City Clerk shall give all notices and per- form all advertisil~g as required by law and perform or cause to be performed all the duties and functions required by law for revi- sion of the City Charter. .......... o0o ..........
