A RESOLUTION OF THE COUNCIL DECLARING ITS INTENTION
TO ORDER THE VACATION OF CAMINO GRANDE DRIVE
FROM THE WEST BOUNDARY OF PARCEL MAP NO. 10,053
TO THE NORTH/SOUTH ROADWAY AT MID-SECTION LINE
OF SECTION 12, T. 29 S., R. 28 E., M.D.M.
WHEREAS, El Paso Merchant ]Energy on behalf of Bear Mountain Cogeneration Plant
submitted a request for the vacation of Camino Grande Drive from the west boundary of Parcel
Map No. 10,053 to the north/south roadway at mid-section line of Section 12, T. 29 S., R. 28 E.,
M.D.M.; and
WHEREAS, for the above-described project, it was determined that the proposed
vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines (General
Rule) in that there is no possibility that the proposed vacation could have a significant effect on
the environment; and
WHEREAS, at its meeting on August 3, 2000, the vacation was duly heard and
considered by the Plarming Commission and was found to be consistent with Metropolitan
Bakers field 2010 General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakers~eld as
follows:
1. The above recitals are true and correct and are incorporated herein.
This resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of Califomia.
The Council intends to order the vacation of E1 Paso Merchant Energy on behalf
of Bear Mom~tain Cogeneration Plant which submitted a request for the vacation
of Camino Grande Drive from the west boundary of Parcel Map No. 10,053 to the
north/south roadway at rrdd-section line of Section 12, T. 29 S., R. 28 E., M.D.M.
in the City of Bakersfield, County of Kern, State of California, more particularly
described as follows: See.. Exhibit "A" attached hereto and made a part hereof by
this retirerice.
Easement rights shall be reserved over the above described strip of land as
follows:

An easement for public utilities pu~oses shall be provided over the entire
strip.
Access for fire protection, police services and all emergency services shall
be provided over the entire strip.
Access for County vehicles, City municipal services and vehicles
necessary for plant operation shall be provided over the entire strip.
An easement for City bike path purposes shall be provided over the entire
strip.
7:00 PM on Wednesday, September 27, 2000, in the Council Chambers, City
Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time
and place when all persons interested in or objecting to the proposed vacation may
appear before the City Council and be heard.
The City Clerk shall cause notice of the date, hour, and place of said hearing on
this resolution to be published for two successive weeks prior thereto in The
Bakersfield Californian and the Superintendent of Streets of the City of
Bakersfield, California, s hall cause "Notice of Vacation" to be posted as required
by Section 8323 of the Streets and Highways Code of the State of California.
The City Clerk shall certify to the passage of this resolution and shall cause the
same to be posted on the bulletin board at the City Hall, 1501 Truxtun Avenue, in
the City of Bakers field, within fifteen (15) days after its passage.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by

All that portion of the north half of the southwest quarter of Section 12, Township
29 South, Range 28 East, M.D.M. more particularly described as follows:
The north 45.00 feet of the east 1249.16 feet of said north half of the southwest
quarter except the east 45.00 feet thereof.
A/so:
A triangular parcel bounded on the north by the south line of said north 45.00 feet,
on the east by the west line of said east 45.00 feet, and on the southwest by an arc
of a circle concave to the southwest, having a radius of 20.00 feet and tangent to
last mentioned south and west lines.
