A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DECLARING THE RESULTS OF CANVASS
OF RETURNS OF THE NOMINATING MUNICIPAL ELECTION
FOR THE OFFICE OF MAYOR AND SPECIAL MUNICIPAL
ELECTION FOR A CHARTER AMENDMENT, MEASURE "D",
AT THE STATE DIRECT PRIMARY ELECTION HELD ON
THE 7TH DAY OF JUNE, 1988.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
SECTION 1.
That the City Council does hereby find, determine and
declare as follows:
a. That pursuant to applicable law, a Special Municipal
Election was held and conducted in said City on the 7th day of
June, 1988; and
b. That said election was held and conducted in confor-
mity with all applicable provisions of law; and
c. That said Special Municipal Election was held for
the purpose of submitting to the voters of said City the following
proposed amendment to the Charter of the City of Bakersfield:
CITY OF BAKERSFIELD MEASURE "D"
Shall Section 3 of the Charter of the City of
Bakersfield be amended to add an eighth ward, to be
created by Mayor and councilpersons by altering
existing ward boundaries, the councilperson for which
will be selected at a special election; shall Section
14 of the Charter of the City of Bakersfield be
amended to refer to eight councilpersons and eight
wards, in conformance with the amendment to Section 3
and to delete provisions restricting Mayor's right to
vote on legislative matters to situations of tie votes
of the Council; shall Section 20 of the City Charter be
amended to provide that the Mayor shall promote the
City, be a full-time position of not less than 40 hours
per week, and receive an annual salary of forty-two
thousand dollars ($42,000.00) adjusted annually in
reference to the Consumer Price Index; to provide that
each fiscal year the Council appropriate not less than
twelve thousand dollars ($12,000.00) for the general
promotion of the City, including reception and enter-
tainment of public guests, to provide that the Mayor be
provided a furnished office at City Hall and a vehicle
for the conduct of his official duties, to specify that
the Mayor be provided a full-time secretary and an aide
with a furnished office whose position shall not be
civil service, whose salary shall be set by ordinance
of the Council, and who shall be selected by and serve
at the will of the Mayor; shall Section 33.3 of the
City Charter be amended to provide that six, rather
than five, votes of the Council are required for appro-
val of any resolution authorizing revenue bonds;~ and
shall Section 37.5 of the Charter of the City of
Bakersfield be amended to provide that the City Manager
may be removed by the affirmative votes of five, rather
than four, members of the Council.
d. That pursuant to direction of the City Council, the
County Clerk of the County of Kern has heretofore conducted a can-
vass of the results thereof and has filed with said City Council a
certificate relating thereto which has been examined and is hereby
accepted by this City Council; and
e. That the Statement of Election Results relating to
said Special Election is attached hereto as Exhibit "A", and by
this reference incorporated herein.
SECTION 2.
That the City Council does hereby find, determine, and
declare as follows:
a. That pursuant to applicable law, a Nominating
Municipal Election was held and conducted in said City on the
7th day of June, 1988 for the purpose of electing a Mayor; and
b. That said election was held and conducted in confor-
mity with all applicable provisions of law; and
c. That pursuant to direction of the City Council, the
County Clerk of the County of Kern has heretofore conducted a can-
vass of the results thereof and has filed with said City Council a
certificate relating thereto which has been examined and is hereby
accepted by this City Council; and

d. That the City Council does hereby accept the canvass
of record of said elections as certified by said County Clerk and
does hereby resolve, determine and declare the results of said
Nominating Election as follows:

e. That the following persons have been nominated, and
are hereby determined to be, Candidates for the Office of Mayor at
the General Election to be held on November 8, 1988:

f. That the City Council does hereby accept the canvass
of record of said Special Municipal Election as certified by said
County Clerk and does hereby declare that 9,326 votes were cast in
favor of the adoption of said amendment and 21,719 votes were cast
against adoption of said amendment and that said amendment is
hereby declared not to have carried, passed or been adopted.
SECTION 3.
That the City Clerk is hereby directed to enter this
resolution in full in the minutes of this City Council, which
entry shall constitute the City Clerk'$ Statement of the result
of the election.
SECTION 4.
That the City Clerk shall certify the adoption of this
resolution.
