A RESOLU1FION APPROVING THE
AMENDMENT OF THE SITING ELEMENT
DESCRIBBNG 3''HE CHINA GRADE CLASS III
SANITARY LANDFILL AS A CLOSED
FACILITY.
WHEREAS, the applicant, Kern County Waste Management Department, intends
to close the disposal area of the China Grade Class Ill Sanitary Landfill: and
WHEREAS, the Kern Countywide Siting Element needs to be amended to reflect
the closure of this facility; and
WHEREAS, the Kern County' Waste Management Department has prepared a
report recommending that the Council for the City of Bakersfield make a finding that the
closure of the China Garde Class Ill Sanitary Landfill is in conformance with the Kern
Countywide Siting Element; and
WHEREAS, in its investigation and evaluation of possible environmental impacts
of this project, the Waste Management Department for the County of Kern has prepared
a Negative Declaration and the Kern County Board of Supervisors will take action on said
Negative Declaration on July 25, 200,0; and
WHEREAS, the City Clerk for the City of Bakersfield has caused notice to be duly
given of a public hearing in this matter in accordance with the law, as evidenced by the
affidavit of publication and the affidavit of mailing on file with the City Clerk; and
WHEREAS, at this public hearing, the City Council for the City of Bakersfield duly
approves the amendment of the Siting Element, describing the China Grade Class III
Sanitary Landfill as a closed facility and approving the report and recommendations of the
Kern County Waste Management Department, and all interested persons have been given
the opportunity to address, and were heard by the City Council for the City of Bakersfield;
and
WHEREAS, all persons desiring to be heard in said matter have been duly heard,
and this Council having considered all testimony presented during said public hearing, and
the report and recommendations of the Kern County Waste Management Department.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct in incorporated herein by reference.
2. The Council finds that the facts recited in the above recitals are true and
further finds that this Council has jurisdiction to consider, approve and adopt the sul~j~.~,~

of this resolution.
3. The Council hereby approves the amendment of the Siting Element
describing the China Grade Class III Sanitary Landfill as a closed facility.
4. The City Clerk shall cause a copy of this Resolution to be sent to Susan Reid
of the Kern County Waste Management Department.
