HomeMy WebLinkAboutRES NO 133-88RESOLUTION NO. 133-88 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF THE EASTERLY HALF OF THE ALLEY IN BLOCK 4 OF HOMAKER PARK TRACT IN THE CITY OF BAKERSFIELD (SOUTH OF 34TH STREET, EAST OF SAN DIMAS). WHEREAS, on June 8, 1988, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1046 declaring its intention to order the vacation of the easterly half of the alley in Block 4 of the Homaker Park Tract in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which said hearing was held on WEDNESDAY, JULY 6, 1988, after notices were duly published and posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That the vacation of the easterly half of the alley in Block 4 of the Homaker Park Tract in the City of Bakersfield, County of Kern, State of California, more particularly described in Exhibit "A" attached hereto and made a part hereof, is unneces- sary for present or prospective public street purposes. 2. That the vacation of the easterly half of the alley in Block 4 of the Homaker Park Tract in the City of Bakersfield, County of Kern, State of California, be and the same is hereby closed up, vacated and abandoned for public street purposes, sub- ject to and in conformity with the following conditions: 9?he property owner shall dedicate an access easement for the public in general and for municipal services connecting the remaining portion of the public alley to 34th Street and said easement shall be maintained by the property owner. Owner or developer shall provide and pay for any relocation of public sewers, public utilities, or any other public facilities required for development and easements shall be provided for all such facilities. Reference to said Resolution of Intention No. 1046 is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. .......... ooo ..........
