A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING THE VACATION OF 9TH
STREET BETWEEN "H" AND EYE STREETS AND A
PORTION OF THE ALLEY IN BLOCK 48 IN THE
CITY OF BAKERSFIELD.
WHEREAS, on May 11, 1988, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets,
Highways and Service Easements Vacation Law," being Chapter 3 of
Part 3 of Division 9 of the Streets and Highways Code of the State
of California, passed and adopted its Resolution of Intention No.
1044 declaring its intention to order the vacation of 9th Street
between "H" and Eye Streets and a portion of the alley in Block 48
in the City of Bakersfield, County of Kern, State of California;
and
WHEREAS, said Council did fix a time and place for hearing
all persons interested in or objecting to said proposed vacation,
which said hearing was held on WEDNESDAY, JUNE 8, 1988, after
notices were duly published and posted as required by law; and
WHEREAS, this Council after duly considering the matter,
does hereby find and resolve as follows:
1. That the vacation of 9th Street between "H" and Eye
Streets and a portion of the alley in Block 48 in the City of
Bakersfield, County of Kern, State of California, more particu-
larly described in Exhibit "A" attached hereto and made a part
hereof, is unnecessary for present or prospective public street
purposes.
2. That the vacation of 9th Street between "H" and Eye
Streets and a portion of the alley in Block 48 in the City of
Bakersfield, County' of Kern, State of California, be and the same
is hereby closed up, vacated and abandoned for public street pur-
poses, subject to and in conformity with the following reserva-
tions and exceptions:

Easements shall be reserved for any public
utility facilities or public sewer lines remaining
within the area hereby vacated; and

A 25-foot wide East/West extension of the alley in
Block 48 between "H" Street and Eye Street shall be
dedicated, including 10 feet x 10 feet corner cut-
offs, and constructed to City standards; and

Street improvements (curb and gutter, sidewalk~
paving) shall be constructed to City standards
along "H" and Eye Streets to close vacated portion
of 9th Street by St. Francis Church, Diocese of
Fresno, by June 8, 1989.
Reference to said Resolution of Intention No. 1044 is hereby made
for further particulars.
3. That the City Clerk shall certify to the passage of
this Resolution and shall cause a certified copy hereof, attested
by the Clerk under the seal of the City, to be recorded in the
office of the County Recorder of the County of Kern, California.

PARCEL 1
All of that portion of 9th Street (82.5 feet in width)
lying adjacent to Blocks 25 and 48, being bounded on the West by
the northerly projection of the West line of Block 48 and bounded
on the East by the Northerly prolongation of the East line of
Block 48 as said street and blocks are shown on MAP OF THE CITY
OF BAKERSFIELD, LOWELL ADDITION, filed January 7, 1897, Page 23
of Map Book 1 in the office of the Kern County Recorder.
PARCEL 2
All of that portion of the alley (20 feet in width) in
above described block 48 lying North of the Westerly prolongation
of the South line of the North 3 feet of Lot 7 of said Block 48
as said alley was diminished in width by resolution of the
Council of the City of Bakersfield adopted December 23, 1918.
EXCEPTING THEREFROM, as an easement for public utilities
purposes, those 10-foot wide strips described as : the East 10
feet of PARCEL 2; and the West 10 feet and South 10 feet of the
East 127 feet of PARCEL 1.
ALSO EXCEPTING THEREFROM, as an easement for public sewer line
purposes, a 10-foot wide strip described as: the West 10 feet of
the East 15 feet of PARCEL 2; and the South 42 feet of the West
10 feet of the East 137 feet of PARCEL 1.
