A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING CHANGES AND MODIFICATION NO. 3
TO ASSESSMENT DIAGRAM AND ASSESSMENT ROLL OF
ASSESSMENT DISTRICT NO. 82-1
(STOCKDALE TRUNKLINE SEWER)

field, as follows:
WHEREAS,
by the City Council of the City of Bakers-
the City Council of the City of Bakersfield
did on July 20, 1982, adopt its Resolution of Intention No. 955
relating to certain proposed acquisitions and improvements for an
assessment district designated Assessment District No. 82-1 of
the City of Bakersfield described in said Resolution of Intention
being hereby expressly made for all further particulars relating
thereto; and
WHEREAS, an Assessment and Diagram were duly made and
filed with said City Council and after hearing, duly noticed and
he]d, said Assessment and said Diagram were confirmed and
approved by Resolution No. 64-83 adopted April 20, 1983, and
changed and modified by Resolution No. 54-87 adopted April 8,
1987, and by Resolution No. L39-87 adopted July 29, 1987; and
WHEREAS, it is proposed to amend certain assessments of
said Assessment District No. 82-1 by transfer of sewer capacity
and the assessed cost therefore to property within said Assess-
merit District No. 82-1; and
WHEREAS, the Engineer of Work has reported on said
amendments, changes and modifications, proposed capacity trans-
fers and proposed assessments, and said amendments, changes and
modifications, including but not limited to new parcels created
by division of land, are more particularly described in the
Amended Assessment Diagram and Amended Assessment Roll submitted
to this City Council and on file in the office of the Superinten-
dent of Streets of the City of Bakersfield; reference is made
thereto and they shall govern for all details thereof; and
WHEREAS, the total amount of assessment has not been
increased and as to any transfers of capacity and assessment, the
owners of the property affected have requested the changes in
writing.
NOW, THEREFORE, BE IT ORDERED AS FOLLOWS:
1. That the Amended Assessment Diagram (Assessment and
Diagram Amendment No. 14) of said Assessment District No. 82-1 be
approved as submitted.
2. That the Amended Assessment Roll for said Assess-
ment District No. 82-1 be approved as submitted and the revised
assessments and new assessments are confirmed and levied as set
forth in said Amended Assessment Roll, a copy of which is
attached hereto and incorporated herein by reference.
3. That the Finance Director of the City of Bakers-
field shall cause the revisions to existing assessments and the
new assessments to be shown on the auditor's Roll for collection
in accordance with law and a Notice of Amended Assessment to be
recorded to set forth the .Liens of assessment on the affected
property of said Assessment District No. 82-1.
4. That the Superintendent of Streets shall cause the
Amended Assessment Diagram (Assessment and Diagram Amendment No.
14) to be filed and recorded in the same manner as the original
Boundary Map and Assessment Diagram were filed and recorded for
said Assessment District No. 82-1.

Highways Code, the undersigned, CAROL WILLIAMS, City Clerk of the
City of Bakersfield, hereby gives notice that an Amended Diagram
and Amended Assessment (Assessment and Diagram Amendment No. 14)
were filed and recorded in the office of the Superintendent of
Streets of the City of Bakersfield, relating to the following
described real property:

assessments assessed on the lots, pieces and parcels shown on the
Amended Assessment Diagram (Assessment and Diagram Amendment No.
14) of Assessment District No. 82-] shall become a lien upon the
lots or portions of lots assessed, respectively.
Reference is made to saSd Amended Assessment Diagram
and Amended Assessment Roll recorded in the office of the Super-
intendent of Streets of the City of Bakersfield.
Attached hereto pursuant to the requirements of Section
27288.1 of the Government Code, marked Exhibit "A", is a copy of
the Amended Assessment Roll, showing the name or names of the

Application:
REQUEST FOR CHANGE AND MODIFICATION NO. 3 AMENDING EXISTING ASSESSMENTS 1425 AND
3072.
California Harvest Shops Inc. (hereinafter "CHSI") is the owner of Lots 1
through 35 in Tract 5024, a subdivision of all of existing Assessment 1425
in City of Bakersflorid Assessment District No. 82-1 (hereinafter "A.D. 82-
1"). CHSI is also the owner of Kern County Assessor's Parcel 390-010-26-
00-3 (existing A.D. 82-1 Assessment 3072). As the owner of the referenced
properties we find that:
The original assessment levied on Assessment 1425 was based on the
cost of Stockdale Trunkline Sewer Capacity (hereinafter "STS
Capacity") needed to service build-out of the property at its then
existing R-2 and R-3 zoning. Assessment 1425 has been rezoned and
subdivided by Tract 5024 into 35 lots zoned R-1 and a 3.3 acre church
parcel.
The rezoni. ng and subdivision of Assessment 1425 has reduced the
STS Capacity needed to service build-out of the parcel from the
originally assessed 405 Equivalent Residential Dwelling Units
(hereinafter "EDU's"), to a revised total of 55 EDU's.
Therefore, Assessment 1425 has a total surplus STS Capacity
350 EDU's.

Existing Assessment 3072 is a parcel of about 217 acres, zoned for
mixed use dew~lopment. Assessment 3072 does not have sufficient STS
Capacity available to service full build-out of the parcel as
currently zoned and with proposed uses.
We therefore request the Superintendent of Streets for the City of
Bakersfield to initiate a Change & Modification proceeding for A.D. 82-1,
pursuant to Section 10350 Et Seq. of the Streets & Highway Code, to amend
existing Assessments 1425 and 3072. The requested change and modification
would include the amendment of said assessments to transfer surplus STS
Capacity and related unpaid assessment principal from Assessment 1425 to
Assessment 3072.
The requested assessment amendments and STS Capacity transfer are
authorized by City Agreement No. 83-80, as amended, and are needed to
correct the aforementioned unbalanced assessments and STS Capacity
surpluses and deficiencies affecting Assessments 1425 and 3072. The
existing assessment principal amounts and proposed assessment and STS
Capacity transfer amounts are shown on EXHIBIT "B" attached hereto. The
proposed amended assessment principal balance for Assessmeat 3072 that
would be levied on that parcel by City Council approval of this requested
Change and Modification No. 3 is shown on EXHIBIT "A", Amended Assessment
Roll attached hereto, as Amended Assessment 3077.
Upon completion of the requested transfer of capacity and assessment, the
amended assessment and STS Capacity for Assessment 1425 will be equal to
the amount of assessment and capacity that would have been assessed to
Tract 5024, as it is currently zoned and with proposed uses, had that tract
existed at the timm of the original confirmation of the A.D. 82-1
assessments.
II.
REQUEST FOR APPORTIONMENT OF UNPAID ASSESSMENT PRINCIPAL SHARE FROM AMENDED
ASSESSMENT 1425 TO TRACT 5024 LOTS, AND FOR APPORTIONMENT OF THE UNPAID
ASSESSMENT PRINCIPAL FROM EXISTING ASSESSMENTS 1431 AND 1435 TO PARCEL MAP 8160
PARCELS AND TO THE UNDIVIDED REMAINDER PARCELS OF ASSESSMENTS 1431 AND 1435.
CHSI, being the owner or interested party in the properties identified on
Exhibit "B" attached hereto, as existing Assessments 1425, 1431 and 1435 in
A,D. 82-1, hereby requests the Superintendent of Streets for the City of
Bakersfield to apportion the amount remaining unpaid on the referenced
assessments in accordance with the provisions of the "Improvement Bond Act
of 1915." Said assessments are to be apportioned to each separate part of
the original parcel of land; the apportioned share of the unpaid amount of
the assessment will be levied as shown on EXHIBIT "A", Amended Assessment
Roll attached hereto, as if each parcel had been so divided at the time of
the original confirmation of the A,D. 82-1 assessments.
III.
ACCEPTANCE OF ASSESSMENT SPREAD PROCEDURE FOR CHANGE AND MODIFICATION NO. 3 AND
FOR APPORTIONMENT OF ASSESSMENTS 1425, 1431, 1435 AND 3072.
We have reviewed the procedure used to de:ermine the amount of STS Capacity
and unpaid assessment principal requested for transfer from Assessment 1425
to Assessment 3072. We have also reviewed the procedure used to apportion
a share of the unpaid assessment principal for Assessments 1425, as
proposed to be amended, and Assessments 1431 and 1435 to the lots, parcels
and remainder pieces created by the subdivision of those properties by,
respectively. Tract 5024 and Parcel Map 8160.
Pursuant to our review of the procedures used for the spread of the
requested assessment transfer and apportionments, we have determined that
the amended assessments shown on EXHIBIT "A", Amended Assessment Roll
attached hereto, are apportioned in accordance with the benefits those
parcels will receive from the Stockdale Trunkline Sewer System
improvements, based on current parcel zoning and with proposed uses.
IV.
WAIVER OF NOTICE AND HEARING ON CHANGE AND MODIFICATION NO. 3 AND REQUEST TO
RECORD AMENDED ASSESSMENTS

Pursuant to our aforementioned review and acceptance of the assessment
spread procedures, we herewith waive notice and hearing before the City
Council on the requested assessment amendments and apportionments, accept
the revised assessments for the referenced parcels, and request that the
City Council approve ChanEe and Modification No. 3, the Amended Assessment
Roll and Amended Assessment Diagram attached hereto.
We further request that following City Council approval of the ~ended
Assessment Roll and Amended Assessment Diagram, said ~ended Diagram and a
Notice of Amended Assessment be recorded with the County Recorder of the
County of Kern.
