HomeMy WebLinkAboutRES NO 77-88RESOLUTION NO. 77-88 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD REQUESTING KERN COUNTY LOCAL AGENCY FORMATION COMMISSION TO APPROVE REVISION OF CITY'S SPHERE OF INFLUENCE AND THAT SUCH COMMISSION FIND THAT SUCH REQUEST CAN BE CONSIDERED AND STUDIED AS PART OF PERIODIC REVIEW. (RENFRO NO. 1 ANNEXATION) WHEREAS, a "sphere of influence" means a probable ultimate physical boundaries and service governmental agency; and plan for the area of a local WHEREAS, the Local Agency Formation Commission is required to develop and determine the sphere of influence of each local governmental agency within the county in order to carry out its purposes and responsibilities for planning and shaping the logical and orderly development and coordination of such agencies so as to advantageously provide for the present and future needs of the county and communities; and WHEREAS, tf any city desires amendment or revision of an adopted sphere of Jinfluence, the City, by resolution of the City Council, may, under Section 56428 of the Government Code, file a request therefor wJ[th the executive officer who shall present the same to the Local Agency Formation Commission for approval; and WHEREAS, if such commission finds that the request for amendment or revisfon of a sphere of influence can be considered and studied as a part of the periodic review of spheres of influ- ence as required by law, such commission may, in its discretion, waive reimbursement of costs; and WHEREAS, the City of Bakersfield desires revision of its adopted sphere of influence under provisions of Government Code Section 56428, to include vacant land within the proposed Renfro No. 1 Annexation that could be served by the City in the future and also desires waiver by the Local Agency Formation Commission of reimbursement costs; and WHEREAS, the Planning Commission of the City of Bakers- field held a public hearing on March 17, 1988, at the hour of 5 P.M., in the Council Chamber of City Hall, 1501 Truxtun Avenue, Bakersfield, California; and WHEREAS, .at said hearing, there was no testimony given for or against the Amendment to the Sphere of Influence, and the Planning Commission adopted its Resolution No. 28-88 approving a Negative Declaration for the proposed revision to the City's sphere of influence, and recommending approval of the proposed revision. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of the City of Bakersfield as follows: 1. That 511 the recitals set forth above are true and correct. 2. That the recitals set forth in Planning Commission Resolution No. 28-88 and a Negative Declaration for this project are hereby approved and adopted by this Council. 3. The proposed amendment is compatible with the City of Bakersfield Urban Community Service priorities. 4. The proposed amendment promotes logical and orderly development and coordination to advantageously provide for the present and future needs of the community. 5. The proposed amendment will be compatible with future and existing development on the surrounding properties. 6. Proposed amendment will not have an adverse affect on the environment and a Negative Declaration was posted and adver- tised in accordance with CEQA. 7. That the City Council hereby requests amendment of the City of Bakersfield's adopted sphere of influence by the Kern County Local Agency Formation Commission under the provisions of Government Code Section 56428, to include certain vacant land gen- erally located at the northeast corner of Stockdale Highway and Renfro Road, described as follows: SPHERE OF INFLUENCE AMENDMENT 88-1: A parcel of land situated in the County of Kern, State of California, being a portion of Sections 34 and 35, Township 29 South, Range 26 East, M.D.B.&M. and Sections 2 and 3, Township 30 South, Range 26 East, M.D.B.&M., more particu- larly described as follows: - 2 - Beginning at a point on the existing sphere of influence boundary of the City of Bakersfield as said boundary was amended and adopted by the City Council on May 20, 1987 and said point also being the intersection of the West line of the East 30 feet of the Northeast 1/4 of said Section 3 and the South line of the North 30 feet of the Northeast ~ of said Section 3. THENCE (1) West, along said South line, 25 feet to a point on the West line of the East 55 feet of the Northeast 1/4 of said ~ection 3; THENCE (2) North along said West line, 30 feet to a point on the South line of said Section 34; THENCE (3) continuing North along West line of the East 55 feet of said Section 34, 1,323.41 feet to a point on the North boundary line of Parcel Map 7660 filed December 17, 1985 in Book 32, Page 157 in the Office of the Recorder of the County of Kern; THENCE (4) East along said North boundary 25 feet to a point on the West line of the East 30 feet of said Section 34; THENCE (5) North along said West line, 661.99 feet more or less to a point of intersection of said West line and the North line of the South 1/2 cf the North 1/2 o~ the Southeast 1/4 of said Section 34; THENCE (6) East along said North line, 30 feet to a point on the East 1/4 corner of the Northeast 1/4 of the Southeast 1/4 of said Section 34, said point also being the C~nterline of Renfro Road (Co.Rd. No.970) and the Southwest corner of Parcel Map 3502 filed May 17, 1976 per Book 15, Page 193 in the Office of the Recorder of the County of Kern; - 3 - THENCE (7) East along the North line of the South 1/2 of the North 1/2 of the Southwest 1/4 of said Section 35, 2,637.08 feet more or less, to the East line of the Southwest 1/4 of said Section 35; THENCE (8) South along said East line, 331.34 feet more or less, to the Northwest corner of Tract 3964 filed March 12, 1981 per Book 30, Page 188 in the Office of the Recorder of the County of Kern; THENCE (9) North 89040'23" East along North boundary line of said Tract 3964, 45 feet to the East right-of-way line of Jenkins Road; THENCE (10) South 0028'29" East along said 'East right-of-way, 330.001 feet to the South right-of-way line of San Simeon Avenue; THENCE (11) North 89040'23" East along said i~outh right-of-way, line 658.971 feet to the Northwest corner of Lot 19 and a point on west boundary line of said Tract 3964; THENCE (12) South 0°26'17" East, along said boundary line, 1,270.57 feet to a point on the North line of the South 51.00 feet of said Section 35; THENCE (13) Easterly along said North line 322.48 feet to the beginning of a 2055 foot radius curve concave to the South, being 55.00 feet northerly of and parallel with that 2000 foot radius cen- ter line curve for Stockdale Highway as shown on Tract 4188 filed July 28, 1981 per Book 31, Page 44 in the Office of the Recorder of the County of Kern; THENCE (14) Easterly along said curve through a central angle of 07031'25" an arc distance of 269.85 feet; - 4 - THENCE (15) South 81050'43" East along a line parallel with and 55.00 feet North- easterly of, as measured perpendicularly from the new Centerline of Stockdale Highway as shown on Tract 4444, Unit A filed September 3, 1985 per Book 34, Page 146 in the Office of the Recorder of the County of Kern, a distance of 125.52 feet to the beginning of a 1,945.00 foot radius curve concave to the North; THENCE (16) Easterly along said curve through a central angle of 07031'25" an arc distance of 255.40 feet to a tangent point on the North line of said Section 2; THENCE (17) South 89o22'08" East along said North line, 1,003.87 feet more or less, to the Northeast corner of said Section 2 as shown on Parcel Map 4687 filed February 13, 1979 per Book 22, Page 76 in the Office of the Recorder of the County of Kern; THENCE (18) South 0°31'36" West along the East line of said Section 2, 2.89 feet more or less to a point on the South right-of-way line of Stockdale Highway (Co.Rd. No.696) also being a point on the existing Sphere of Influence Boundary of the City of Bakersfield; THENCE (19) Westerly along said Sphere of Influence Boundary to the POINT OF BEGINNING. CONTAINING 149.20 ACRES, MORE OR LESS 8. That the City Council hereby requests the Kern County Local Agency Formation Commission to find that this request for revision of the Bakersfield Sphere of Influence can be considered and studied as a part of the periodic review of spheres of influ- ence required by Government Code Section 56425 and that such Commission waive reimbursement for costs as provided in Government Code Section 56428. - 5 - 9.
