AN ORDINANCE OF THE CITY COUNCIL
ACCEPTING THE REQUIREMENTS RELATING TO
THE RECRUITMENT AND TRAINING OF
PUBLIC SAFETY DISPATCHERS
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Chapter 2.37 of the Bakersfield Municipal Code is added to read as
follows:
Chapter 2.37
AN ORDINANCE ACCEPTING THE REQUIREMENTS OF
SECTIONS (13510(c) AND 13512OF THE PENAL CODE
RELATIVE TO THE RECRUITMENT AND TRAINING
STANDARDS OF PUBLIC SAFETY DISPATCHERS
Section 2.37:
A. The City of Bakersfield declares it accepts the requirements of Section
13510(c), Chapter 1 of Title 4, Part 4, of the California Penal Code, and will adhere to
the standards for recruitment and training established by the Commission on Peace
Officer Standards and Training (POST) for Public Safety Dispatchers.
B. The adoption of this measure is not intended and shall not be construed
as creating a standard of care, but shall constitute a mechanism for reimbursement
eligibility. Without limiting the generality of the foregoing, this measure shall not create
or impose a mandatory duty under Government Code Section 815.6 or otherwise, nor
shall it be construed to constitute a statute, ordinance or regulation within the meaning
of Evidence Code Section 669.
C. The City of Bakersfield will adhere to the requirements of Section 13512,
Chapter 1, that the Commission and its representatives may make such inquiries as
deemed appropriate by the Commission to ascertain that the City of Bakersfield public
dispatcher personnel adhere to standards for selection and training established by the
Commission on Peace Officer Standards and Training.
SECTION 2.
This Ordinance shall be posted in accordance with provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and after
the date of its passage.
