HomeMy WebLinkAboutRES NO 68-88RESOLUTION NO. 68-88 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE DECLARATION AND APPROVING SEGMENT I OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE ELEMENT AMENDMENT 1-88). WHEREAS, the Council of the City of Bakersfield referred Segment I of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on March 17, 1988, on Segment I of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: SEGMENT I RICKETT, WARD, DELMARTER & DEIFEL request an amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to designate 42.98 +/- acres as Low Density Residential, 11.88 acres of Medium Density Residential, and 6.50 acres of Commercial and concurrent Zoning Upon Annexation for 61.36 +/- acres to R-1 (One Family Dwelling) Zone on 42.98 +/- acres; R-2 (Limited Multiple Family Dwelling) Zone on 11.88 +/- acres; and C-2 (Commercial) Zone on 6.50 +/- acres, located southwest of the intersection of Calloway Drive and Hageman Road; and WHEREAS, for the above described Segment, an Initial Study was conducted and it was determined that the proposed pro- ject would not have a significant effect on the environment and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution 107-86 have been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 22-88 on March 17, 1988, the Planning Commission recommended approval and adoption of Segment I by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on MAY 18, 1988, on the above-described Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given an least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bak~rsfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment I is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. Public necessity, convenience, general welfare and good planning practice justify the proposed General Plan Amendment, as conditioned below. 5. Proposed General Plan Amendment will be compatible with future development in surrounding areas and development on the project area. 6. The City Council approves and adopts Segment I of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, subject to the conditions of approval listed below: Project area designated Low Density Residential shall be restricted along western boundary to minimum lot sizes of 10,000 square feet, and - 2 - De within the area designated Medium Density Residential along western boundary no building of more than one-story shall be allowed within 100 feet of that boundary. Offers of dedication will be required to allow for construction to arterial standards of Hageman Road and Calloway Drive for the full lengths within the GPA area. Such offers of dedication shall include sufficient widths for expanded intersections and additional areas for landscaping as directed by the City Engineer. The right-of-way width of a standard arterial is 110 feet with additional widening at intersections and additional area to permit 10 feet of landscaping behind the combination sidewalk. All offers of dedication, fully executed, shall be submitted to the City prior to development within the GPA area or recordation of any subdivision map. All street paving sections are to be determined based on R-value tests using traffic index values established by the Traffic Engineer. Prior to recordation of any subdivision map or issu- ance of a building permit, the subdivider/developer shall dedicate land or pay in-lieu of fees for the development of neighborhood parks in accordance with North Bakersfield Recreation and Park District adopted standards and the District Service Agreement between that District and the City of Bakersfield. The applicant shall initiate either formation of a new landscape maintenance district or incorporation into an existing maintenance district prior to recordation of any subdivision map or issuance of a building permit within the GPA area. Upon subdivision or development, the subdiuider/developer shall be responsible for at least half width landscaped median islands in all arterial streets as directed by the City Engineer. Sewer service is available in Rancho Laborde Drive in the west half of Section 21. Municipal sewer service shall be provided to any subdivision or development within this GPA area. Me Oo This site is within the Rosedale Community Benefit Area of the Buena Vista Trunkline Sewer, and prior to recordation of a subdivision map, all applicable charges must be paid. Prior to development or recordation of a subdivision map, the applicant or its successor shall provide a comprehensive traffic study approved by the City Engineer and enter into an agreement with the City and post approved security to guarantee payment of his share of costs involved in traffic signal con- struction at the following intersections: a) Hageman Road & Calloway Drive b) Meacham Road & Calloway Drive Payment shall be made to the City upon demand at the time said funds are required for signal construc- tion. The applicant shall make arrangements with the appropriate utility company to relocate to their ultimate locations all utility poles within existing or proposed rights of way. The applicant shall provide an overall drainage study and initiate proceedings for a Planned Drainage Area, if determined necessary by the City Engineer. The drainage study shall be submitted to and approved by the City Engineer, the required drainage basin site(s) and necessary easements deeded to the City, and, if necessary, the Planned Drainage Area formed prior to submittal of any subdivision map or development plan within this area. A comprehensive sewer study shall be approved by the City Engineer prior to submittal of a development plan or subdivision map. 7. That Segment I, approved herein, be combined with other approved segments, described in separate resolutions, to form a single Land Use Element Amendment, 1-88. ........... o0o ..........
