A RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 327
(CASA LOMA NO. 3 ANNEXATION) GENERALLY LOCATED
SOUTHEAST OF THE CITY LIMITS, WEST OF THE
CITY'S SEWAGE TREATMENT PLANT, SOUTH OF WATTS
DRIVE AND NORTH OF EAST PACHECO ROAD.
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 56800 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that it hereby finds and determines as
follows:
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolu-
tion as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a Plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 56653 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985, and it is requested that
proceedings be authorized for annexation in accordance therewith.
5. That the reasons for the proposed change of organi-
zation are that the owners and residents of the affected terri-
tory desire to receive municipal services from the City of
Bakersfield, and the City desires to receive tax revenues for
benefits given and to be given to the territory proposed to be
annexed.
6. That for this proposed annexation, an Initial Study
was conducted and it was determined that the proposed project
would not have a significant effect on the environment, and a
Negative Declaration was prepared.
7. That the laws and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in the
California Environmental Quality Act and City of Bakersfield
Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and
adopted.
8. That the territory proposed for annexation as
described herein has been determined to be uninhabited pursuant
to the Cortese-Knox Local Government Reorganization Act of 1985,
Section 56046 of the Government Code.
9. That the names of the officers of the City of
Bakersfield who are to be furnished with copies of the Executive
Officer's Report aad who are to be given mailed Notice of
Hearing, if any, are:

A parcel of land situated in the County of Kern, State of California,
being a portion of Sections 9, 16 and 17, Township 30 South, Range 28
East, M.D.B.&M., more particularly described as follows:
Beginning at a point of intersection of the East line of the West half
and North line of the South 30 feet of Section 16, as said Section is
shown on the Record of Survey Map recorded in Book 6, Page 52 on the
24th day of January 1950 in the office of the Kern County Recorder,
said point of intersection also being on the existing Corporate
Boundary of the City of Bakersfield;
Thence (1) Westerly along said North line a distance of 1325.9 feet,
more or less, to the East line of Lot 29 as said Lot is shown on the
"Sales Map of Lands of Kern County Land Co." in Section 16 filed July

Please provide the following information, when applicable, only for services which will be provided by the
Applicant City/District.

Police: Ail police services in the City of Bakersfield are
administered through the City Police Department located at the
southwest corner of Truxtun Avenue and Eye Street about 5-1/2
miles northwesterly of tbe annexation.
Fire: Station 5 (City is within 1-1/2 miles at the corner of
South Chester Avenue and Planz Road.
Parks and Recreation: Planz is the nearest City park located
2 miles westerly. Park and Recreation areas will be provided
in accordance with the Casa Loma Specific Plan.
Library: Not applicable.
Streets:
Construction/Maintenance; Sweeping; Lighting: The City
Corporation Yard on Truxtun Avenue, West of Freeway 99 will
provide necessary facilities, personnel and services to
accommodate Public Works efforts. Maintenance and personnel
will be dispatched from the City Yard on a regular basis for
preventative maintenance as needed. Repair includes streets
construction/maintenance, sweeping and lighting.
Sewer: A City trunk sewer line exists in Planz Road through
the area connecting directly to City Wastewater Treatment Plant
No. 2. An existing County Sanitation District Trunk Sewer Line
is located in Cottonwood Road from Planz Road northerly.
Water: The majority of this territory is now served by or is
in the service area of the California Water Service Company.
Any portion lying outside of this service area will be served
by the same company.
Other: REFUSE - Present refuse service is by franchise
collector. Upon annexation, the City will provide collection
either by City forces or by contract with the present collector
if possible.

Service Level Capacity
Indicate frequency and availability of service
(i.e., street sweeping, response time for
emergency services, rec. programs~ etc.)
24-hour patrol is provided in the immediate
vicinity of this annexation. First priority
response is approximately 7.00 minutes or less.
Fire protection is provided on a 24-hour basis with
response time of 3 minutes or less. The annexation will
not affect City/County joint fire service capability.
All City parks are open to the public at
reasonable bouts.
Not applicable.
There will be no reduction in the range capacity
of the City to provide the necessary public
works services to this area. Services will be
on a regular basis and "as needed."

III. What effects, if any, would annexation of this territory have on the existing
level of City/District services (i.e., need for additional emergency service
personnel or construction of new facilities, etc.)? The annexation of this
territory will not affect near term level or capability of the City to provide
needed services. Upon time of full build out of this territory, additional City
police officers will be required to maintain the current level of service.
Street improvements resulting from proposed development will increase the
maintenance responsibility of the City but will not affect the existing level
of service.
IV.
Would City/District require any upgrading or change in facilities to serve
affected territory (roads, fire hydrants, mains, etc.)? If so, would City/District
o__r residents be responsible for financing? The City will not require any
upgrading or changes in existing facilities. As development occurs, Developers
shall provide and pay for major improvements and facilities and dedicate them to
the City. Also at the time of development, extension of sewer service could
possibly be provided by formation of an assessment district or by Developer/
Subdivider.
Indicate and explain existing zoning in affected territory. This area is located
within the Casa Loma Specific Plan Area adopted by the City Council on August 6,
1986 and by Kern County Board of Supervisors on August 25, 1986. The Specific
Plan is a City/County Joint Product providing for land uses under joint
jurisdiction.
See attached Table 1 and Map for Land Use designations

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation, such as maintenance of livestock
on property, etc.) This project does not propose any Land Use or Zoning changes
from those already adopted by the Case Loma Specific Plan.

VII. List City/District services that area will directly or indirectly benefit from
such as decrease in fire insurance rate, shorter emergency response time, use of
co~nunity facilities, etc. City police should be able to respond in a more
timely manner than the present County Sheriff and State Highway Patrol. Current
City police standard is a higher sworn officer per 1,000 population percentage
compared to the County standard. Refuse service will be provided by the City
and will result in savings to the owners within this annexation. No special
assessments or charges for street sweeping, leaf collection, school crossing
guards, street lighting energy costs and fire hydrants upon any future
development of subject area.
VIII. Please provide the following information relative to City/District and County
taxes:

assessed market value. This represents the total property tax rate. When
annexed, approximately 30% of the total tax of the area will accrue to the City.
(Rate as shown on 1987-88 County Auditor-Controller Tax Rate List).

If so, explain. Yes, the tax rate for City bonds equals 0.004970% of assessed
market value. When annexed, the total tax rate will be 1.081546%. (Rates as
shown on 1987-88 County Auditor-Controller Tax Rate List).
How will the difference in tax rates affect a house with a market value of
$50,000. The yearly tax rate would increase by the amount of $2.14 on a house of
$50,000 market value due to inclusion of the City Bond Rate. (Figure includes
deduction for home owners exemption).

3.3 Circulation System
The Circulation System land use designation is intended'to
provide new circulation system improvements within the Casa
Loma Specific Plan area in order to support industrial,
commercial and residential growth. Existing circulation
within the pro3ect area would be unable to support the
anticipated development in the area. The cost for
construction of the street improvements identified in the
Casa Loma Specific Plan Circulation System would be paid by
the developers/subdividers as development and land division
occurs within the Casa Loma Specific Plan area.
Residential- Maximum 10 units/net acre - 4,386 sq ft.

The purpose of the Low-Medium Density Residential land use
category is to designate areas which will be suitable for
traditional smaller lot, single-family homes, duplex
developments, and compatible uses. Maximum density is limited
to ten (10} dwelling units per net acre. Typicalism, the R-1
district will be characterized by the single family
subdivision.
6.2 General Commercial
The purpose of the General Commercial land use classification
is to designate areas for the widest range of retail
commercial activities, including regional shopping centers
and heavy commercial uses.
?.1 Light Industrial
The Light Industrial category is intended to provide
unobtrusive industrial activities that can locate in close
proximity to residential and commercial uses with a minimum
of environmental conflicts. These uses would be
characterized as labor intensive, nonpolluting, and uses
which do not produce fumes, odors, noise, or vibrations
detrimental to nearby properties.
7.2 Service Industrial
The Service Industrial category is intended to provide
commercial or industrial activities which involve outdoor
storage or use of heavy equipment, general manufacturing,
processing and assembling activities. Such uses produce
significant air or noise pollution and are visually
obtrusive.
7.3 Heavy Industrial
The Heavy Industrial category is intended to provide heavy
manufacturing and industrial uses which are incompatible with
other land uses, because of potential environmental effects
(noise, dust, etc.) and/or high employee densities. Heavy
industrial uses normally include manufacturing, food
processing, solid waste energy plants, steam generation
plants, and metal works plants.
