RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BAKERSFIELD DESIGNATING THE
PUBLIC WORKS MANAGER TO SEND A NOTICE .RE
THE COLLECTION OF ASSESSMENTS AND
DIRECTING THE CITY TREASURER TO ESTABLISH
A SPECIAL FUND FOR
Assessment District NO. 87-3
WHEREAS, by Resolution No. 47-88 , this City Council
confirmed an assessment on lands lying within Assessment
District No. 87-3 and ordered the assessment and diagram to be
filed in the office of the Public Works Manager, acting as the
Superintendent of Streets, the office of the County Surveyor
and to be recorded in the Office of the County Recorder; and
WHEREAS, it appears that the Public Works Manager and City
Treasurer are covered by a blanket fidelity bond covering the
faithful performance of the duties imposed by law in an amount
deemed by this City Council to be adequate; and
WHEREAS, under the provisions of Section 10424 of the
California Streets a~d Highways Code, funds collected by the
Public Works Manager pursuant to an assessment under the
Municipal Improvement Act of 1913 are required to be paid to
the City Treasurer and placed in a special fund designated by
the name of the improvement proceeding;
NOW, THEREFORE, the City Council of the City of Bakersfield
DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. There is hereby created a special fund to be
held by the City Treasurer known as the "Assessment District
No. 87-3 Improvement Fund".
SECTION 2. The Public Works Manager is authorized to send
a notice re the collection of assessments and the City
Treasurer, on behalf of the Public Works Manager, is hereby
designated to collect and receive all funds paid on account of
the assessment leived upon lands in Assessment District No.
87-3 and the City Treasurer is directed to place all funds so
received in the aforesaid Assessment District No. 87-3
Improvement Fund.
SECTION 3. This City Council finds and determines that
those assessments paid in cash during the thirty day cash
payment period be reduced by Ten Percent
( 10 %) of the amount shown as the assessment
on the Engineer's Final Report as such reduction represents the
cost attributable to the issuance of the bonds representing
unpaid assessments.
PASSED AND ADOPTED by the City Council of the City of
Bakersfield at a regular meeting held on March 30, 1988.
