HomeMy WebLinkAboutRES NO 24-88RESOLUTION NO. 24-88 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, ADOPTING NEGA- TIVE DECLARATION AND APPROVING AND ADOPTING SEGMENT III OF PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 4-87). WHEREAS, the Council of the City of Bakersfield referred Segment III of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on December 17, 1987, on Segment II.I of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hear- ing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows: SEGMENT III: CITY OF BAKERSFIELD requests to amend the Bakersfield Metropolitan Area General Plan by adding an area from the Rosedale General Plan of the County of Kern and changing a portion of the project area designation of Rancho Residential (1 acre net, 0.11 to 0.75 du/ga) on 11.818 acres to Low Density Residential (0.5 to 5.49 du/ga), Commercial on 7.652 acres and Public Facility (Fire Station) on .516 acre to Commercial. Concurrent Zoning Upon Annexation (ZUA #4648) will be a change from County E(¼) (Estate 1/'4 Acre District) on 13.512 acres to R-1 (One Family Dwelling) Zone, from C-2 PD (General Commercial Precise Development Combining District) on 5.958 acres, to C-2 (Commercial) Zone, and from A (Exclusive Agriculture District on .516 acre to C-2 (Commercial) Zone; and WHEREAS, for the above described Segment, an Initial Study was conducted and it was determined that the proposed pro- ject would not have a significant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, the law and regulations relating to the prepar- ation and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution 107-86 have been duly followed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 5-88 on December 17, 1987, the Planning Commission recommended approval and adoption of Segment III and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on February 24, 1988, on the above-described Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given an least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment III is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 4. The C~ty Council hereby approves and adopts Segment III of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, with incorporation therein of the following conditions of development: An agreement similar to the Olive Drive Annexation Service Agreement between the City of Bakersfield and North Bakersfield Parks and Recreation District should be executed per prior arrangement. - 2 - Park acreage or in-lieu fees shall be required in accordance with North Bakersfield Parks and Recreation District adopted standards and the District Service Agreement with the City of Bakersfield or at the City of Bakersfield adopted standard of 2.5 acres per 1,000 population, whichever is greater. Prior to recordation of any final Tract or Parcel Map, the developer will be required to form, or be included in an existing landscape maintenance district as spec- ified by North Bakersfield Parks and Recreation District. 5. That Segment III, approved herein, be combined with other approved segments, described in separate resolutions, to form a single Land Use Element Amendment, 4-87. .......... o0o .......... - 3 - I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on February 24, 1988 , by the following vote~: AYES: COUNCILMEMB[R$: CHILDS.
