A RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 318
(BERKSHIRE NO. 3 ANNEXATION).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 56800 of the Government Code of the State of California.

NOW, THEREFORE, BE IT RESOLVED by the Council of the
Bakersfield that it hereby finds and determines as
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolu-
tion as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a
of this Resolution as though fully set forth herein.

3. That a Plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 56653 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is; made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985, and it is requested that
proceedings be authorized for annexation in accordance therewith.
5. That the reasons for the proposed change of organi-
zation are that the owners and residents of the affected terri-
tory desire to receive municipal services from the City of
Bakersfield, and the City desires to receive tax revenues for
benefits given and to be given to the territory proposed to be
annexed.
6. That for this proposed annexation and the zoning
upon annexation therefor, the ordinance for which was adopted
on December 9, 1987, an Initial Study was conducted and it was
determined that the proposed project would not have a significant
effect on the environment, and a Negative Declaration was pre-
pared.
7. That the laws and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in the
California Environmental Quality Act and City of Bakersfield
Resolution No. 107--86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and
adopted.
8. That the territory proposed for annexation as
described herein has been determined to be uninhabited pursuant
to the Cortese-Knox Local Government Reorganization Act of 1985,
Section 56046 of the Government Code.
9. That the names of the officers of the City of
Bakersfield who are to be furnished with copies of the Executive
Officer's Report and who are to be given mailed Notice of
Hearing, if any, are:

A parcel of land situated in the County of Kern, State of California, being
tht~se po~:t[,.)ns of Lots 3, 4, 13, ].4, ]6, ]7, 18, ]9, 20, 29 and 130 as shown on
map of the Berkshire Farm Tract as filed Jn the office of tile Kern County
Recorder on August 27, 190], in Section 30 and an additional portion in Section
31, Township 30 South, Ilange 28 East, M.D.B. & M., more particularly described as
follows:
Beginning at: the point of intersection of~ the South line of tile North 30 feet
and the East line of the West 30 feet of Lot 3, of the "l~erkshire Farm Tract".
The said South line also being the South right-of-way line of Panama Lane. The
said point also being on the Corporate Boundary of the City of BakersEield;

through the City Police Department located at the S/W corner of
Truxtun Avenue and Eye Street about 5-1/2 miles north of the
annexaticn.

What effects, if any, would annexation of this territory have on the existing level
of city/district services (i.e., need for additional emergency service personnel or
construction of new facilities, etc.)? The annexation of this territory will not
affect the near term level or capability of the City to provide needed services.
U~on toem of full buildout of this territory, additional police officers will be
added to maintain the City Standard of 1.5 officers per 1000 ~Du].ation. Street
improvements resulting from proposed development will increase the maintenance
responsibility for the City but will not effect existing level of service.
IV.
Would city/district require any upgrading or change in facilities to serve affected
territory (roads, fire hydrants, mains, etc.)? If so, would city/district or residents
be responsible for financing? As development occurs, the developer provi~s and
pays for major facilJLties and didicates them to the City. The proposed Ilosking Road
trunk sewer system through t]~e area will possibly be financed by an assessment district
~ich will encompass the entire annexation area. Developers J~ the area will also
share in the cost of a proposc~] crossing of the Arvin-Edison Canal.
Indicate and explain existing zoning in affected territory. Sut)ject property is
zoned E(5) ~ RS (Estate 5 Acres, ~.~bilel]or~ Combining, Residential Suburban
combining) in the Cot~ty for the south 40 acres. The remaining portien of subject
property is Zoned A IExclusive Agriculture) in the County.

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc. ) Proposed prezoning and amenctment to the Bakersfield Metropolitan

VII.
List city/district ser-vices that area will directly or indirectly benefit from, such as
decrease in fire insurance rate, shorter emergency response time, use of community
facilities, etc. City Police should be able to respond in a more timely matter t,han
present County Sheriff and State Highway Patrol Services. The present City single
family dwelling refugee collection rate of $75.00 13er year is lower than fees County
residents now pay to independent ccmpanies. No special assessment or charqes for
street sweeping, leaf collection, school crossing quards, street liqhtinq enerqy c~)sts
and fire hydrants upon development of subject area.
Please provide the following information relative to city/district and county taxes:
List existing tax rate(s) in area. The existing tax rate (as shown on Kern Cot~ty
1987-88 tax rate schedule) in the area equals 1. 119681%of assesse~ market value.
This represents the total property tax rate. When annexed approximately 30% of the
total property tax of the area will accrue to the City and the remaining to the
County for providing h~are and social services.
Would effected area be subject to any bonded indebtedness of the city/district: If
so, explain. Yes, when annexed, the rate will be increased to 1.124651% of assessod
market value which equals the City bond rate of 0.004970% and the total property tax
rate of 1.119681% as shown on Kern County 1986-87 tax rate schedule.
How will the difference in tax rates affect a house with a market value of $50,000.007
If the house is used as the principal residenee, the $7,000 home owners exemption
leaves $43,000.00 for taxing purposes. The City Bond rate of 0.004970% amounts to
a difference of $2.14 mere per year on a house of this value.
