A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT VI OF PRO-
POSED AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLAN
(LAND USE AMENDMENT 3-87).
WHEREAS, the Council of the City of Bakersfield referred
Segment VI of a proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan to the Planning
Commission; and
WHEREAS, the Planning Commission of the City of
Bakersfield, in accordance with the provisions of Section 65351
of the Government Code, held a public hearing on September 17,
1987, on Segment V]Z of a proposed amendment to the Land Use
Element of the General Plan, notice of the time and place of
hearing having been given at least ten (10) calendar days before
said hearing by publication in the Bakersfield Californian, a
local newspaper of general circulation; and
WHEREAS, ~uch Segment VI of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan is as follows:
SEGMENT VI
The CITY OF BAKERSFIELD requests an amend-
ment to the Bakersfield Metropolitan Area
General Plan on a portion of the project
area from Kern County General Plan desig-
nation of 5.4 (maximum 4 units net acre)
on 87.13 +/- acres to City Low Density
Residential. Concurrent Zoning Upon
Annexation request is a change from County
A (Exclusive Agriculture) on 111.23 +/-
acres and County E(5) MHR-S (Estate 5 Acres
Mobilehome Combining) on 29.32 +/- acres to
City R-1 (One Family Dwelling) Zone on
property located north of Hosking Avenue,
easterly of South "H" Street, south of
Panama Lane, and westerly of South Union
Avenue, as. shown on attached map.
and
WHEREAS, for the above-described Segment, an Initial
Study was conducted and it was determined that the proposed pro-
ject would not haw~ a significant effect on the environment, and
a Negative Declaration was prepared; and
WHEREAS, 'the law and regulations relating to the prepar-
ation and adoption of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution 107-86 have been duly followed
by the City staff and the Planning Commission;
WHEREAS, by Resolution No. 49-87 on September 17, 1987,
the Planning Commission recommended approval and adoption of
Segment VI by this Council and this Council has fully considered
the findings made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted and held a public hearing on December 2, 1987,
on the above-described Segment VI of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan, notice of time and place of the hearing having been given
an least ten (10)calendar days before the hearing by publication
in the Bakersfield Californian, a local newspaper of general
circulation; and
NOW, THEREFORE, BE IT RESOLVED and found by the Council
of the City of Bakersfield as follows:
1. The ai0ove recitals and findings, incorporated
herein, are true and correct.
2. The Negative Declaration for Segment VI is hereby
approved and adopted.
3. The r,~port of the Planning Commission, including
maps and all reports and papers relevant thereto, transmitted by
the Secretary of tlne Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The City Council hereby approves and adopts Segment
VI of the proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan, with incorporation
therein of the following conditions of approval:
A portion of the site is south of the limits of
streets shown on the Circulation Element of the
General Plan. The Circulation Element shall be
amended to include the following streets and corre-
sponding designations as reflected in the proposed
2010 General Plan:
South "H" Street (Panama Lane to McKee Road) Major
Arterial; South Union Avenue (Panama Lane to McKee Road)
Major Arterial; Monitor Street (Panama Lane to McKee Road)
Major Collector; Berkshire Road (Renfro Road to Weedpatch
Highway) Major Collector; Hosking Avenue (Renfro Road to
Weedpatch Highway) Major Arterial.
Upon development or subdivision and prior to issuance
of a b~ilding permit or recordation of a tract or
parcel map, each developer or subdivider shall pay
his proportionate share of the costs for extension of
Monito~ Street across the Arvin-Edison Canal.
Any development or subdivision within this GPA shall
be connected to the municipal sewer system. The pro-
perty owners shall participate in any Assessment
District and/or Planned Sewer Area proceedings to
provide sewer service to development within this area
and the Berkshire numbers 1 and 2 annexations
(adjacent to and west of this GPA area).
There is an existing high voltage pole line on the
south ~ide of Panama Lane. Upon development or sub-
division of the property adjacent to Panama Lane, the
developer or subdivider shall relocate the pole line
at his expense. To maintain safety clearances for
the pole line, no buildings or structures are allowed
within 25 feet of the relocated pole line. That area
shall be labeled "RESTRICTED DEVELOPMENT AREA,
CONTACT YOUR LOCAL PG&E LAND DEPARTMENT FOR APPROVED
USES."
Prior to issuance of a building permit or recordation
of a tract or parcel map, the developer or subdivider
shall !pay his share of costs involved in traffic sig-
nal construction at the following intersections:
a) Monitor Street and Hosking Avenue
b) ~onitor Street and Berkshire Road
5. That Segment VI, approved herein,
other approved segments, described in separate
form a single Land Use Element Amendment, 3-87.
