HomeMy WebLinkAboutRES NO 223-87RESOLUTION NO. 223-87 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD MAKING FINDINGS, APPROVING NEGATIVE DECLARATION AND APPROVING SEGMENT IV OF PRO- POSED AMENDMENT TO THE LAND USE ELEMENT OF THE BAKERSFIELD METROPOLITAN AREA GENERAL PLAN (LAND USE AMENDMENT 3-87). WHEREAS, the Council of the City of Bakersfield referred Segment IV of a proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan to the Planning Commission; and WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65351 of the Government Code, held a public hearing on September 17, 1987, on Segment IV of a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least ten (10) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment IV of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan is as follows:. SEGMENT IV: GRACECO has requested to amend the Land Use Element of the Bakersfield Metropolitan Area General Plan from High Density Residential designation to Commercial for a retail commer- cial shopping center on 2.29 acres located generally at the northwest corner of Oswell and Bernard Streets. WHEREAS, for the above described Segment, an Initial Study was conducted[ and it was determined that, with one mitiga- tion measure incorporated in the project and the conditions of development imposedl hereinbelow, the proposed project would not have a significant effect on the environment, and a Negative Declaration was prepared; and WHEREAS, such one mitigation measure incorporated in the project is as follows: and Upon final grading of the commercial property, a 6-foot (six) high continuous masonry wall shall be constructed on the southwest and western edges of the property (adjacent to condominiums and church); WHEREAS, the law and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield Resolution No. 107-86 have been duly fol- lowed by the City staff and the Planning Commission; and WHEREAS, by Resolution No. 46-87 on September 17, 1987, the Planning Commission recommended approval and adoption of Segment IV, subject to conditions, by this Council and this Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the condition of approval requiring a P.C.D. (Planned Commercial_ Development) Zone over the site provides for development of a commercial center in harmony with the character of the surrounding neighborhood and community; and WHEREAS, the Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on December 2, 1987, on the above-described Segment IV of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan, notice of time and place of the hearing having been given an least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for Segment IV is hereby approved and adopted. 3. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. - 2 - 4. The City Council hereby approves and adopts Segment IV of the proposed amendment to the Land Use Element of the Bakersfield Metropolitan Area General Plan subject to the follow- ing conditions of approval: so Following approval of GPA 3-87, Segment IV, the project site shall be subject to an approved PCD (Planned Commercial Development) Zone. Future development of the site shall be subject to site review policies, ordinance and dew~lopment standards. The project shall provide adequate parking spaces for vehicles, bicycles and deliveries. One parking space per 250 gross square feet of building shall be provided. Because of the anticipated additional traffic which will be generated by development on this site, the applicant shall provide a traffic impact analysis by a qualified traffic engineering firm. This study shall determine the increased volumes due to this project and evaluate its impact on levels of service with recommended mitigation measures so that the level of service shall not result below level C. The study shall also explore the possibility of shared access from the East Hills Mall entrance. If agreement is reached with East Hills Mall, access to Oswell Street shall be restricted to a "service" type drive or "exit only" type drive with parking layout revised accordingly. This analysis shall be submitted to and approved the Traffic Authority prior to submittal of any development plans or submittals for site plan review. by 5. That Segment IV, approved herein, be combined with other approved segments, described in separate resolutions, to form a single Land Use Element Amendment, 3-87. .......... o0o ..........
