HomeMy WebLinkAboutRES NO 220-87RESOLUTION NO. 220-87 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CALLING THE NOMINATING MUNICIPAL ELECTION FOR THE OFFICE OF MAYOR AND A SPECIAL MUNICIPAL ELECTION FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF THE CITY AMENDMENTS TO THE CHARTER OF THE CITY OF BAKERSFIELD, AND PROVIDING FOR THE CONSOLI- DATION OF SAID MUNICIPAL ELECTIONS WITH THE STATE OF CALIFORNIA DIRECT PRIMARY ELECTION TO BE HELD ON JUNE 7, 1988. WHEREAS, pursuant to Section 20(j) of the Charter of the City of Bakersfield, the Nominating Municipal Election for the Office of Mayor of the City of Bakersfield for the full term of four (4) years shall be held concurrently with the State of California Direct Primary Election, to be held June 7, 1988; and WHEREAS, pursuant to petition signed by a sufficient num- ber of registered electors of the City, and in accordance with applicable law, the Council is to call a Special MunJ. cipal Charter Amendment Election for the purpose of submitting to the electors of the City a proposed amendment to the Charter of the City of Bakersfield; and WHEREAS, the Charter amendment so proposed to be submit- ted is as follows: MEASURE #A" A. Section 3 of the Charter of the City of Bakers- field is amended as follows: WARD DIVISIONS The City of Bakersfield shall be divided into eight political subdivisions which shall be known as wards and shall be established by ordinance and altered from time to time to reflect as nearly as possible equal population. The e~stin~ Council, consisting of seven council- persons and a M__a~or, shall, !~ conformance with existing law and pursuant to section 11.1 of this Charter, alter e__x!~tin~ ward boundaries i__n order to create an eighth ward. Thereafter a special election pursuant to existing law shall be held in the newly created eighth ward to elect a councilperson for the eighth ward, whose term thereafter shall coincide with terms for councilpersons elected in November~ 1987, and pursuant to sectien 15 of this Charter. Section 14 of the Charter of the City of Bakersfield is amended as follows: The legislative powers of the City, except as reserved to the people by this Charter, shall be vested in a Council consisting of eight councilpersons and a Mayor, said councilpersons to be elected one from each of the eight wards of the City by electors thereof, and said Mayor elected from the City at large. Section 20 of the Charter of the City of Bakersfield is amended as follows: MAYOR AND VICE-MAYOR (a) [unchanged] (b) The Mayor shall be the official head of the City for all legislative policy and ceremonial purposes, shall promote the City of Bakersfield, and shall execute all legal instruments and documents, and shall preside at all meetings of the Council. The Mayor shall not be vested with administrative authority. (c) The Mayor shall be a full-time position and the Mayor s~all devote such time as may be necessary to properly and efficiently discharge the duties of the office, office, and in no event less than 40 hours per week. The Mayor shall receive an annual salary of forty-two thousand dollars ($42,000.00), payable in equal monthly installments, except as hereinafter pro- vided, and shall be adjusted annually in reference ~9 the Consumer Price Index. At the beginning of each fiscal year, the Council, exclusive of the Mayor, shall appropriate a sum of money, but not less than twelve thousand dollars ($12,000.00), for general promotion of the c__it_~ End for reception and entertainment of publi~- guests. (d) A furnished office at City Hall and a vehicle appropriate to the office shall be provided for the Mayor for the conduct of his official duties. - 2 - (e) A full-time secretary with a furnished office at City Hal~ shall be provided by the City to the Mayor for the conduct of the office duties of the Mayor. An aide with a furnished office at City Hall. shall b__e provided by the City to the Mayor. Such aide shall not be a civil service position, shall be selected ~y the Mayor and shall serve a~t the will of the Mayor. The compensation for such aide shall be established by ordi- nance of the City Council and shall be modified from time to time as the Council shall deem appropriate. (f) through (m) [unchanged] Section 33.3 of the Charter of the City of Bakers- field is amended aa follows: REVENUE BONDS Revenue bonds may be authorized by the Council of the City of Bakersfield by resolution of six affirmative votes of the Council; [balance of section unchanged] Section 37.5 of the Charter of the City of Bakers- field is amended as follows: REMOVAL OF CITY MANAGER The City Manager may be removed from office by the affirmative votes of five members of the council; [balance of section unchanged] - 3 - 2. That a Special Municipal Election is hereby called to be held in the City of Bakersfield on Tuesday, the 7th day of June, 1988, for the purpose of submitting to the electors of said City of Bakersfield the hereinbefore specified amendment to the City Charter. 3. That the above-stated Measure "A" to amend the Charter of the City of Bakersfield is hereby submitted for place- ment on the ballot in proper form to be used at said election. 4. That the elections hereby called are also hereby con- solidated with each other and with the State of California Direct Primary Election, each scheduled to be held on Tuesday, June 7, 1988. 5. That the County Clerk is requested to conduct the elections and is requested to provide within the territory affected by this order of consolidation the election precincts, polling places, and voting booths, which shall, in every case, be the same and there shall be only one set of election officers in each of the precincts for the elections hereby called and that the candidates for the Office of Mayor in said Nominating Municipal Election and the amendment to the Charter of the City of Bakers- field to be voted upon in said Special Election be set forth in each ballot to be used at said elections insofar as the same is held within said territory affected by said order of consolidation. 6. That the County Clerk is further requested to procure and furnish to the election officers the necessary printed ballots and send to each voter affected by the elections a voter's pam- phlet, together with the sample ballot and polling place notice and provide for absent voters' applications and absentee voting for such elections. 7. The County Clerk is hereby further authorized and requested to canvass the returns of said elections with respect to the votes cast in said territory affected by the consolidation herein and to certify such canvass of the votes so cast to this Council. 8. The City Clerk is hereby authorized and directed to certify to the adoption of this resolution and to transmit a copy thereof to the County Clerk of Kern County and to the Board of Supervisors of the County of Kern. 9. That the polls shall be open in all precincts in the City from 7:00 A.M. to 8:00 P.M. - 5 - 10. That the City Clerk shall give all notices and per- form all advertising as required by law and/or cause to be per- formed all the duties and functions required. .......... o0o ..........
