AN ORDINANCE AMENDING SUBSECTION F
OF SECTION 3.20.090 OF THE BAKERSFIELD
MUNICIPAL CODE RELATING TO
PERFORMANCE BONDS.
WHEREAS, in certain instances where the City itself is performing a public works
project and buying materials therefore the requirement of obtaining performance bonds
adds unnecessary costs to the City's projects; and
WHEREAS, the City Council wishes to clarify the times in which performance bonds
will be used.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as
follows:
SECTION I.
Subsection F of Section 3.20.090 of the Bakersfield Municipal Code is hereby
amended to read as follows:
3.20.090 Formal Contract Procedures.
F. Performance Bond. Except for the erection of any public building or
works, or in furnishing any supplies, equipment and materials for same, to be performed
by City's own work forces, the City shall require a faithful performance bond in an amount
equal to 100% of the contract price issued by an insurer admitted to transact the class of
surety insurance in the State of California.
SECTION 2.
This Ordinance shall be posted in accordance with the Bakersfield Municipal Code
and shall become effective thirty (30) days from and after the date of its passage.
