A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD INITIATING PROCEEDINGS FOR TEE
ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD
IDENTIFIED AS PROCEEDING NO. 939, ANNEXATION NO.
313, IN ACCORDANCE WITH LAFCO RESOLUTION MAKING
DETERMINATION (BERKSHIRE NO. 1).
WHEREAS, a proposal was submitted to the Local Agency
Formation Commission of Kern County ("Commission") for the annex-
ation of territory to the City of Bakersfield designated as
Annexation No. 313 (Berkshire No. 1); and
WHEREAS, a duly noticed public hearing upon said pro-
posal was held before the Commission on the 13th day of October,
1987; and
WHEREAS, following said public hearing the Commission,
on October 13, 1987, adopted its Resolution Making Determination,
being Resolution No. 87-33, recorded in Minute Book 34 of said
Commission.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield as follows:
1. Preliminary proceedings for annexation of territory
to the City of Bakersfield designated as Annexation No. 313
(Berkshire No. 1) were authorized by the City Council of the City
of Bakersfield by action at a regular meeting thereof held on
May 30, 1987; App].ication for Annexation dated May 30, 1987, was
transmitted to LAFCO; the Certificate of Filing of the Executive
Officer of the Conmission shows that the proposal was filed by him
on the 20th day of August, 1987.
2. The distinctive short form designation assigned by
the Commission to the territory proposed to be annexed is: "City
of Bakersfield Annexation No. 313 (Berkshire No. 1)."
3. The description of the exterior boundaries of the
territory proposed to be annexed is contained in Exhibit "A",
attached hereto, and incorporated in this Resolution as though
fully set forth herein.
4. The territory proposed to be annexed is uninhabited
as determined by the Commission in its Resolution Making
Determination.
5. The reasons for the proposed annexation as set forth
in the proposal thereof submitted to the Commission are that the
owners of the affected territory desire to receive tax revenues
for benefits given and to be given to the territory proposed to
be annexed.
6. BE lit FURTHER RESOLVED, that Wednesday, the 18th day
of November, 1987, at the hour of 7 p.m. (or as soon thereafter as
the matter may be heard) in the Council Chambers of the City Hall,
1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as
the time, date and place of hearing on the proposed annexation
where any owner of land within, or any registered voter residing
within, the said described territory may appear before the Council
of the City of Bakersfield and show cause why such territory
should not be annexed. Any owner of land within, or any regis-
tered voter residing within, the described territory may file a
written protest against the annexation with the City Clerk of the
City of Bakersfield at 1501 Truxtun Avenue at any time prior to
the conclusion of the hearing on the proposed annexation.
7. That the City of Bakersfield, as lead agency, has
completed an environmental assessment and a Negative Declaration
was adopted by the Planning Commission after a public hearing
thereon and this Council hereby approves and adopts the Negative
Declaration. The project will not have a significant effect on
the environment.
8. The land and improvements within the territory to be
annexed shall be liable for the general indebtedness of the City
existing at the time of annexation.
9. A certified copy of the Resolution shall forthwith
be transmitted to the Executive Director of LAFCO.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on October 21, 1987 , by

EXHIBIT A
ANNEXATION NO. 313
BERKSHIRE NO. 1
A parcel of land situated in the County of Kern, State of California, being a
portion of Section 25, Township 30 South, Range 27 East and Section 30, Township
30 South, Range 28 East, M.D.B.&M., more particularly described as follows:
Beginning at a point at the Northeast corner of the South 165 feet
of Lot 6 of the "Berkshire Farm Tract" as filed in the Office of the
Kern County Recorder on August 27, 1901. The said point being on the
North right of way of the Arvin-Edison Intake Canal and also being on
the Corporate Boundary of the City of Bakersfield;
Thence (1) S 0°35'36" W, along the East line of Lots 6, 11, 22, and 27 of
said "Berkshire Farm Tract", a distance of 3499.84 + feet to the North line
of the right of way line of Hosking Avenue. The sa~d North llne also being
the North line of the Bouth 30 feet of said Section 30;
Thence (2) N 89°30'34" W, along the North right of way line of Hosking
Avenue a distance of 2127.52 feet to the West line of said Section 30.
The West line also being the centerline of South H Street;
Thence (3) N 89°11'30" W, along the North right of way line of Hosking
Avenue, a distance of 854.55'. The North right of way line also being the
North line of the South 30 feet of Section 25, T. 30 S., R. 27 E.,
M.D.B.&M.;
Thence (4) N 81°00'07" W, a distance of 334.88 feet;
Thence (5) N 85°25'54" W, a distance of 243.39 feet;
Thence (6) N 83°47'07" W, a distance of 121.23 feet to a point on the
East right of Way line of State Highway 99 (State Route VI-KER-4-C) as
shown on State Highway Map No. 7-1, filed in Book 1, Page 100 in the
Office of the Kern County Surveyor;
Thence (7) N 11°31' W, along said right of way line, a distance of
2536.25 feet to the centerline of Berkshire Road;
Thence (8) continuing N 11°31' W, along said right of way line, a distance
of 1350.93 feet to the North right of way line of the Arvin-Edison Intake
Canal, and also on the Corporate Boundary of the City of Bakersfield;
Thence (9) East and North along the various courses of the said
Corporate Boundary f,% the True Point'of Beginning.
Containing 581.05 acres of land, more or less
