HomeMy WebLinkAboutRES NO 189-87RESOLUTION NO. 189-87 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD FINDING THAT LITTER ON PROPERTY AT 2900 PARKWAY, BAKERSFIELD, CONSTITUTES A NUISANCE AND ORDERING BUILDING DIRECTOR TO PROCEED WITH ABATE- MENT. WHEREAS, in accordance with the requirements of Chapter 8.29 of the Bakersfield Municipal Code, the Building Director on September 9, 1987, gave to the owner of real property located at 2900 Parkway, Bakersfield, Notice to Clean Premises of litter or to show cause before this Council this date why such accumulation of litter should not be found to constitute a public nuisance and the same ordered abated; and WHEREAS, the Notice to Clean Premises specified that failure of the owner to abate any nuisance found by this Council to exist would result in the City abating the nuisance and the costs thereof being assessed against and becoming a tax lien on the premises; and WHEREAS, 'the nuisance has not been abated within the time specified in the Notice to Clean Premises or prior to the date of this hearing; and WHEREAS, the Building Director has reported to the Council as to conditions on the premises located at 2900 Parkway, Bakersfield, and the owner of such premises has been afforded an opportunity to show cause why a nuisance should not be found to exist thereon and ordered abated. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The recitals set forth above are true and correct; and 2. The notice requirements of Section 8.29.110 of the Hakersfield Municipal Code have been duly met; and 3. A public nuisance is found to exist on property located at 2900 Parkway, Bakersfield, by the accumulation of ter on such premises; and lit- 4. The Building Director is ordered to proceed with the work abating such nuisance pursuant to the provisions of Chapter 8.29 of the Bakersfield Municipal Code. .......... o0o .......... D: Winston I4eal Rust NOTICE IS HEREBY GIVEN, under the provisions of Chapter 8.29 of the Bakersfield Municipal Code that litter upon property owned by you at 2900 Parkway - Bakersfield and/or on the abutting half of the street, sidewalk space and/or alley, in the City of Bakersfield is a public nuisance. YOU ARE HEREBY NOTIFIED that said public nuisance is required to be abated within seven (7) days frc~ the date of this notice or appeal this notice to the City Council. If not abated by removal or appealed to the City Council on or before such time, the City of Bakersfield will abate the public nui- sance or cause the same to be abated, in which case the costs thereof will be assessed against: the land and become a tax lien thereon as provided in Chapter 8.29 of the Bakersfield Municipal Code and will be collected on the tax roll upon which property taxes are collected. IF YOU APPEAL TO ~{E CITY COUNCIL FROM THIS NOTICE, you are directed to appear before the City Council of said City at its meeting on Wednesday , the 23rd day of September , 19 87 , at seven o'clock P.M., in the Council Chambers of the City Hall at 1501 Truxtun Avenue, Bakersfield, California, and show cause, if any you have, why said nuisance should not be found to exist and the same ordered abated as provided in said Chapter.
