A RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD APPROVING AMENDMENT TO
SITE PLAN REVIEW POLICY REQUIRING ALL
NONRESIDENTIAL DEVELOPMENTS TO PAY AN ASSESSMENT
TO BE APPLIED TOWARD THE COST OF IMPROVEMENTS
BENEFITING THE ENTIRE COMMUNITY.
WHEREAS, 'the Planning Commission by its Resolution No.
7-85 heretofore approved a site plan review policy requiring all
nonresidential dew~lopments to pay an assessment to be applied
toward the cost of improvements benefiting the entire community,
approved by the Council by its Resolution No. 21-85; and
WHEREAS, upon recommendation of the Public Works Manager
of the City, the Planning Commission determined that the site plan
review policy set forth in its Resolution No. 21-85 should be
amended to provide that whenever a developer is required, as a
condition of project approval, to construct or to pay the cost, or
a portion of the cost, of constructing one or more of the commu-
nity improvements identified in Exhibit "A" of said Resolution,
the reasonable cost: to construct such improvements or costs paid
to the City therefor shall be credited against the assessment oth-
erwise due under said Resolution; and
WHEREAS, by its Resolution No. 39-87 the Planning
Commission adopted the amendment to the Site Plan Review Policy
set forth below; and
WHEREAS, an environmental assessment was made on this
proposed amendment to such site plan review policy and a Negative
Declaration therefor was advertised and posted. -
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The foregoing ~ecitals are true and correct.
2. The Negative Declaration prepared for this policy is
hereby approved and adopted;
3. The Council hereby approves the following amendment
to Site Plan Review Policy adopted by Planning Commission
Resolution No. 39-87: whenever a developer is required, as a
condition of project approval, to construct or to pay the cost, or
a portion of the cost, of construction one or more of the commu-
nity improvements identified in Exhibit "A", as originally adopted
and as amended, the reasonable cost of constructing such improve-
ments or costs paid to City therefor shall be credited against the
fee otherwise due under said Resolution.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on September 23, 1987 , by
