A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
APPROVING THE FILING OF AN APPLICATION FOR GRANT FUNDS
FROM THE COMMUNITY PARKLAND ACT OF 1986 FOR IRRIGATION
AND LANDSCAPING ALONG THE KERN RIVER PARKWAY ADJACENT TO
TRUXTUN AVENUE.
WHEREAS, the people of the State of California have enacted the
Community Parkland Act of 1986 which provides funds to the State of California
and its political subdivisions for acquiring lands and developing facilities
for public recreational purposes; and
WHEREAS, the State Department of Parks and Recreation has been
delegated the responsibility for the administration of programs under said
Act setting up necessary procedures governing application by local agencies
under the program; and
WHEREAS, said procedures established by the State Department
of Parks and Recreation require the applicant to certify by resolution the
approval of an application to the State; and
WHEREAS, said application contains assurances that the applicant
must comply with; and
WHEREAS,
applicant will comply with all federal, state,
public health, relocation, affirmative action,
requirements and all other appropriate codes,
to the expenditure of the grant funds; and
said application contain a certification that the

WHEREAS, the applicant agency will enter into an agreement with
the State of California for development of the project.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby:
1. Approves; the filing of an application for 1986 State Grant
assistance for the above project.
2. Certifies that said agency has or will have sufficient funds
to operate and maintain the project funded under these programs; and
3. Certifies that said agency understands the assurances and
certifications in the application; and
4. Certifies that said agency will complete the project within
three (3) years from date of approval by the State; and
5. Appoints the City Manager as agent of the City of Bakersfield
to conduct all negotiations, execute and submit all documents including but
not limited to applications, agreements, amendments, payment requests, and
so on which may be necessary for the completion of the aforementioned
projects; and
6. Appoints the City Attorney as legal counsel of the City of
Bakersfield for purposes hereof.
