A RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 316
(BUENA VISTA NO. 3 ANNEXATION).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 56800 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that it hereby finds and determines as
follows:
1. That the City of Bakersfield proposes the annexation
to the City of Bakersfield of the territory described in Exhibit
"A", attached hereto and made a part of this resolution as though
fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a Plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 56653 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985, and it is requested that
proceedings be authorized for annexation in accordance therewith.
5. That the reasons for the proposed change of organi-
zation are that the owners and/or residents of the affected
territory desire to receive municipal services from the City of
Bakersfield, and the City desires to receive tax revenues for
benefits given and to be given to the territory proposed to be
annexed.
6. That for this proposed annexation and the zoning
upon annexation therefor, the ordinance for which was adopted
this date, an Initial Study was conducted and it was determined
that the proposed project would not have a significant effect on
the environment, and a Negative Declaration was prepared.
7. That the laws and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in the
California Environmental Quality Act and City of Bakersfield
Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and
adopted.
8. That the territory proposed for annexation as
described herein has been determined to be uninhabited pursuant
to the Cortese-Knox Local Government Reorganization Act of 1985,
Section 56046 of the Government Code.
9. That the names of the officers of the City of
Bakersfield who are to be furnished with copies of the Executive
Officer's Report and who are to be given mailed Notice of
Hearing, if any, are:

BUENA VISTA NO. 3
A parcel of land situated in the County of Kern, State of California,
being a portion of Sectsion 13 of Township 30 South, Range 26 East, and
Section 18 of Township 30 South, Range 27 East, M.D.B.&M. more partic-
ularly described as follows:
Beginning at the intersection of the East line of Section
18, and the North right-of-way line of the Southern Pacific
Railroad, Buttonwillow Branch, said intersection being
northerly along last named East line, a distance of 82.5
feet, more or less, fr~n the Southeast corner of said Section
18, said point also being a point on the existing Corporate
Boundary of the the City of Bakersfield;
Thence (1) departing said Corporate Boundary Westerly along
said North right-of-way line, said line being parallel with
and 50 feet northerly of as measured at right angles to the
center line of main rails, to intersect the west line of the
East 30 feet of Section 13, a distance of 5442 feet, more or
less;
Thence (2) Northerly along last named West line to intersect.
the South line of the North 30 feet of Section 13, a distance
of 5150 feet, more or less, said point being a point on the
exterior Corporate Boundary;
Thence (3) Easterly along said South line and along the
South line of the North 30 feet of Section 18, to inter-
sect the East line of the West 30 feet of Section 18, a dis-
tance of 60 feet, said South line being on the exterior
Corporate Boundary of the City of Bakersfield;
Thence (4) departing said Corporate Boundary Southerly along
last named EAST lirm to intesect the South line of the North
1038 feet of Section 18, a distance of 1008 feet, more or
less, said point being a point on the exterior Corporate
Boundary.
Thence (5) Southerly and Easterly along various courses of

maintenance, sweeping and lighting).

Area to be served by Treatment Plant No. 3 by way of
the Stockdale Sewer Trunkline. A proposed extension
of the Buena Vista Trunkline will be continued
Southerly along Buena Vista Road.
- The area will be served by City of Bakersfield Ashe Water
Division.
Other (REFUSE) - City will provide service either by City forces
dispatched from blain Corporation Yard or by
contracted franchise service.
Service Level Capacity

24 llour patrol is provided. First priority response
time is approximately 7 minutes or less.

There will be no reduction in the range or capacity
of the City to provide the necessary Public Works
services to this area. Services will be on a regulal
basis and "as needed".

What effects, if any, would annexation of this territory have on the existing level
of city/district services (i.e., need for additional emergency service personnel or
construction of new facilities, etc.)? The annexation of this territory will not
effect the near term level or capability of the City to provide needed services.
Approximately 4.8 additional Police Officers will be needed at scheduled buildout
to maintain City standard for Police protection. Ultimate street improvements
resulting from proposed development will increase the maintenance responsibility for
the City, but will not effect existing level of services.
IV.
Would city/district require any upgrading or change in facilities to serve affected
territory (roads, fire hydrants, mains, etc.)? If so, would city/district or' residents
be responsible for financing? As development occurs, the deveioper provides and
pays for major facilities and dedicates them to the City. A portion of the annexation
area falls within the boundary of Assessment District No. 82-1 (Stockdale Sewer
Trunkline) whereby development of property within said district will result in adjustments
of the assessments levied on such lands in accordance with the requirements of the
district. The remainder of the area falls within the "Benefit Area" of the Stockdale
Sewer Trunkline whereby a capacity charge is paid at the time of development.

Indicate and explain existing zoning in affected territory. The entire ~roperties are
zoned A (Exclusive A~riculturei in the County. The EasterIv 73.93 acre portion of
the territory (in the east half of Section 18, T30S., R27E., ~LD.H.] is under
a~ricultural preserve contract under the Williamson Conservation Act.

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc.} Proposed prezonin~ and amendment to the Bakersfield Hetropolit~n
area Eeneral olan will be as follows: 5.31 acres at the Northwest corner of the
territory to be zoned R-2 (limited multiule - family dwellingS: the remainin~ 221.17
acres of territory lvin~ in the west half of said section 18 to be zoned R-1
(one family dwellinE); the Easterly 73.93 acres as described above (see Section
to be zoned A-20A (AEricultural twenty-acre minimum lot sizel remaininz consistant
with contracted aEriculture preserve. The Eeneral impact will be a chanEe from
existinE aEricultural use to City low density residential use.
VII.
List city/district ser¥ice~ .nat area will directly or indire~ .y benefit from, such as
decrease in fire insurance rate, shorter emergency response time, use of community
facilities, etc. City Police should be able to respond in a more timely matter than
present County Sheriff and State Highway Patrol services. The present City single
famzly dwelling refuse collection rate of $7S.00 per year is lower than fees county
residents now pay to independant companies. No special assessment or charges for
street sweeping, leaf collection, school crossing guards, street lighting energy
costs and fire hydrants upon development of subject area.
Please provide the following information relative to city/district and county taxes:
List existing tax rate(s) in area. The existing tax rate in the area equals 1.01S701%
of assessed market value as taken ±rom Kern County 1986-87 tax rate schedule. This
represents the total property tax rate. When annexed approximately 30% of the total
property tax o~ the area will accrue to the City and the remaining to the County for
provzd~ng health care and social servzces.
Would effected area be subject to any bonded indebtedness of the city/district: If
so, explain. Yes, when annexed, the rate will be increased to 1.021206% of assessed
market value which equals the City bond rate of 0.00550S% and the total pronertv
tax rate of 1.015701%. As shown on Kern County 1986-87 Tax Rate Schedule. - .
How will the difference in tax rates affect a house with a market value of $50,000.00?
If the house is used as the principal residence, the $7000. home owners exemption
leaves $43,000 for taxin~ purposes. The City Bond rate of 0.005S05% amounts to
a difference of $2.37 more per year on a house of this vah~e.
