A RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 315
(BERKSHIRE NO. 2 ANNEXATION).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 56800 of the Government Code of the State of California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Bakersfield that it hereby finds and determines as
follows:
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolu-
tion as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a Plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 56653 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Cortese-Knox Local
Government Reorganization Act of 1985, and it is requested that
proceedings be authorized for annexation in accordance therewith.
5. That the reasons for the proposed change of organi-
zation are that the owners and residents of the affected terri-
tory desire to receive municipal services from the City of
Bakersfield, and the City desires to receive taK revenues for
benefits given and to be given to the territory proposed to be
annexed.
6. That for this proposed annexation and the zoning
upon annexation therefor, the ordinance for which was adopted
this date, an Initial Study was conducted and it was determined
that the proposed project would not have a significant effect on
the environment, and a Negative Declaration was prepared.
7. That the laws and regulations relating to the prepa-
ration and adoption of Negative Declarations as set forth in the
California Environmental Quality Act and City of Bakersfield
Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and
adopted.
8. That the territory proposed for annexation as
described herein has been determined to be uninhabited pursuant
to the Cortese-Knox Local Government Reorganization Act of 1985,
Section 56046 of the Government Code.
9. That the names of the officers of the City of
Bakersfield who are to be furnished with copies of the Executive
Officer's Report and who are to be given mailed Notice of
Hearing~ if any, are:

ANNEXATION NO. 315
A parcel of land situated in the County of Kern, State of California, being a
portion of Sections 30 and 31, Township 30 South, Range 28 East, M.D.B.&M., more
particularly described as follows:
Beginning at the point of intersection of the North right of way line
of the Arvin-Edison Intake Canal as described in Parcel 1C-3 of that
certain Order of Condemnation recorded in Book 3972, Page 201 of
Official Records in the Office of the Kern County Recorder and the
East line of Lot 5, of the "Berkshire Farm Tract" as filed in the
Office of the Kern County Recorder on August 27, 1901. The said
point being on the Corporate Boundary of the City of Bakersfield,
said point being the True Point of Beginning;
THENCE (1) departing from the existing Corporate Boundary Southerly
along the East line of Lots 5, 12, 21, and 28 of said "Berkshire Farm
Tract" and Southerly prolongation thereof, a distance of 4150.97 +
feet to the South line of the North 30 feet of Section 31. The said
South line also being the South right of way line of Hosking Avenue.
THENCE (2) Westerly along the said South right of way line of Hosking
Avenue, a distance of 654.77 + feet to the Southerly prolongation of
the West line of Lot 128 of sa~d "Berkshire Farm Tract."
T~ENCE (3) Northerly .along the West line of Lots 5, 12, 21, 28, and
the Southerly prolongation of Lot 28, a distance of 4159.84 ~ feet to
a point on the North line of the South 165 feet of Lot 5. Said point
being a point on the existing Corporate Boundary and also being on
the North right of way line of the Arvin-Edison Intake Canal.
THENCE (4) Easterly along the various courses of the said Corporate
Boundary to the True Point of Beginning.
Containing 63.00 acres of land, more or less.

Police - Ail police services in the City of Bakersfield are admini-
stered through the City Police Department located at the S/W
corner of Truxtun Avenue and Eye Street about 5-1/2 miles
north of the annexation.
Fire- Station 52 (County) is within t-1/2 miles at South Union and
Barton Street.
Parks and Recreation - P!anz Park is within 3 miles northerly of
the area. Upon development of residential
areas, neighborhood parks will be provided
in accordance with City policy.

The City Corporation Yard on Truxtun
Avenue west of Freeway 99 will provide
necessary facilities, personnel and
services to accommodate Public Works
efforts. Maintenance and personnel
will be dispatched from the City Yard
on a regular basis for preventative
maintenance as needed. Repair
includes streets, constructed/main-
tenance, sweeping & lighting.
- Sewer services will become available in Hosking Avenue upon
completion of the Hosking Avenue Trunk Sewer Project which
will tie into Treatment Plant No. 3.
Water - This area to be served by Greenfield County Water District.
Other (REFUSE)
- Upon development, service will be provided by the
City, possibly by contracts with a franchise
collector.
Service Level Capacity

24 hour patrol is provided in the immediate vicinity
'approximately 7.00 minutes or less.
Fire protection is provided on a 24-hour basis with
response time of 5 minutes or less. The annexation
will not affect City Fire service capability.

What effects, if any, would annexation of this territory have on the existing level
of city/district services (i.e., need for additional emergency service personnel or
construction of new facilities, etc.)? The annexation o£ this territory will not
affect the near term level or capability of the City to provide needed services.
Upon time of full buildout of this territory, additional police officers will be
added to maintain the City Standard of 1.5 officers per 1000 population. Street
improvements resulting from proposed development will increase the maintenance
responsibility for the City but will not effect existing level of service.
IV.
Would city/district require any upgrading or change in facilities to serve affected
territory (roads, fire hydrants, mains, etc.)? If so, would city/district or residents
be responsible for financing.~ As development occurs, the developer provi~-~s and
pays for major facilities and dedicates them tO the City. The proposed Hosking Road
trunk sewer system through the area will possibly be financed by an assessment d~strzct
which will encompass the entire annexation area. Developers in the area wzll also
share in the cost of a proposed crossing of the Arvin-Edison Canal.
Indicate and explain existing zoning in affected territory. Subiect oroperty is
zoned A {Exclusive AEriculture) in the County for that portion ]yin~ north of
Berkshire Road. The remainins portion of subject pronertv south of Berkshire Road
is zoned E (1/4), PD (Estate - 1/4 acre, precise development combining) in the county,

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc.) Proposed prezoning and amendment to the Bakersfield ~,letropolitan
Area General Plan will consist of City R-1 (Single Family Dwelling) Zone over the
entire subject property. The impact in general will be a change from existing
agriculture land use to city low density residential use as subject area is now primarily
used for agricultural production.
VII. List city/district services that area will directly or indirectly benefit from, such as
decrease in fire insurance rate, shorter emergency response time, use of community
facilities, etc. City Police should be able to respond in a more timely matter than
present County Sheriff and State Highway Patrol Services. The present City single
family dwelling refuse collection rate of $75.00 per year is lower than fees County
residents now pay to independent companies. No special assessment or charges for
street sweeping, leaf collection, school crossing guards, street lighting energy costs
and fire hydrants upon development of subject area. --
VIII. Please provide the following information relative to city/district and county taxes:
List existing tax rate(s) in area. The existing tax rate (as shown on Kern County
A. 1986-1987 tax rate schedule~ in the area equals 1.075609% of assessed market value.
This represents the total property tax rate. When annexed approxzmately 30~ o~ the
total property tax of the area will accrue to the City and the remaining to the County
for providing health care and social services.
Would effected area be subject to any bonded indebtedness of the city/district: If
so, explain. Yes, when annexed, the rate will be increased to 1.0811t~% of assessed
market value which equals the City bond rate of 0.005505% and the total property tax
rate of 1.075609% as shown on Kern County 1986-1987 tax rate schedule.
How will the difference in tax rates affect a house with a market value of $50,000.00?
If the house is used as the principal residence, the $7000.00 home owners exemption
leaves $43,000.00 for taxin~ purposes. The City Bond rate of 0.005505% amounts to
a difference of $2.37 more per year on a house of this value.
