A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT VI OF PRO-
POSED AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLAN
(LAND USE AMENDMENT 2-87).
WHEREAS, the Council of the City of Bakersfield referred
Segment VI of a proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan to the Planning
Commission; and
WHEREAS, the Planning Commission of the City of
Bakersfield, in accordance with the provisions of Section 65351
of the Government Code~ held a public hearing on June 18, 1987,
on Segment VI of a proposed amendment to the Land Use Element of
the General Plan, notice of the time and place of hearing having
been given at least ten (10) calendar days before said hearing by
publication in the Bakersfield Californian, a local newspaper of
general circulation; and
WHEREAS, such Segment VI of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan is as follows:
SEGMENT VI
The CITY OF BAKERSFIELD has applied to
amend the Bakersfield Metropolitan Area
General Plan on a portion of the project
area from Kern County General Plan desig-
nation of 5.4 (maximum 4 units net acre)
on 40 +/- acres to City Low Density
Residential. Concurrent Zoning Upon
Annexation request is a change from County
A (Exclusive Agriculture) on 19.60 +/-
acres and County E-¼ (Estate ~ acre) on
40 +/- acres to City R-1 (One Family
Dwelling) Zone on property located north
of Hosking Road, easterly of South "H"
Street and south of the Arvin-Edison Canal;
and
WHEREAS, for the above-described Segment, an Initial
Study was conducted. and it was determined that, with mitigation
measures incorporated as conditions in the project and accepted
by the property owner, the proposed project would not have a sig-
nificant effect on the environment, and a Negative Declaration
was prepared; and
WHEREAS, the law and regulations relating to the prepar-
ation and adoption of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution 107-86 have been duly followed
by the City staff and the Planning Commission;
WHEREAS, by Resolution No. 26-87 on June 18, 1987, the
Planning Commission recommended approval and adoption of
Segment VI by this Council and this Council has fully considered
the findings made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted and[ held a public hearing on August 19, 1987,
on the above-described Segment VI of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan, notice of time and place of the hearing having been given
an least ten (10) calendar days before the hearing by publication
in the Bakersfield Californian, a local newspaper of general
circulation; and
NOW, THEREFORE, BE IT RESOLVED and found by the Council
of the City of Bakersfield as follows:
1. The above recitals and findings, incorporated
herein, are true and correct.
2. The Negative Declaration for Segment VI is hereby
approved and adopted.
3. The report of the Planning Commission, including
maps and all reports and papers relevant thereto, transmitted by
the Secretary of the Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The City Council hereby approves and adopts Segment
VI of the proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan, with incorporation
therein of the following conditions of development:
Hosking Avenue and Berkshire Road shall be offered
for dedication.

The east 45' of the site shall be offered for dedi-
cation as half of a major collector (Monitor Street
alignment) as shown on the Circulation Element of
the General Plan.
The intersections of Monitor Street and Berkshire
Road and Monitor Street and Hosking Avenue will
require additional dedication for expanded intersec-
tions.
Any development or subdivision within the General
Plan Amendment shall be connected to the municipal
sewer system. The property owners shall participate
in any Assessment District and/or planned sewer area
proceedings to provide sewer service to development
within this area and the Berkshire #1 annexation
(adjacent to and west of this General Plan Amendment
area).
Required dedications or offers of dedication shall
be submitted within 90 days of completion of the
annexation proceedings. All dedications shall
include the quitclaim or subordination of rights to
the City by all interest and easement holders having
the right to place facilities or otherwise obstruct
and free use of the right-of-way. Where major
facilities exist, a common use agreement may be
allowed when determined appropriate by the City
Engineer.
The property owner or developer shall pay his share
of the proposed crossing of the Arvin-Edison Canal.
Payment shall be required prior to recordation of
any subdivision map within the segment area.
An overall drainage study shall be provided by the
owner. A Planning Drainage Area shall be estab-
lished and incorporate the area in General Plan
Amendment 1-87, Segment VI. Designated drainage
basin sties shall be dedicated to the City within
the same time period.
At the time of development or subdivision, the deve-
loper or subdivider shall pay his share of costs
involved in traffic signal construction at the fol-
lowing intersections:
1. Monitor Street and Hosking Avenue
2. Monitor Street and Berkshire Road
Payment shall be made to the City at the rate of
$500 per gross acre.
5. That Segment VI, approved herein, be combined with
other approved segments, described in separate resolutions, to
form a single Land Use Element Amendment, 2-87.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on August 19, 1987 , by
the following vote:
