A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD
FINDING THERE ARE NO UNMET PUBLIC TRANSPORTATION NEEDS
WHICH COULD BE REASONABLY MET.
WHEREAS, the Transportation Development Act of 1971 provides for the
disbursement of funds form the Local Transportation Fund held in trust by the
Kern County Auditor-Controller for use by eligible claimants for the purpose
authorized by Article 8 Section 994000(a), Streets and Roads, and Article 4,
Section 99260(a), Public Transportation, of said Act; and
WHEREAS, an eligible claimant wishing to receive an allocation from
the Local Transportation Fund must receive written and oral testimony regarding
transit needs and, after considering the evidence presented at the meeting, and
transit needs and, after considering the evidence presented at the meeting, and
its own knowledge of public transportation needs within the City of Bakersfield,
must find that transit needs are being met; and
WHEREAS, a duly noticed public hearing was held before the City
Council of the City of Bakersfield, wherein written and oral testimony regarding
transit needs were received; and
WHEREAS, the City Council considered the evidence presented at the
public hearing, along with its knowledge of public transportation needs within
the City of Bakersfield; and
WHEREAS, funds from the Local Transportation Fund will be required to
maintain the street and road system.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAKERSFIELD HEREBY
FINDS AND DECLARES AS FOLLOWS:
1. There are no unmet public transportation needs which could be rea-
sonably met by expansion of existing transportation systems or by establishing
new systems.
2. That a copy of this resolution be transmitted to the Kern County
Council of Governments in conjunction with the filing of the claim; and the Kern
County Council of Governments be requested to concur in these findings and grant
the allocation of funds as specified in the Article 8 claim.

I MEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
the 15th day of July, 1987, by the following vote:
