RESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD MAKING FINDINGS AND
CERTIFYING THE FINAL ENVIRONMENTAL IMPACT
REPORT (EIR) FOR PROPOSED WASTEWATER
TREATMENT PLANT NO. 3 IMPROVEMENTS.
WHEREAS, it is proposed to expand the City of
Bakersfield Wastewater Treatment Plant No. 3 facilities from 8
million gallons per day (MGD) capacity to 16 MGD capacity in two,
four MGD increments;
and
WHEREAS, a Draft EIR on this proposal was prepared by
the City of Bakersfield under contract with a consultant, circu-
lated and distributed in accordance with the requirements of law
and applicable regulations;
and
WHEREAS, public and private agencies and individuals
submitted written comments on the DEIR as listed in the comments
and responses;
and
WHEREAS, a duly noticed public hearing was held and con-
ducted by and before the City of Bakersfield Planning Commission
in accordance with procedures required by City Resolution No.
107-86, on June 18, 1987 at which hearing the public was entitled
to comment on the DEIR;
and
WHEREAS, the consultant had responded in writing to all
significant points raised by the public and private agencies and
individuals in the review and public hearing process in the Final
EIR, consisting of a revised DEIR and comments and responses
dated July, 1987.
and
WHEREAS, the consultant has responded in writing to all
significant points raised by the Planning Commission and public
and private agencies and individuals in the review and public
hearing process
and
WHEREAS, the Final E.I.R., consisting of a revised Draft
E.I.R. text and Comments and Responses dated July, 1987, were
reviewed, evaluated and considered by the Planning Commission,
and that Commission found that the Final E.I.R. has been com-
pleted in compliance with the California Environmental Quality
Act, the State E.I.R. Guidelines and City of Bakersfield
Resolution No. 107-86;
and

WHEREAS, the City of Bakersfield Planning Commission
found that significant environmental effects identified in the
Final E.I.R. with the exception of the removal of farmland from
agricultural production have been eliminated or substantially
lessened and recommended certification of the Final E.I.R.;
and
WHEREAS, the loss of agricultural land as a secondary
impact is unmitigatable and a statement of overriding considera-
tions would be required to approve the project;
and
WHEREAS, the City Council has considered the Final
E.I.R., and has reviewed the record of proceedings before and
findings of the Planning Commission with respect thereto;
and
WHEREAS, the Final E.I.R. is an accurate and objective
discussion of the proposed project and adequately discusses and
describes the environmental considerations and mitigation
measures;
and
WHEREAS, the various alternatives to the project,
including "no project", have been considered in the Final E.I.R.;
and
WHEREAS, the total of all mitigation measures identified
in the Final E.I.R. is sufficient to minimize environmental
impacts which can be mitigated;
and
and
WHEREAS, the period for public review has been adequate;
WHEREAS, the Final E.I.R., adequately addresses all
issues raised during the public review period, any mitigation
measures required must be incorporated into the project to avoid
or substantially lessen the significant environmental effects
identified;
and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The above recitals are true and correct; and
The Final E.I.R. has been completed in compliance
with CEQA, the State E.I.R. Guidelines and the City
of Bakersfield Resolution No. 107-86, including fin-
dings a through d on Page 2 of the revised Staff Report
(July 1, 1987); and
3. The Final E.I.R., is hereby certified as adequate.

I HEREBY CERTIt that the foregoing Resolu. 3n was passed and
adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 1st day of July , 1987 by the
following vote:
