RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BAKERSFIELD
RESOLUTION AND CERTIFICATE OF FINDINGS
OF FACT FOR THE CONSIDERATION OF A
CONVENIENCE ZONE EXEMPTION FROM THE
REQUIREMENT OF THE STATE LAW IN
ACCORDANCE WITH THE CALIFORNIA BEVERAGE
CONTAINER RECYCLING AND LITTER REDUC-
TION ACT (AB 2020) REQUESTED BY
BAKERSFIELD ASSOCIATION FOR RETARDED
CITIZENS, INC. (BARC) TO EXEMPT SIX
CONVENIENCE ZONE NUMBERS 386, 405, 406,
407, 409 AND 424.
WHEREAS, the City of Bakersfield has provided public notice
of the City Council's intent to request an exemption from the
convenience zone requirements of the California Beverage
Container Recycling and Litter Reduction Act for the Bakersfield
Association for Retarded Citizens, Inc.
WHEREAS, on June 24, 1987, a public hearing was held and tes-
timony was received regarding public support to the proposed
action, and
WHEREAS, the City Council has evaluated and identified alter-
native recycling locations available to the consumer to conven-
iently return beverage containers for the redemption value and
redemption bonus, and
WHEREAS, the City Council has reviewed the exemption cri-
teria, completed the exemption request form, and listened to and
responded to all public testimony regarding the exemption propo-
sal, and

WHEREAS, the City Council has determined that, if granted,
the proposed exemption to convenience zones 386, 405, 406, 407,
409 and 424 will not significantly decrease the ability of con-
sumers to return beverage containers for the redemption value and
any applicable redemption bonus, and
WHEREAS, the City of Bakersfield has responded to all of the
requirements of the state regulations governing exemption of con-
venience zones, and
THEREFORE, BE IT RESOLVED that the City Council authorizes
the Development Services Department to submit the exemption
request to the Chief of the Division of Recycling, State of
California.
I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on June 24, 1987 , by
