A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD, ESTABLISHING UNDERGROUND
UTILITY DISTRICT NO. 2, DIVISION 14 (ON "H"
STREET BETWEEN TRUXTUN AVENUE AND 14TH
STREET).
WHEREAS, by Rosolution of Intention No. 1024 adopted on
May 6, 1987, a public hearing was called for June 3, 1987, at the
hour of 7:00 P.M., in the Council Chambers in the City Hall, 1501
Truxtun Avenue, Bakersfield, California, and continued to June
17, 1987, same time and place, to ascertain whether the public
necessity, health, ~afety or general welfare requires the removal
of poles, overhead wires and associated overhead structures and
underground installation of wires and facilities for supplying
olectric, communication, cable television or similar and associ-
ated services, with that certain area, more particularly described
as follows:
UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 14
That the area in the City of Bakersfield, State of
California, more particularly described as follows:
Beginning at the intersection of the westerly line
of "H" Street with the centerline of Truxtun Avenue;
1)
Thenco easterly along said centerline of Truxtun
Avenuo to a point within the easterly line of
"H" Street;
2) Thenco southerly along said easterly line of "H"
Street to a point within the centerline of 14th
Street;
3)
Thence westerly along said centerline of 14th
Street to a point within the westerly line of "H"
Street;
4) Thenco northerly along said westerly line of "H"
Street to the Point of Beginning.
Notice of such hearing has been given to all affected
property owners as such are shown on the last equalized assessment
roll and to all utilities concerned in the manner and with the
time required by law; and

NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield that, pursuant to Chapter 12.32 of Title 12 of the
Municipal Code of the City of Bakersfield, the above described
area is hereby declared an underground utility district and is
designated as Underground Utility District No. 2, Division 14, of
the City of Bakersfield. Attached hereto, marked Exhibit "A", and
hereby incorporated as a part of this Resolution, is a map or dia-
gram entitled as follows: UNDERGROUND UTILITY DISTRICT NO. 2,
DIVISION 14, delineating the boundaries of said District.
BE IT FURTHER RESOLVED that the electric utility which
undertakes underground installation of its facilities shall use
the underground conversion allocation computed to decisions of the
Public Utilities Commission of the State of California for the
purpose of providing to each premises in Underground Utility
District No. 2, Division 14, requiring it a maximum cf one hundred
feed of individual electric service trenching and conductor, as
well as backfill, paving and and conduit. Each property owner in
Underground Utility District No. 2, Division 14, shall be respon-
sible for the installation and maintenance of the conduit and ter-
m--~nation box locate~ on, under or within any structure on the
premises served.
BE IT FURTHER RESOLVED that the Council does hereby fix
December 31, 1987, as the date on which all affected utilities must
have all facilities installed, and have completed removal of all
poles, overhead wi~es and associated overhead structures and the
underground installation of wires and facilities for supplying
electric, communication, cable television or similar or associated
services within Underground Utility District No. 2, Division 14.
BE IT FURTHER RESOLVED that the City Clerk is hereby
instructed to notify all affected utilities and all persons owning
real property within Underground Utility District No. 2, Division
14, of the adoption of this Resolution within ten (10) days after
the date of such adoption. Said City Clerk shall further notify
said property owners of the necessity that, if they or any person
occupying such property desire to continue to receive electric,
communication, cable television, or other similar or associated
service, they or such occupant shall, but the date fixed on this

Resolution, providE! all necessary facility changes on their prem-
ises so as to receive service from the lines of the supplying
rules, regulations and tariffs of the respective utility or utili-
ties on file with the Public Utilities Commission of the State of
California.
Such notification shall be made by mailing a copy of this
Resolution, together with a copy of Chapter 12.32 of the Municipal
Code of the City of Bakersfield, to all affected property owners
as such are shown on the last equalized assessment roll and to the
affected utilities.
BE IT FURTHER RESOLVED that the Council hereby finds and
determines as follows:
1. That the public necessity, health, safety or general
welfare requires the removal and undergrounding of poles, overhead
wires and associated overhead structures within Underground
Utility District No. 2, Division 14.
2. The Underground Utility District herein created is in
the general public interest for the reason that the streets, roads
or rights-of-way in the District are extensively used by the gen-
eral public and carry a heavy volume of pedestrian and vehicular
traffic.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on June 17, 1987 , by
the following vote:
