HomeMy WebLinkAboutRES NO 90-87RESOLUTION NO. 90-87 A RESOLUTION OF APPLICATION OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS FOR ANNEXATION OF TERRITORY TO THE CITY OF BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 314 (OLIVE DRIVE NO. 1 ANNEXATION). WHEREAS, ~:he City of Bakersfield desires to propose a change of organization, to wit, the annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 56800 of the Government Code of the State of California. NOW, THEREFORE, BE City of Bakersfield that it follows: IT RESOLVED by the Council of the hereby finds and determines as 1. That the City of Bakersfield hereby proposes the annexation to the City of Bakersfield of the territory described in Exhibit "A", attached hereto and made a part of this resolu- tion as though fully set forth herein. 2. That a map of the territory proposed to be so annexed, marked Exhibit "B", is attached hereto and made a of this Resolution as though fully set forth herein. part 3. That a Plan for providing services within the affected territory of the proposed annexation, in accordance with the provisions of Section 56653 of the Government Code, is marked as Exhibit "C", attached hereto and made a part hereof as though fully set forth herein. 4. That this proposal for change of organization, to wit, annexation, is made pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, and it is requested that proceedings be authorized for annexation in accordance therewith. 5. That the reasons for the proposed change of organi- zation are that the owners and residents of the affected terri- tory desire to receive municipal services from the City of Bakersfield, and the City desires to receive tax revenues for benefits given and to be given to the territory proposed to be annexed. 6. That for this proposed annexation and the zoning upon annexation, therefor, the ordinance for which was adopted this date, an Initial Study was conducted and it was determined that the proposed projects would not have a significant effect on the environment, and a Negative Declaration was prepared. 7. That the laws and regulations relating to the prepa- ration and adoption of Negative Declarations as set forth in the California Environmental Quality Act and City of Bakersfield Resolution No. 107-86 have been duly followed and the Negative Declaration for this proposed annexation is hereby approved and adopted. 8. That the territory proposed for annexation as described herein has been determined to be uninhabited pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Section 56046 of the Government Code. 9. Location Indicate location from which service will be provided (i.e. nearest fire station, library, etc. ) Police - All police services in the City of Bakersfield are adminis- tered through the City Police Department located at tile s/w corder of Truxtun Avenue and Eye Street about 5~2 miles southeast of the anne xat ion. Fire- Station 6t (County) located at tile southeast corner of Norris Road and Fruitvale is within,I/2 mile of the north annexation boundary. Parks and Recreation- Upon development of this area, the open space elemeat of the adopted Bakersfield bletropolitan Area General Plan provides a minimum of 2.5 acres of park space per 1000 popula- tion. Library _ N/A Streets- The City Corporation Yard on Truxtun Avenue west of Fwy. 99 will provide necessary facilities, Construction/Maintenance personnel and services to accomodate Public Works efforts. Maintenance & Sweeping personnel will be dispatched from the City Yard on a regular basis for pre- Lighting ventative maintenance as needed. Re- pair includes streets, constructed/ maintenance, sweeping & lighting. Sewer- Sewer service is available at the intersection of Fruitvale Ave. and Hageman Road. The Hageman Road Trunk Line is part of the nearly completed Buena Vista Trunk Sewer System. Water - This area is served by the California Water Service Co. Other (Refuse) Present refuse collection is provided by a franchise refuse collector. ~mn annexed, service will be provided by the City with a portion of the service by contracts with the same collector if at all possible. Service Level Capacity Indicate frequency and availability of service (I.e. street sweeping, response time for emergenc¥ services, rec. pro[llrams, etc.) 24 hour patrol is provided in the i~mnediate vicinity of this annexation. First priority response is approximately 7.00 minutes or less. Fire protection is provided on a 24-hour basis with response time of 5 minutes less. The anne-' tioe will not affect City Fire service capabili,. A]i City parks are open to the public at reasonahlt hours. There will be no reduction in the rauge capacity of the City to provide tile necessary public works services to this area. Services will be on a re,ilar basis and "as needed". Upon completion o£ Buena Vista Trm~k System adequat capacity will exist. Adequate capacity exists. City refuse pickup twice a week. I11. What effects, if any, would annexation of this territory have on the existing level of city/district services (i.e., need for additional emergency service personnel or construction of new facilities, etc.)? IV. Would city/district require any upgrading or change in facilities to serve affected territory (roads, fire hydrants, mains, etc.)? If so, would city/district or residents be responsible for financing? As deveiopment occurs the deveioper provided'and pays for major facilities and dedicates them to the City. The required trLmk sewer system through the area is to be financed by an assessment district which will encompass almost the entire annexation area. Indicate and explain existing zoning in affected territory. Subject: property is zoned according to the Rosedale Community General Plan as Estate Residential on the northerly $0~ acres and low density residential on the remainin~ portion of the property. The County Zoning presently is "A" (Exclusive A~riculture) VI. Indicate and explain proposed prezoning in area. (List effects on present land use that would occur as a result of annexation such as maintenance of livestock on property, etc.) Proposed prezoning and amendment to the Bakersfield Metropolitan Area General Plan will consist of City R-1CH (One Family Dwelling-Church) Zone of 17.2 Acres at the southeast corner of Olive Drive and Fruitvale Avenue and City R-I (One Family Dwelling) Zone of the remainder of the subject property. The most significant effect of prezoning will be allowance of approximately one more average unit per acre. VII. List city/district services that area will directly or indirectly benefit from, such as decrease in fire insurance rate, shorter emergency response time, use of community facilities, etc. City Pol±ce should be able to respond in a more timely manner than present County Sheriff and State Highway Patrol services. The present City refuse collection rate of $54.00 per year is substantially lower than fees county'residents now pay to independant companies. No special assessment or charges for street sweeping, leaf collection, school crossing guards, street lighting energy costs and fire hydrants upon development of subject area. VIII. Please provide the following information relative to city/district and county taxes: List existing tax rate(s) in area. The existing tax rate in the area equals A. 1.0IS701% of assessed market value. This represents the total property tax rate. When annexed approximately 30% of the total property tax of the area will accrue to the City and the remaining to the County for Drovidin~ health care and social services. ' Would effected area be subject to any bonded indebtedness of the city/district: so, explain. Yes, when annexed, the rate will be increased to 1.021206% of assessed market value waich equals the City bond rate of 0.005505% and the total property tax rate of 1.015701%. If C. How will the difference in tax rates affect a house with a market value of $50,000.007 If the house is used as the pr±ncipal residence, the $7,000. home o~ers exemption leaves $43,000 for taxing pu~oses. The City bond rate of 0.005505% amounts to a difference of 32.37 more per year on a house of this value.
