A RESOLUTION OF APPLICATION OF THE COUNCIL OF
THE CITY OF BAKERSFIELD PROPOSING PROCEEDINGS
FOR ANNEXATION OF TERRITORY TO THE CITY OF
BAKERSFIELD IDENTIFIED AS ANNEXATION NO. 313
(BERKSHIRE NO. 1 ANNEXATION).
WHEREAS, the City of Bakersfield desires to propose a
change of organization, to wit, the annexation to the City of
Bakersfield of the hereinafter-described territory, pursuant to
Section 56800 of the Government Code of the State of California.
NOW, THEREFORE, BE

follows:
IT RESOLVED by the Council of the
hereby finds and determines as
1. That the City of Bakersfield hereby proposes the
annexation to the City of Bakersfield of the territory described
in Exhibit "A", attached hereto and made a part of this resolu-
tion as though fully set forth herein.
2. That a map of the territory proposed to be so
annexed, marked Exhibit "B", is attached hereto and made a part
of this Resolution as though fully set forth herein.
3. That a Plan for providing services within the
affected territory of the proposed annexation, in accordance with
the provisions of Section 56653 of the Government Code, is marked
as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
4. That this proposal for change of organization, to
wit, annexation, is made pursuant to the Cortese-Knox Local
Government Reorganization Act of ~985, and it is requested that
proceedings be authorized for annexation in accordance therewith.
5. That the reasons for the proposed change of organi-
zation are that the owners and residents of the affected terri-
tory desire to receive municipal services from the City of
Bakersfield, and the City desires to receive tax revenues for
benefits given and to be given to the territory proposed to be
annexed.
6. That for this proposed annexation and the zoning
upon annexation, therefor, the ordinance for which was adopted
this date, an Initial Study was conducted and it was determined
that the proposed ]projects would not have a significant effect on
the environment, and a Negative Declaration was prepared.
7. That the laws and regulations relating to the prepa-
ration and adoptio~l of Negative Declarations as set forth in the
California Environmental Quality Act and City of Bakersfield
Resolution No. 107-86 have been duly followed and the Negative
Declaration for this proposed annexation is hereby approved and
adopted.
8. That the territory proposed for annexation as
described herein has been determined to be uninhabited pursuant
to the Cortese-Knox Local Government Reorganization Act of 1985,
Section 56046 of the Government Code.
9. That the names of the officers of the City of
Bakersfield who are to be furnished with copies of the Executive
Officer's Report a~d who are to be given mailed Notice of
Hearing, if any, are:

ANNEXATION NO. 313
BERKSHIRE NO. 1
A parcel of land situated in the County of Kern, State of California, being a
portion of Section 25, Township 30 South, Range 27 East and Section 30, Township
30 South, Range 28 East, M.D.B.&M., more particularly described as follows:
Beginning at a point at the Northeast corner of the South 165 feet
of Lot 6 of the "Berkshire Farm Tract" as filed in the Office of the
Kern County Recorder on August 27, 1901. The said point being on the
North right of way of the Arvin-Edison Intake Canal and also being on
the Corporate Boundary of the City of Bakersfield;
Thence (1) S 0°35'36" W, along the East line of Lots 6, 11, 22, and 27 of
said "Berkshire Farm Tract", a distance of 3499.84 + feet to the North line
of the right of way line of Hosking Avenue. The sa~d North line also being
the North line of the South 30 feet of said Section 30;
Thence (2) N 89°30'34" W, along the North right of way line of Hosking
Avenue a distance of 2127.52 feet to the West line of said Section 30.
The West line also being the centerline of South H Street;
Thence (3) N 89°11'30" W, along the North right of way line of Hosking
Avenue, a distance of 854.55'. The North right of way line also being the
North line of the South 30 feet of Section 25, T. 30 S., R. 27 E.,
M.D.B.&M.;
Thence (4) N 81°00'07" W, a distance of 334.88 feet;
Thence (5) N 85°25'54" W, a distance of 243.39 feet;
Thence (6) N 83°47'07" W, a distance of 121.23 feet to a point on the
East right of way line of State Highway 99 (State Route VI-KER-4-C) as
shown on State Highway Map No. 7-1, filed in Book 1, Page 100 in the
Office of the Kern County Surveyor;
Thence (7) N 11°31' W, along said right of way line, a distance of
2536.25 feet to the centerline of Berkshire Road;
Thence (8) continuing N 11°31' W, along said right of way line, a distance
of 1350.93 feet to the North right of way line of the Arvin-Edison Intake
Canal, and also on the Corporate Boundary of the City of Bakersfield;
Thence (9) East and North along the various courses of the said
Corporate Boundary to the True Point of Beginning.

tion.
Fire_ Station 52 (County) is within 1~ miles at South Union and
Barton Street.
Parks and Recreation - Upon development of residential areas, tile
open space element of the adopted Bakersfield Metropolitan area
general plan provides a minimum of 2.5 acres of park space per
1000 population.
Library - N/A
Streets - The City Corporation Yard on Truxtun Avenue west of Fwy. 99
will provide necessary facilities, personnel and services to

Other (Refuse) - Present refuse collection is provided by a franchise
refuse collector. ~en annexed, service will be provided by the
City with a portion of the service by contracts with the same
collector if at all possible.
Indicate frequency and availability of service
(i.e. street sweeping, response time for
emerqency services, rec. programs, etc.)
24 hour patrol is provided in tile immediate
vicinity of this annexation. First priority
response is approximately 7.00 minutes or less.
Fire protection is provided on a 24-hour basis
with response time of S minutes or less. The
annexation will nat affect City Fire service
capability.
All City parks are open to the public at reasonable
hours.

What effects, if any, would annexation of this territory have on the existing level
of city/district services (i.e., need for additional emergency service personnel or
construction of new facilities, etc.)? The annexation of this territory will not
affect the near term level or capability of the City to provide needed services.
Upon time o± ~ul] buildout of this territory, additional police officers will
be added.

Would city/district require any upgrading or change in facilities to serve affected
territory (roads, fire hydrants, mains, etc.)? If so, would city/district o._~r residents
be responsible for financing? As development occurs the developer provides and
pays for major facilities and dedicates them to the City. The required trunk
sewer system through the area ~s to be ±~nanced by an assessment district which
w±l~ encompass almost the' entzre annexation area.
Indicate and explain existing zoning in affected territory. Subject ~rocertv
is zoned A (Exclusive Agriculture), A-1 (Limited A~riculture), MP (Mobilehome Park).

Indicate and explain proposed prezoning in area. (List effects on present land
use that would occur as a result of annexation such as maintenance of livestock
on property, etc.) Proposed prezoning and amendment to the Bakersfield Metropolitan
Area General Plan will consist of City R-1 [SinF. le Family Dwellin,.~) Zone over th~
majority of the subject property and City M-1 (Limited Industrial') gone on 42.7
acres at the northeast corner of Berkshire Rd. and So. "H" St. The impact in
general will be a change from existing agriculture land use to city low density
res~dentlal use.

List city/district services ~nat area wiH directly or indire / benefit from, such as
decrease in fire insurance rate, shorter emergency response time, use of community
facilities, etc. City Police should be able to respond in a more timely matter than
present County Sherriff and State Highway Patrol services. The present City refuse
collection rate o± ~b4.00 per year ~s substantially lower than fees county residents
now pay to independant companies. No special assessment or charges for street
sweepzng, lea± collection, school crossing guards, street lighting energy costs
and ±zre hydrants upon development of subject area.

List existing tax rate(s) in area. The existing tax rate in the area equals
1.075609% of assessed market value. thzs represents the total property tax rate.
~en annexed approximately 30% of the total property tax of the area will accrue
to the City and the remaining to the County for providing health care and social
services.
Would effected area be subject to any bonded indebtedness of the city/district: If
so, explain. Yes, when annexed, the rate will be increased to 1.081114% of assessed
market value which equals the City bond rate of 0.005505% and the total property
tax rate of t.07S609%.
How will the difference in tax rates affect a house with a market value of $50,000.00?
If the house is used as the principal residence, the $7000. home owners exemption
leaves ~4~,UUU tor taxing purposes. 't~e ~ty Bond rate oi 0.005505% amounts to
