A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO SPECIAL ASSESSMENT AND ASSESSMENT
BOND ACTS FOR THE ACQUISITION
OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER
DIVISION 4 OF THE STREETS AND HIGHWAYS CODE
CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 87-2
WHEREAS, all of the owners of more than 60% in area of
the property subject to assessment therefor have signed and filed
with the City Clerk of the City of Bakersfield a written petition
for undertaking proceedings pursuant to special assessment and
assessment bond acts, and to assess the costs thereof upon the
properties benefited by said improvements, and waiving proceed-
ings under Division 4 of the Streets and Highways Code, for the
acquisition of improvements as set forth in Exhibit "A" attached
hereto and by reference incorporated herein; and
WHEREAS, the costs and expenses of said contemplated
improvements are to be chargeable upon an assessment district,
the exterior boundaries of which are the coterminous exterior
boundaries of the composite and consolidated area shown on the
map thereof on file in the office of the City Clerk to which
reference is hereby made for further particulars; and
WHEREAS, the public interest and convenience will be
served by the taking of said proceedings.
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND
ORDERED that all of the owners of more than 60% in area of the
property subject to assessment for said proposed improvements
have filed with the City Clerk of this City a written petition

IT IS FURTHER FOUND, DETERMINED AND ORDERED that said proceed-
ings for the acquisition of said improvements shall be had pursuant to
the Municipal Improvement Act of 1913, the Charter, and the Municipal
Code of the City of Bakersfield, and the bonds upon the unpaid assess-
ments thereof shall be issued pursuant to the Improvement Bond Act of
1915.
IT IS FURTHER FOUND, DETERMINED AND ORDERED that the provi-
sions of Division 4 of the Streets and Highways Code be, and they are
hereby, dispensed with.,

GENERAL DESCRIPTION OF WORK AND ACQUISITIONS
CITY OF BAKERSFIELD ASSESSMENT DISTRICT NO. 87-2 - ACQUISITION OF GATEWAY
INDUSTRIAL PARK PUBLIC IMPROVEMENTS (TENATIVE PARCEL MAP 7744)
The individual Projects comprising the Works of Improvement, hereinafter the
"Improvements", eligible for acquisition pursuant to Assessment District
proceedings for City of Bakersfield Assessment District No. 87-2, hereinafter the
"Assessment District", are described below. The descriptions of the Improvements
and the termini of the work proposed for acquisition do not necessarily extend for
the full length of the description thereof. The plans and profiles of the work to
be acquired shall be controlling as to the correct and detailed description
thereof. The individual Projects comprising the Improvements that are to be
acquired and their locations are:
Sanitary Sewer Pipeline and Lift Station Project including sanitary sewer
pipelines complete with manholes, fittings and property service laterals and a
Lift Station Facility complete with all mechanical and electrical equipment
and controls and also including a 15 inch diameter discharge pipeline
running from said Lift Station Facility to connect with an existing 36 inch
diameter City pipeline in Mount Vernon Avenue, together with all appurtenances
and incidental work necessary to complete the same in the following
locations:
Sanitary Sewer Pipelines to be installed in the following streets proposed
for development pursuant to Tenneco Parcel Map PM 7744 (PM7744) which
includes proposed Gateway Drive, Gateway Court and Enterprise Way, and in
new dedications of rights-of-way for East Belle Terrace from Washington
Street east to Mount Vernon Avenue and in Mount Vernon Avenue from East
Belle Terrace north to proposed Gateway Drive.
The Sanitary Sewer Lift Station is to be installed at the southwest corner
of proposed Parcel 16 of PM7744, with the discharge line running from said
lift station site easterly to connect with an existing City pipeline fn
Mount Vernon Avenue.
Storm Drain Pipeline and Lift Station Project including manholes, fittings,
catch basins with connecting pipelines and a Lift Station Facility complete
with all mechanical and electrical equipment and controls and a discharge
pipeline to connect with existing storm water disposal facilities, together
with all appurtenances and incidental work necessary to complete the same in
the following locations:
Storm Drain Pipelines and Catch Basins installed in the following streets
proposed for development pursuant to PM7744 and including proposed Gateway
Drive from proposed Enterprise Way east to Mount Vernon Avenue, in
proposed Gateway Court north to proposed Gateway Drive, and in new
right-of-way dedications for Mount Vernon Avenue pursuant to PM7744 and
running from East Belle Terrace north to the proposed Storm Water Lift
Station site in proposed PM7744 Parcel 1.

B. The Storm Water L~' Station is to be constructed ~ ~g the east boundary
of proposed Parcel . in PM7744, adjacent to HounU Ve~on Avenue.
Water Distribution System P{peline Project including pipelines, flutings,
valves, fire hydrants, separate 2 inch diameter domestic and 6 inch diameter
fire service laterals for each proposed PM7744 parcel, together with all
appurtenances and incidental work necessary to complete the same in the
following locations:
Water Distribution Pipelines and appurtenances in Washington Street from
Feliz Drive north across Highway 58 to connect to an existing water main
in Brundage Lane; in proposed Gateway Drive, Gateway Court and Enterprise
Way, all said roadways to be developed pursuant to PM7744, and in new
rights-of-way dedications also pursuant to said PM7744 for Mount Vernon
Avenue from proposed Gateway Drive south to East Belle Terrace and in East
Belle Terrace from Mount Vernon Avenue west to Washington Street.
Street Construction and Reconstruction Project including street grading, sub-
grade preparation, asphalt concrete paving, concrete curbs and gutters as
required for construction of proposed Gateway Drive, Gateway Court and
Enterprise Way, all to be developed pursuant to PM7744; the construction of
the north half of East Belle Terrace in new right-of-way to be dedicated
pursuant to said PM7744; the reconstruction of portions of existing Mount
Vernon Avenue and the construction of the west half of said street including
outside lane concrete curb and gutter, median curb, street grading, subgrade
preparation and asphalt concrete paving between East Belle Terrace on the
south and the Highway 58 right-of-way on the north; the construction of the
east half of Washington Street in right-of-way to be dedicated pursuant to
PM7744 from the Highway 58 right-of-way south to East Belle Terrace, and also
including the construction of concrete sidewalks ~1ong the perimeter of said
PM7744 in said rights-of-way to be dedicated for said Washington Street, East
Belle Terrace and Mount Vernon Avenue, together with all appurtenances and
incidental work necessary to complete the same.
Street Safety Lighting Project to include street safety ligkts, controls~
conduits and wires, light poles and bases installed where required along the
east side of Washington Street, the north side of East Belle Terrace, the west
side of Mount Vernon Avenue and along proposed Gateway Drive, Gateway Court
and Enterprise Way, all within proposed PM7744, together with appurtenances
and incidental work necessary to complete same.
The doing of all incidental work and payment of expenses therefor as required
to complete the foregoing work including but not limited to labor and trans-
portation costs incurred by Property Owner, Tenneco Realty Development Corpor-
ation, to purchase and deliver equipment and materials to be installed by
Property Owner's contractors and which equipment and materials shall become a
part of the completed Improvements; interest on funds advanced by Property
Owner for construction of the Improvements; Property Owner's cost for design
of the Improvements, including soils testing and analysis related to design
and construction of the Improvements, consUruction inspection and contract
administration costs; assessment engineering consultant costs incurred by the
Property Owner; all associated district formation administration costs and
expenses as authorized by the Streets and Highways Code of the State of
California.

The acquisition of ea ~nts and rights-of-way, if s other than those
described above or alre~uy held by the City of Bakersf~=zd and required for
the construction and installation of said facilities, together with the
construction and installation 'of all improvements auxiliary to the above and
necessary to complete the same.
