HomeMy WebLinkAboutRES NO 72-87RESOLUTION NO. 72-87 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD REQUESTING KERN COUNTY LOCAL AGENCY FORMATION COMMISSION TO APPROVE REVISION OF CITY'S SPHERE OF INFLUENCE AND THAT SUCH COMMISSION FIND THAT SUCH REQUEST CAN BE CONSIDERED AND STUDIED AS PART OF PERIODIC REVIEW. WHEREAS, a "sphere of influence', means a plan for the probable ultimate physical boundaries and service area of a local governmental agency; and WHEREAS, the Local Agency Formation Commission is required to develop and determine the sphere of influence of each local governmental agency within the county in order to carry out its purposes and responsibilities for planning and shaping the logical and orderly development and coordination of such agencies so as to advantageously provide for the present and future needs of the county and communities; and WHEREAS, if any city desires amendment or revision of an adopted sphere of influence, the City, by resolution of the City Council, may, under Section 56428 of the Government Code, file a request therefor with the executive officer who shall present the same to the Local Agency Formation Commission for approval; and WHEREAS, if such commission finds that the request for amendment or revision of a sphere of influence can be considered and studied as a part of the periodic review of spheres of influ- ence as required by law, such commission may, in its discretion, waive reimbursement of costs; and WHEREAS, the City of Bakersfield desires revision of its adopted sphere of influence under provisions of Government Code Section 56428, to include land within the proposed Olive Drive Annexation and additional lands that couId be annexed and served by the City in the future; and also desires waiver by the Local Agency Formation Commission of reimbursement costs. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Council of the City of Bakersfield as follows: 1. That all the recitals set forth above are true and correct. LAFCO SPHERE QUESTIONN._RE II Page 2 10. Does your agency provide services to any area outside the boundaries of the agency? If so, describe the area(s) and the services? Police and fire service is provided for hack-up assistance and under mutual aid agreements. Water service is provided to approximately 200 service connections in the area west of Freeway 99 and north of Rosedale Highway. Water for domestic use and fire protection is provlded to Fairhaven water service area. Agriculture water is delivered to irrigation districts outside the City primarily on a wholesale hasis. Waste water treatment searvices are for East Niles CSD, Union Avenue and Alta Ve~rde County sanitation districts plus sewer service is p~ovided to 250 users in island areas. Services outside of the existing city limits now receiving services can continue to receive services. Additional services may require expansion of service capacity. Are the services provided by other local agencies within the territory of your agency adequate? If not, describe the nature of any asserted inadequacy. What type of development is now occurring or planned for the territory within your agency including, but not limited to~ residential, commercial and industrial development: Ongoing urban development typically includes various densities and intensities of residential, commercial, office and industrial projects. Related public and semi- public uses such as schools, churches and government buildings are also occurring. Planned to 2010: The City is in the process of updating the Bakersfield Metropolitan Area General Plan~ The 2010 General Plan Update will give guidance to those making decisions affecting the allocation of resources and the future shape and character of the City and will contain seven p~incipal elements. The 2010 General Plan Update will provide planning for future land use, circulation, housing, conservation, open space, noise, and safety. Annexations in progress lnclude: Olive Drive No. 1 (130 acres) southeast of Olive Drive and Fruitvale Avenue; Berkshire No. 1 (350 acres) north of Hosktng Road, south of the Arvin-Edison Canal~ and west of Freeway 99 and South H Street. Annexations planned in the next five years include: Old Stockdale (360 acres) south of Stockdale Highway and west of Ashe Road; Oswell No. 6 (640 acres) north and south of Brundage Lane, east and west of Mt. Vernon Avenue, east and west of Oswell Street; Hosklng No. 1 (1,054 acres) east of Stine Road, north of Taft Highway and south of Arvin Edison Canal; Rosedale No. 3 (715 acres) east of Rancho-Laborde Annexation, west of Gibson Street, and north of Kern River; and Bakersfield Country Club (5007/- acres) east and west of Oswell Street and south of Highway 178. Describe the existing facilities used by your agency in carrying out the functions of the agency. Existing public facilities included fire stations, offices and training facilities, city hall, corporation yard, two wastewater treatment plants~ police statton~ telecommunication office, shop buildtng~ pistol range, nineteen groundwater wells, six million gallons of above ground water storage, a civic auditorium and twenty parks. Describe any new facilities used by your agency in carrying out the functions of the agency. The Fire Department anticipates three additional stations. The Police Department anticipates expansion of its central facility and replacement of the pistol range. Public Works anticipates a Rio Bravo corporation yard substation, expansion of City Hall and expansion of the Wastewater Treatment Plants. Community Services anticipates new water wells and related distribution facilities correlated to growth. Are there agrlcul'tural preserves within the area being considered within the proposed sphere of influence? Yes Can the physlcal ~and econotalc integrity of such preserves be maintained in the event such preserves are lncluded within the sphere of influence of the agensy? Yes. They can be as they have been through the Land LAFCO SPHERE QUESTION~.~RE II Page 4 16. 17. Conservation Act program (Williamson Act). Typically the owners petition to cancel the preserve contracts when urban development is anticipated. Such cancellations are not automatic and must be considered as required by state law. What are the methods of financing your district? (i.e. service charges, etc.) Methods for financing the City include: General Fund revenues made up of sales taxes, property taxes, Motor Vehicle In-Lieu~ transient lodging tax, and business license tax. Other sources include state gas tax~ fees from domestic water~ off street~ parking~ sewer service, refuse service~ assessment districts, state park fundst agricultural watert and auditorium ssles. Special revenue funds include Community Development Block Grant Program, federal aid urban fund, street and road transportation fund, and traffic safety fund.
