A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD MAKING FINDINGS, ADOPTING NEGATIVE
DECLARATION AND APPROVING SEGMENT VI OF PRO-
POSED AMENDMENT TO THE LAND USE ELEMENT OF THE
BAKERSFIELD METROPOLITAN AREA GENERAL PLAN
(LAND USE AMENDMENT 1-87).
WHEREAS, the Council of the City of Bakersfield referred
Segment VI of a proposed amendment to the Land Use Element of
the Bakersfield Metropolitan Area General Plan to the Planning
Commission; and
WHEREAS, the Planning Commission of the City of
Bakersfield, in accordance with the provisions of Section 65351
of the Government Code, held a public hearing on March 19, 7987,
on Segment VI of a proposed amendment to the Land Use Element of
the General Plan, notice of the time and place of hearing having
been given at least ten (10) calendar days before said hearing by
publication in the Bakersfield Californian, a local newspaper of
general circulation; and
WHEREAS, such Segment VI of the proposed amendment to
the Land Use Element of the Bakersfield Metropolitan Area General
Plan is as follows:
Segment VII:
SEQUOIA ENGINEERING requests to amend the
Bakersfield Metropolitan Area General Plan
from Kern County General Plan designation of
5.4 (maximum 4 units net acre) on 197 +/-
acres, 5.5 (minimum 1.25 gross acres/unit) on
50.47 +/- acres and 7.4 (Agricultural
Industrial and Service) on 42.7 acres to City
Lo~ Density Residential on 247.47 +/- acres
and City Industrial designations on 42.7
acres. Concurrent Zoning Upon Annexation
request i~ a change from County A (Exclusiw~
Agriculture) Zone and County A-1 (Limited
Agriculture) Zone to City R-1 (One Family
Dwelling) Zone on 308 +/- acres and M-1 (Light
Manufacturing) Zone on 42.7 acres;
and
WHEREAS, for the above-described Segment, an Initial
Study was conducted, and it was determined that, with mitigation
measures incorporated as conditions in the project and accepted
by the applicant, the proposed project would not have a signifi-
cant effect on the environment, and a Negative Declaration was
prepared; and
WHEREAS, the law and regulations relating to the prepa-
ration and adoptio~ of Negative Declarations as set forth in CEQA
and City of Bakersfield Resolution No. 107-86 have been duly fol-
lowed by the City staff and the Planning Commission; and
WHEREAS, by Resolution No. 6-87 on March 19, 1987, the
Planning Commissio~ recommended approval and adoption of
Segment VI by this Council and this Council has fully considered
the findings made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the Council of the City of Bakersfield, in
accordance with the provisions of Section 65355 of the Government
Code, conducted and held a public hearing on May 6, 1987, on the
above-described Segment VI of the proposed amendment to the Land
Use Element of the Bakersfield Metropolitan Area General Plan,
notice of time and place of the hearing having been given an
least ten (10) calendar days before the hearing by publication in
the Bakersfield C~lifornian, a local newspaper of general circu-
lation.
NOW, THEREFORE, BE IT RESOLVED and found by the Council
of the City of Bakersfield as follows:
1. The above recitals and findings, incorporated
herein, are true and correct.
2. The Negative Declaration for Segment VI is hereby
approved and adopted.
3- The report of the Planning Commission, including
maps and all reports and papers reIevant thereto, transmitted by
the Secretary of the Planning Commission to the City Council, is
hereby received, accepted and approved.
4. The C~ty Council hereby approves and adopts Segment
VI of the proposed amendment to the Land Use Element of the
Bakersfield Metropolitan Area General Plan, with incorporation
therein of the following conditions of development:
Dedicate as South "H" Street right-of-way the east
70' of Section 25. The dedication shall contain a
waiver of direct access rights to South "H" Street.
Modification of this waiver may be considered at
the t~me of subdivision.
The applicant shall offer for dedication, with provim
sions for turn lanes, Berkshire Road to major collec-
tor width and Hosking Avenue to major arterial width.
At the time of development or subdivision, the appli-
cant shall provide sewer service to the site by
extending a line easterly from Stine Road along the
alignment of Hosking Avenue· Subject to adopted City
policy~. assessment district financing may be used for
the trunk line construction.
Required dedications shall be submitted within 90
days of completion of annexation proceedings. All
dedications shall include the quitclaim or subor-
dination of rights to the City by all interest and
easement holders having the right to place facilities
or otherwise obstruct the free use of any road right-
of-~ay~. Where major facilities exist, a common use
agreement may be allowed when determined appropriate
by the City Engineer.
Zoning Upon Annexation for that portion consisting of
50.47 acres located east and south of the industrial
designations shall be R-1 (One Family Dwelling) with
a minimum lot size of 10,000 square feet.
Note:
Noise mitigation measures require~ under the
Noise Element of the Bakersfield Metropolitan
Area General Plan will provide adequate buffer
between industrial uses and residential devel-
opment proposed west of South "H" Street.
Development of the project site may be required to
include a buffer wall to obviate potential safety
hazards between future industrial and residential
~ses.
All esorow instructions may be required to include a
provision specifying all development of the project
site shall include a buffer wall to obviate potential
safety hazards between future industrial and residen-
tial uses.
Approw~l of tentative tract maps may require condi-
tions be included to require development of the pro-
ject site shall include a buffer wall to obviate
potential safety hazards between future ~ndustrial
and residential uses.

The developer/subdivider shall provide an overall
drainage study and initiate proceedings for a Planned
Drainage Area. Designated drainage basin sites shall
be dedicated to the City.
The drainage study shall be submitted to and approved
by the City Engineer within 90 days of completion of
the anr~exation proceedings. Required drainage basin
sites shall be dedicated to the city within the same
time period.
At the time of development or subdivision, the
developer/subdivider shall pay their share of costs
included in traffic signal construction. Developer's/
subdivider's share will be based on $143 per gross
acre up to a maximum contribution of $50,000.
5. That Segment VI, approved herein, be combined with
other approved segments, described in separate resolutions, to
form a single Land Use Element Amendment~ 1-87.

I HEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on May6. 1987 , by
