HomeMy WebLinkAboutRES NO 62-87RESOLUTION NO. 62-87 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD CONFIRMING REPORT OF SUPERINTENDENT OF STREETS AS TO WORK DONE, COSTS OF WORK, AND ASSESSMENT OF COSTS FOR INSTALLATION OF CURB, GUTTER AND CONNECTING PAVING ALONG MESA GRANDE STREET IN FRONT OF PARCEL C, TRACT 2263, AND ORDERING NOTICES OF LIENS DELIVERED TO COUNTY AUDITOR FOR COLLECTION OF LIENS WITH TAXES. WHEREAS, by Resolution No. 153-86 this Council on October 15, 1986, pursuant to the authority of Chapter 27 of Part 3 of Division 7 (Sections 5870, et seq.) of the California Streets and Highways Code hereinafter referred to as the "Code," ordered con- struction within 60 days of improvements (curb, gutter and con- necting paving on Mesa Grande Street in front of Parcel C, Tract 2263, which Resolution directed notice be given and a hearing held as prescribed in the Code to hear and pass upon objections and protests; and WHEREAS, such notice was duly given on October 16, 1986, and such hearing was duly held on October 29, 1986, and, no objec- tions or protests having been made at such hearing, the order to construct was confirmed by the Council by its Resolution No. 157-86; and WHEREAS, construction of such improvements was not com- menced within the 60-day period specified in the Notice to Construct and, thereafter, the Superintendent of Streets proceeded to have such work done and such work has been completed; and WHEREAS, the Superintendent of Streets has filed with the Council his report of work, specifying the work which has been done, the costs of construction, a description of the real prop- erty in front of which the work has been done and the assessment against each lot or parcel of land proposed to be levied to pay the cost thereof; and WHEREAS, notice of construction as required by Section 5881 of the Code has been duly given and, in accordance with such notice and the requirements of Section 5883 of the Code, a hearing has this date been held. NOW, THEREFORE, BE IT RESOLVED by the Council[ of the City of Bakersfield as follows: 1. The recitals set forth above are true and correct. 2. The report of work by the Superintendent of Streets is confirmed, no objections or protests having been raised by any of the property owners liable to be assessed for such construction or by any other interested person. 3- Pursuant to Section 5983 of the Code, this Council orders that, following the procedures set forth in Article 3 of the aforementioned Chapter 27, the resulting notices of liens shall be delivered to the Auditor of the County of Kern who shall enter the amounts thereof on the County assessment book opposite the descriptions of the particular properties and such amounts shall be collected together with all other taxes thereon. .......... 000 .......... Since construction of such improvements had not commenced within sixty (60) days after notice to construct improvements was given, the work was performed by order of the City's Superintendent of Streets and the cost of the same shall be a lien on the prop- erty and will be collected with other taxes on the property. A report has been filed with the City Clerk specifying the work which has been done, the cost of construction, a descrip- tion of the real property in front of which the work has been done and the assessment against each lot or parcel of land proposed to be levied to pay the cost.thereof. A copy of said report is attached hereto as Exhibit "A." · The Council of the City of Bakersfield shall conduct a hearing and will pas~ upon the report together with objections or protests, if any, which may be raised by any property owner liable to be assessed for such construction or other interested persons at 7 p.m., or as soon thereafter as the matter may be heard, on April 22, 1987, at the Council Chambers, City Hall, 1501 Truxtun Aven~e, Bak~£sfield, California. ~u~p~i~tendent of AJS:dr 4:COST REPORT OF WORK (Assessor's Parcel 338-103-14 1. Description of Work: The work performed consisted of sawcutting and removing existing asphalt concrete, grading, constructing 132.28 feet of Type B curb and gutter along Mesa Grande Street, placing and compacting Class II aggregate base, mid placing and compacting asphalt concrete. Cost of Construction: Total Cost of Construction: $3,917 This Parcel's Proportional cost = The quantity of proportional length of curb, gutter and tie-in paving divided by the total length of curb, gutter and tie-in paving, multiplied by the total cost of work performed: 132.28 feet ($3,917) = $2253 230 feet 3. Description of Work: That property described as the Northerly 132.28 feet of Parcel C as shown on Altered Map of Tract 2263 filed October 8, 1962 in Book 13, Page 57 in the Office of Kem~ County Recorder; also described as Kern County Assessor's Parcel 338-103-14. 4. Assessment Agginst Described Property: $2253 ~/Superintendent of Streets; Page 1 of 1 REPORT OF WORK [Assessor's Parcel 338-103-17) 1. Description of Work: The work performed consisted of sawcutting and removing existing asphalt concrete, grading, constructing 97.72 feet of Type B curb and gutter along Mesa Grande Street, placing and compacting Class II aggregate base, m~d placing and compacting asphalt concrete. Cost of Construction: Total Cost of Construction: $3,917 This Parcel's Proportional cost = The quantity of proportional length of curb, gutter and tie-in paving divided by the total length of curb, gutter and tie-in paving, multiplied by the total cost of work performed: 97.72 feet ($3,917) = $1664 230 feet 3. Description of Real Property: That property described as Parcel C as shown on Altered Map of Tract 2263 filed October 8, 1962 in Book 13, Page 57 in the Office of the Kern County Recorder, excepting therefrom the Northerly 132.88 feet of said parcel; and also described as Kern County Assessor's Parcel 338-103-17. 4.
