RESOLUTION NO. 53-87
A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ORDERING THE VACATION OF A PORTION
OF SUMNER STREET AND ALLEY WITHIN BLOCKS 86
AND 87 BETWEEN UNION AVENUE AND SACRAMENTO
STREET IN THE CITY OF BAKERSFIELD.
WHEREAS, on March 11, 1987, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets,
Highways and Service Easements Vacation Law," being Chapter 3 of
Part 3 of Division 9 of the Streets and Highways Code of the State
of California, passed and a~opted its Resolution of intention No.
1022 declaring its intention to order the vacation of a portion of
Sumner Street and Alley within Blocks 86 and 87 between Union
Avenue and Sacramento Street in the City of Bakersfield, County of
Kern, State of California; and
WHEREAS, said Council did fix a time and place for hear-
ing all persons interested in or objecting to said proposed vaca-
tion, which said hearing was held on April 8, 1987, after notices
were duly published and posted as required by law; and
WHEREAS, this Council after duly considering the matter,
does hereby find and resolve as follows:
1. That a portion of Sumner Street and alley within
blocks 86 and 87 between Unisn Avenue and Sacramento Street in the
City of Bakersfield, County of Kern, State of California, more par-
ticularly described in Exhibit "A" attached hereto and made a part
hereof, is unnecessary for present or prospective public street
purposes.
2. That a portion of Sumner Street and alley within
blocks 86 and 87 between Union Avenue and Sacramento Street, in
the City of Bakersfield, be and the same is hereby closed up,
vacated and abandoned for public street purposes, subject to
and in conformity with any reservations and exceptions contained
in and contemplated by said Resolution of Intention No. 1022.
Reference to said Resolution of Intention is hereby made for fur-
ther particulars.
3. That the City Clerk shall certify to the passage of
this Resolution and shall cause a certified copy hereof, attested
by the Clerk under the seal of the City, to be recorded in the
office of the County Recorder of the County of Kern, California.

EXHIBIT "A"

Two (2) parcels of land situated in the City of Bakersfield, formerly known as
the Town of Kern, in the City of Bakersfield, County of Kern, State of
California per map recorded January 12, 1889 in Book 1 at Pages 15 and 16 of
Maps in the Office of the Rern County Recorder.
PARCEL 1
Beginning at a point in the North line of Sumner Street (80 feet wide) from
which the intersection of said North line of Sumner Street with the East
line of Union Avenue (115.50 feet wide) bears N. 73°08'36" West, a distance
of 132.65 feet;
Thence (1) S. 73°08'36" E., along the North line of said Sumner Street (80 feet
wide) a distance of 285.08 feet;
Thence (2) S. 40°50'30" E., a distance of 1.24 feet;
Thence (3) along a tangent circular curve, concave to the North, having a
radius of 545.00 feet, through a central angle of 24°31'45", a distance of
233.32 feet to a point on the South line of said Sumner Street;
Thence (4) N. 73°08'36" W., along last named South line of Sumner Street a
distance of 508.11 feet:;
Thence (5) N. 20°02'19" E., a distance of 80.12 feet to the Point of Beginning.
EXCEPTING THEREFROM any portion of aforedescribed Parcel 1 falling East of a
Northerly extension of the West line of Sacramento Street.
EXCEPTING THEREFROM as a reservation of an easement for public utilities
purposes the southerly 5 feet of the westerly 25 feet of aforedescribed
Parcel 1.
PARCEL 2
Beginning at a point in the North line of the alley (20 feet wide) in Blocks
86 and 87, as shown on said "Town of Kern" Map, from which the intersection
of said North line with the East line of Union Avenue (115.50 feet wide)
bears N. 73°08'36" W., a distance of 53.59 feet;
Thence (1) S. 73°08'36' E., along the North line of said alley, a distance of
499.03 feet to the west line of Sacramento Street (80 feet wide);
Thence (2) S. 16°51'24" W., along last named West line, a distance of 20.00
feet to the South line of said alley;
Thence (3) N. 73°08'36" W., along last named South line, a distance of
500.14 feet;
Thence (4) N. 20°02'19"' E., a distance of 20.03 feet to the point of
beginning.
EXCEPTING THEREFROM as a reservation of an easement for public utilities
purposes and for public sewer line purposes all of aforedescribed Parcel 2.
