WHEREAS, o:n March 11, 1987, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1021 declaring its intention to order the abandonment of a 50 foot portion of dedicateJ vehicular access rights on the west side of Ashe Road between District Boulevard and White Lane in the City of Bakersfield, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hear- ing all persons interested in or objecting to said proposed vaca- tion, which said hearing was held on April 8, 1987, after notices were duly published and posted as required by law; and WHEREAS, this Council after duly considering the matter, does hereby find and resolve as follows: 1. That a 50 foot portion of dedicated vehioular access rights on the west side of Ashe Road between District Boulevard and White Lane in the City of Bakersfield, County of Kern, State of California, more particularly described in Exhibit "A" attached hereto and made a part hereof, is unnecessary for pre- sent or prospective public street purposes. 2. That a 50 foot portion of dedicated vehicular access rights on the west side of Ashe Road between District Boulevard and White Lane in the City of Bakersfield, be and the same is here- by closed up, vacated and abandoned for public street purposes, subject to and in conformity with any reservations and exceptions contained in and contemplated by said Resolution of Intention No. 1021. Reference to said Resolution of Intention is hereby made for further particulars. 3. That the City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the office of the County Recorder of the County of Kern, California. .......... 000 .......... C I~P~ORNEY of the City of Bakersfield AJS/MEG R RES 4 R.1021 -2- 6326 0894 EXHIBIT "A" A 50.00 foot portion of the East right of way line of Ashe Road in the southeast quarter of Section 16, T. 30 S., R. 27 E., M.D.B.& M. in the City of Bakersfield, County of Kern, State of California, as said right of way is described by Deed recorded December 14, 1982 in Book 5510, Page 1441 of Official Records in the Office of the Kern County Recorder, more particularly described as follows: One 50.00 foot portion of said West right of way line falling within the limits of the South 240 feet of the North 480 feet of Parcel l as shown on Parcel Map No. 6963 filed December 27, 1983 in Book 30 of Parcel Maps, Page 83 in the Office of the Kern County Recorder. 5 Legal.4
