RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD SUPPORTING LEGISLATION TO
REPEAL CHAPTER 164 OF THE STATUTES OF
1984.
WHEREAS, in 1983 the Kern County Board of Supervisors
requested then State Senator Walter Stiern to author and carry
forward a bill that would permit a portion of Heritage Park to be
used for the needed expansion of juvenile court facilities without
providing replacement parklands as required by the Public Park
Preservation Act of 1971; and
WHEREAS, in 1984 Senator Stiern authored such a bill
(Senate Bill No. 1475) which was enacted by the L~gislature~
approved by the Governor and became law (Chapter 164 of the
Statutes of 1984); and
WHEREAS, this law required the holding of at least one
public hearing prior to constructing juvenile court facilities on
not more than 5.0 acres of the 19.83 acre Heritage Park site; and
WHEREAS, the Kern County Board of Supervisors scheduled,
noticed and held a public hearing on this matter on December 15,
1986, which hearing was continued; and
WHEREAS, on December 29~ 1986, a meeting was held at the
East Bakersfield Veterans Hall, adjacent to Heritage Park, to ena-
ble County staff to directly address the questions and concerns
raised by, and receive the comments of, residents of the com-
munity; and
WHEREAS, as a result of the public's and staff's comments
on this matter the Board of Supervisors has evaluated the desira-
bility of ~educing the size of Meritage Park to accommodate the
expansion of juvenile court facilities and at this time desires to
declare its intention that Heritage Park remain its present size;
and
WHEREAS, the City of Bakersfield has supported policies
for providing park and open space opportunities for the Citizens
of Bakersfield and Heritage Park contributes to the availability
of park and open space in Greater ~akersfield; and
WHEREAS, toward this end, City Council desires that
Chapter 164 of the Statutes of 1984 be repealed.
NOW, THEREFORE BE IT RESOLVED that at this time the City
of Bakersfield, County of Kern, State of California, finds, deter-
mines and declares the following:
1. That ~{eritage Park is valued by the co~m~unity it ser-
ves and area residents desire to see it remain its present size.
That ~teritage Park should not be reduced in size.
3. That the Legislature should repeal Chapter 164 of the
Statutes of 1984.
BE IT FURTHER RESOLVED that the Nayor be authorized and
directed to request this area's State Legislators eupport legisla-
tion to repeal Chapter 164 of the Statutes of 1984.
BE IT FURTHER RESOLVED that the City Clerk shall forward
copies of this Resolution to the following:

Assemblyman Harvey
Mary K. Shell
Chairman, Board of Supervisors
County Administrative Officer
County Counsel
